Ekstsellents,

Mul on au teatada, et olen kätte saanud Teie Ekstsellentsi tänase kuupäevaga noodi, mis on järgmine:

«Mul on au teha Teie Ekstsellentsile ettepanek sõlmida turistide viisanõude kaotamise kokkulepe, et lihtsustada vastastikusel alusel Tšiili Vabariigi kodanike reisimist Eesti Vabariigi territooriumile ja Eesti Vabariigi kodanike reisimist Tšiili Vabariigi territooriumile (edaspidi «lepingupooled») ning süvendada sõbralikke suhteid ja soodustada riikidevahelist kaubandust. Lepingutingimused on järgmised:
1. Tšiili Vabariigi kodanikud ja Eesti Vabariigi kodanikud, kellel on kodaniku pass (ja nende pereliikmed, kes on sellisesse passi sisse kantud), on vabastatud viisakohustusest teise lepingupoole territooriumile sisenedes, sellelt territooriumilt lahkudes või sealt läbi sõites, kui nad kuue kuu jooksul ei viibi seal üle 90 päeva.
2. Eelmises lõikes nimetatud passide omanikud peavad teise lepingupoole territooriumil viibides järgima seal kehtivaid seadusi ja eeskirju.
2.1. Nimetatud passide omanikud võivad viibida Tšiili või Eesti territooriumil kuni üheksakümmend (90) päeva kuue (6) kuu, vajaduse korral mitu korda sisenedes. Seda perioodi võivad kummagi riigi pädevad ametiasutused vajaduse korral pikendada võrdsete perioodide võrra.
3. Kokkulepe ei piira Tšiili Vabariigi ega Eesti Vabariigi õigust põhjendust esitamata keelata oma territooriumile siseneda teise lepingupoole kodanikul, keda peetakse ebasoovitavaks või vastuvõetamatuks, või saata selline kodanik oma territooriumilt välja.
4. Lepingupool võib riikliku julgeoleku, avaliku korra või tervishoiu huvides peatada kas täielikult või osaliselt turistide viisakohustuse kaotamise kokkuleppe täitmise, teavitades kohe diplomaatiliste kanalite kaudu teist lepingupoolt oma otsusest peatada täitmine või see taastada.
5. Kokkulepe jõustub 30. päeval pärast nootide vahetamist. Lepingupooled vahetavad kokkuleppe jõustumisest arvates 30 päeva jooksul diplomaatiliste kanalite kaudu oma tavalise passi näidised.
5.1. Kui passi vormi muudetakse, saadab lepingupool teisele lepingupoolele diplomaatiliste kanalite kaudu 30 päeva enne muutmist kirjaliku teatise koos uue passi näidisega.
6. Kokkulepe on jõus määramata aja. Kui lepingupool soovib kokkulepet lõpetada, teavitab ta sellest kirjalikult diplomaatiliste kanalite kaudu teist lepingupoolt. Sellisel juhul lõpeb kokkulepe asjaomase teatise kättesaamise kuupäevast arvates 90 päeva pärast.
6.1. Kui lepingupooled peavad seda vajalikuks, võivad nad pärast konsultatsioonide pidamist lisada kokkuleppele täiendavaid sätteid või teha selles muudatusi.

Kui eeltoodu on Eesti Vabariigi valitsusele vastuvõetav, siis käesolev noot ja Teie Ekstsellentsi vastunoot, mis kinnitab Eesti Vabariigi valitsuse nõusolekut, moodustavad turistide viisanõude kaotamise kokkuleppe mõlema riigi kodanike jaoks, kes sisenevad teise lepingupoole territooriumile.»

Mul on edasi au kinnitada Eesti Vabariigi valitsuse nimel ülaltoodud ettepanekut ja nõustuda, et Teie Ekstsellentsi noot ja käesolev noot moodustavad kahe valitsuse vahel turistide viisanõude kaotamise kokkuleppe.

Ma kasutan juhust kinnitada Teie Ekstsellentsile oma sügavaimat lugupidamist.

AGREEMENT BETWEEN THE REPUBLIC OF ESTONIA AND THE REPUBLIC OF CHILE
ON THE EXEMPTION OF THE TOURIST VISA REQUIREMENT

Excellency,

I have the honour to acknowledge the receipt of Your Excellency’s Note of today’s date, which reads as follows:

“I have the honour to propose to Your Excellency an Agreement on the Exemption of the Tourist Visa Requirement to facilitate the trips of nationals from the Republic of Chile to the territory of the Republic of Estonia and of nationals of the Republic of Estonia to the territory of the Republic of Chile (hereinafter referred to as “Contracting Parties”), on a reciprocal basis, to further the bonds of the friendly relations and promoting trade between both Parties. The terms of this Agreement would be as follows:

1. The nationals of the Republic of Chile and the nationals of the Republic of Estonia, holders of valid ordinary passports (as well as their dependants included in the same passport of the holder) shall be exempt from the tourist visa requirement for entering the territory of the other Contracting Party, to abandon such territory or to transit through it, whose stay may not exceed 90 days during 6 months.

2. The holders of ordinary passports as referred to in the above paragraph shall observe the relevant laws and regulations of the other Contracting Party while staying in its territory.

2.1. The holders of the passports mentioned above may stay for up to ninety (90) days during six (6) months in the Chilean or Estonian territory, as case may be with multiple re-entries. This period may be extended by the relevant authorities of each country for equal periods.

3. This Agreement does not restrict the right of the Republic of Chile or the Republic of Estonia, to prohibit the entry to their respective territories of any national of the other Contracting Party considered undesirable or unacceptable or to terminate his/her stay in its territory without stating the cause.

4. Either Contracting Party temporarily suspend wholly or partially, the implementation of this Agreement on Exemption of Tourist Visas due to reasons of national security, public order or public Health, giving prompt notice in writing to the other Contracting Party, through diplomatic channels, of its decision to suspend or resume its implementation.

5. This Agreement shall enter into force on the 30th day following the exchange of the Notes. Within the 30 days following the exchange of the Notes the Contracting Parties shall exchange through diplomatic channels the specimens of their valid ordinary passports.

5.1. In case of modification of its passport format, either Contracting Party shall send to the other Contracting Party, through diplomatic channels, the corresponding 30 day prior written notice with a specimen of its new passport.

6. This Agreement shall have an indefinite term of duration. Should either Contracting Party be willing to denounce this Agreement, its shall give notice in writing to the Contracting Party, through diplomatic channels. In this case, this Agreement shall expire 90 days after the date of the relevant notice.

6.1. Should the Contracting Parties deem it appropriate, upon consultation, they may introduce additional clauses or amendments to the present Agreement.

Should the above proposal be acceptable to the Government of the Republic of Estonia, this Note, together with Your Excellency’s reply communicating such acceptance, shall constitute an Agreement on Exemption of the Tourist Visa Requirement for nationals of both Parties entering into the territory of the other Contracting Party.”

I have further the honour to confirm on behalf of the Government of the Republic of Estonia the foregoing arrangements and to agree that Your Excellency’s Note and this Note shall be regarded as constituting an Agreement on Exemption of the Tourist Visa Requirement between the two Governments.

I avail myself of this opportunity to extend to Your Excellency the assurances of my highest consideration.
