Mitteametlik tõlge

Eesti Vabariigi Valitsus ja Rootsi Kuningriigi Valitsus, soovides võimaldada hädavajalikku meditsiinilist abi ühe lepingupoole elanikele, kes ajutiselt viibivad teise lepingupoole territooriumil, on kokku leppinud alljärgnevas:


Artikkel 1

1. Käesolevas lepingus tähendab «meditsiiniline abi»:

a) Eesti puhul, meditsiinilist abi vastavalt Eesti ravikindlustusseadusandlusele,

b) Rootsi puhul, meditsiinilist abi vastavalt Rootsi haiguskindlustus-seadusandlusele.

2. Käesolev leping kehtib ka kogu seadusandluse suhtes, mis asendab, parandab, täiendab või ühendab käesoleva artikli 1. lõikes viidatud seadusandlust.


Artikkel 2

1. Käesolev leping kehtib ühe lepingupoole elaniku kohta, kellel vastavalt selle lepingupoole artiklis 1 viidatud seadusandlusele on õigus meditsiinilisele abile ja kes on kas:

a) ajutiselt teise lepingupoole territooriumil; või

b) teise lepingupoole territooriumil kui esimesena mainitud lepingupoole poolt rajatud diplomaatilise esinduse juht või selle esinduse või konsulaarasutuse personali liige või sellise isiku perekonnaliige, kes ühtlasi kuulub sellise isiku leibkonda, või sellise isiku isiklik teenija.

2. Käesolev leping ei kehti isikute kohta, kes saabuvad kummagi lepingupoole territooriumile spetsiaalselt meditsiinilise abi saamiseks.


Artikkel 3

1. Isikud, kelle kohta kehtib artikli 2 lõige 1 a ning kes, viibides teise lepingupoole territooriumil, vajavad vältimatut meditsiinilist abi, saavad nimetatud abi samadel tingimustel nagu isikud, kelle suhtes kehtib selle lepingupoole seadusandlus. Nimetatud abi antakse kuni nende paranemiseni või kuni nende tervislik seisund võimaldab neil tagasi pöörduda või olla tagasi saadetud selle lepingupoole territooriumile, kus nad alaliselt elavad.

2. Isikutele, kelle kohta kehtib artikli 2 lõige 1 b, antakse meditsiinilist abi samadel tingimustel, nagu isikutele, kelle suhtes kehtib teise lepingupoole seadusandlus, olenemata sellest, kas abi on koheselt vajalik või mitte ja sõltumata abi andva lepingupoole territooriumil viibimise ajast.
3. Isikud, kelle kohta kehtib artikli 2 lõige 1, saavad vanusest olenemata koheselt hädavajalikku hambaravi.


Artikkel 4

1. Käesoleva lepingu kohaselt antava arstiabi kulud ei kuulu lepingupoolte vahelisele arveldamisele.

2. Iga summa, mis käesoleva lepingu põhjal tuleb maksta seoses meditsiinilise abi osutamisega lepingupoole territooriumil, tasub isik, kellele meditsiinilist abi antakse.


Artikkel 5

Selleks, et saada õigust meditsiinilisele abile teise lepingupoole territooriumil käesoleva lepingu kohaselt, esitab seda taotlev isik:

a) Eesti elanike puhul kas kehtiva Eesti passi kinnitusega, et selle omanik elab Eestis, või Eesti haigekassa poolt väljaantud haiguskindlustuse tõendi; ning

b) Rootsi elanike puhul kas kehtiva Rootsi passi või Rootsi Sotsiaalkindlustusameti poolt väljaantud haiguskindlustuse tõendi.


Artikkel 6

1. Pädevad ametkonnad käesoleva lepingu rakendamiseks on:

a) Eestis — Sotsiaalministeerium,

b) Rootsis — Riiklik Sotsiaalkindlustuse Amet.

2. Pädevad ametkonnad saadavad teineteisele niipea kui võimalik andmed kõigi muudatuste kohta nende territooriumidel kehtivates seadustes ja määrustes, mis võivad oluliselt mõjutada käesoleva lepingu kohaselt antavate teenuste iseloomu ja ulatust.

3. Käesoleva lepingu rakendamisega seotud küsimused lahendatakse konsultatsioonidega pädevate ametkondade vahel.


Artikkel 7

1. Käesolev leping jõustub kolmanda kuu esimesel päeval, mis järgneb kuule, mil lepingupooled on teineteisele diplomaatiliste kanalite kaudu teatanud, et jõustumiseks vajalikud juriidilised ja põhiseaduslikud nõuded on täidetud.

2. Käesolev leping jääb jõusse kuni 12 kuu möödumiseni päevast, mil üks lepingupooltest saab teiselt diplomaatiliste kanalite kaudu kirjaliku teate teise lepingupoole otsusest lõpetada käesolev leping.

3. Juhul kui käesolev leping lõpetatakse vastavalt käesoleva artikli lõikele 2, jätkub selle lepingu kehtivus seoses meditsiinilise abiga, mida anti enne teadet või selles lõikes viidatud perioodi jooksul.

Ülaltoodu kinnituseks on selleks oma vastavate valitsuste poolt kohaselt volitatud isikud alla kirjutanud käesolevale lepingule.

Agreement between the Government of the Republic of Estonia
and the Government of the Kingdom of Sweden
on Medical Care for Temporary Visitors

The Government of the Republic of Estonia and the Government of the Kingdom of Sweden,

Desirous of facilitating the provision of immediately necessary medical care for residents of the territory of one Party temporarily in the territory of the other Party,

Have agreed as follows:

Article 1

1. For the purposes of this Agreement "medical care" means:
a) in relation to Estonia, medical care under the Estonian health insurance legislation;
b) in relation to Sweden, medical care under Swedish sickness insurance legislation.

2. This Agreement shall apply also to any legislation which replaces, amends, supplements or consolidates the legislation referred to in paragraph 1 of the present Article.


Article 2

1. This Agreement applies to a resident of the territory of one Party who is entitled to medical care under the legislation of that Party referred to in Article 1 and is either:

a) temporarily in the territory of the other Party; or

b) in the territory of the other Party as the head of or a member of the staff of a diplomatic mission or consular post, established there by the first mention Party, or a member of the family of that person who also forms part of the household of that person or a personal servant of that person.

2. This Agreement does not apply to persons who enter the territory of one of the Parties for the specific purpose of seeking medical care.


Article 3

1. Persons to whom paragraph 1 a) of Article 2 applies, in need of immediately necessary medical care while in the territory of the other Party, shall receive such care under the same conditions as apply to persons covered by the legislation of that Party. Such care shall be provided until their recovery or until their state of health permits them to return or to be repatriated to the territory of the Party where they reside.

2. Persons to whom paragraph 1 b) of Article 2 applies, shall be provided with medical care under the same conditions as apply to persons covered by the legislation of the other Party, whether or not the care is immediately necessary and regardless of the length of the stay in the territory of the party in which the care is provided.

3. Persons to whom paragraph 1 of Article 2 applies shall be provided with immediately necessary dental care regardless of their age.


Article 4

1. The costs of medical care provided under this Agreement shall not be subject to the settlement of accounts between the Parties.

2. Any amount which is payable in respect of medical care provided in the territory of a Party by virtue of this Agreement shall be borne by the person in respect of whom the medical care is provided.


Article 5

In order to get the right to medical care under this Agreement in the territory of the other Party, the person applying for the care shall present:

a) in relation to residents in Estonia, either a current Estonian passport endorsed to the effect that the holder is residing in Estonia or a sickness insurance certificate issued by an Estonian Sickness Insurance Office; and

b) in relation to Sweden, either a current Swedish passport or a sickness insurance certificate issued by a Swedish Social Insurance Office.

Article 6

1. The competent authorities for the application of this Agreement are:
a) in relation to Estonia, the Ministry of Social Affairs,
b) in relation to Sweden, the National Social Insurance Board.

2. The competent authorities shall send to each other as soon as possible details of any changes in laws and regulations in force in their respective territories which may significantly affect the nature and scope of services provided under this Agreement.

3. Matters relating to the implementation of this Agreement shall be resolved by consultation between the competent authorities.

Article 7

1. This Agreement shall enter into force on the first day of the third month following the month in which both Parties have notified each other through the diplomatic channel that their respective legal and constitutional requirements for the entry into force have been fulfilled.

2. This Agreement shall remain in force until the expiration of 12 months from the date on which either Party receives from the other a written notice through the diplomatic channel of the other Partys decision to terminate this Agreement.

3. In the event that this Agreement is terminated in accordance with paragraph 2 of the present Article, the Agreement shall continue to have effect in relation to medical care which was being provided prior to or at the expiry of the period of the notice referred to in that paragraph.

In witness whereof the undersigned, duly authorized thereto by their respective Governments, have signed this Agreement.
