Teadaanne välislepingu jõustumise kohta

Koostatud 1. märtsil 2004. a Sofias, jõustus 1. aprillil 2004. a

Eesti Vabariigi valitsus ja Bulgaaria Vabariigi valitsus (edaspidi «lepingupooled»),

toetudes kahe riigi sõbralikele suhetele,

soovides tunda ja mõista paremini teineteise rahva kultuuri ja ajalugu,

olles veendunud, et hariduse, teaduse ja kultuuri areng on selles kõige olulisem,

on kokku leppinud järgmises.

Artikkel 1

Lepingupooled edendavad haridus-, teadus- ja kultuurikoostööd kokkuleppe põhimõtete kohaselt.

Artikkel 2

1. Lepingupooled edendavad üliõpilaste, kraadiõppurite, lektorite, stipendiaatide, õpetajate ja teadlaste ning teiste haridusekspertide vahetust.

2. Lepingupooled annavad oma vahendite piires vastastikku stipendiume ülikooli- ja kraadiõppeks ning uurimistööks kõrgkoolides.

Artikkel 3

Lepingupooled edendavad oma vahendite piires teise lepingupoole keele õppimist ja õpetamist kõrgkoolides ning teistes haridus- ja teadusasutustes.

Artikkel 4

1. Lepingupooled kooskõlastavad aeg-ajalt koostööplaane ning uurimisvaldkondi, mida nad peavad oluliseks ühiste teaduseesmärkide saavutamisel.

2. Lepingupooled määravad vastastikusel kokkuleppel kindlaks prioriteedid teaduseesmärkide saavutamiseks.

3. Teadus- ja tehnoloogiakoostöö tihendamiseks toetavad lepingupooled:
a. teadus- ja tehnoloogiateabe vahetust;
b. ekspertide ja spetsialistide vahetust;
c. ühiskonverentside ja -seminaride korraldamist;
d. ühist osalemist Euroopa teadusprogrammides;
e. kokkulepitavates valdkondades ühiste teadus- ja muude uuringute ning programmide läbiviimist;
f. spetsiaalsete andmebaaside loomist ning mõlema juurdepääsu tagamist neile.

4. Lepingupooled toetavad ja soodustavad selliste riiklike ja eraõiguslike teadusorganisatsioonide ja -asutuste kontakte ja koostööd, kus ollakse valmis uue tehnoloogia kasutuselevõtuks.

5. Lepingupooled toetavad ja arendavad vastastikuste kokkulepete alusel tervishoiu ja arstiteaduse valdkonna koostööd.

Artikkel 5

Lepingupooled arendavad mõlemale kasulikku kultuurikoostööd. Lepingupooled astuvad samme, et tutvustada teise poole kunsti ja kultuuriväärtusi, tehes need üldsusele kättesaadavaks ning edendades riiklikke, asutustevahelisi ja isiklikke kontakte.

Artikkel 6

Lepingupooled edendavad muuseumide, kultuurimälestiste kaitsega tegelevate asutuste, raamatukogude ja kirjastajate koostööd ning raamatute, ajalehtede, ajakirjade ja muude perioodiliste väljaannete vahetamist.

Artikkel 7

Lepingupooled vahetavad aegsasti teavet rahvusvaheliste võistluste, festivalide, konverentside ning teiste riigis toimuvate kultuuri- ja kunstiürituste kohta.

Artikkel 8

Lepingupooled teevad koostööd UNESCOs ning tihendavad kahe riigi UNESCO rahvuslike komisjonide sidemeid.

Artikkel 9

Et kaitsta rahvuslikku pärandit, kohustuvad lepingupooled tõkestama ebaseaduslikku kaubitsemist kunstiteoste, dokumentide ja muude ajalooliste, arheoloogiliste või muinasesemetega ning tagama nende kaitse ajutise sisseveo korral.

Artikkel 10

Lepingupooled soodustavad poliitilise, sotsiaalse ja kultuurielu puudutava teabe vahetamist, et teineteist rohkem tundma õppida ja mõista.

Artikkel 11

Lepingupooled teevad koostööd meedia valdkonnas, vahetades teavet, programme ja materjale. Lepingupooled soodustavad raadio- ja televisiooniorganisatsioonide ning telegraafiagentuuride vahetut koostööd.

Artikkel 12

Lepingupooled aitavad luua filmi- ja audiovisuaalse tööstuse ühistööde jaoks soodsaid tingimusi kooskõlas riiklike õigusaktide ja rahvusvaheliste kohustustega.

Artikkel 13

Lepingupooled teevad intellektuaalomandi kaitse koostööd nende suhtes kehtivate asjakohaste välislepingute kohaselt.

Artikkel 14

Lepingupooled edendavad rahvusarhiivide koostööd, võimaldades vaba juurdepääsu neile ning soodustades kogemuste, dokumentide koopiate, publikatsioonide ja erialakirjanduse vahetamist riiklike õigusaktide kohaselt.

Artikkel 15

Lepingupooled toetavad noortevahetusi ning edendavad noorsootöö spetsialistide, noorteorganisatsioonide ja -ühingute otsekontakte.

Artikkel 16

Lepingupooled toetavad ja arendavad spordikoostööd, edendades asjakohaste spordiorganisatsioonide ja -ühingute ning spordiseltside ja -klubide otsekontakte; koostöö ulatuse ja üksikasjad määravad kindlaks asjaomased asutused.

Artikkel 17

Lepingupooled soodustavad valitsustevaheliste ja valitsusväliste organisatsioonide kaudu tehtavat koostööd.

Artikkel 18

Kokkuleppe alusel korraldatavad tegevused ning vahetuste rahalised ja muud tingimused määratakse kindlaks asjaomaste ministeeriumide kolmeaastastes koostööprogrammides ning asjaomaste valdkondade asutuste ja organisatsioonide koostöö kokkulepetes.

Artikkel 19

Kokkulepe jõustub päeval, mil lepingupooled saavad teineteiselt viimase teate selle kohta, et kokkuleppe jõustumiseks nõutavad riiklikud tingimused on täidetud.

Kokkulepe on sõlmitud määramata ajaks. Kumbki lepingupool võib kokkuleppe lõpetada, teatades oma kavatsusest kirjalikult diplomaatiliste kanalite kaudu kuus kuud ette.

Koostatud 1. märtsil 2004. aastal Sofias kahes originaaleksemplaris eesti, bulgaaria ja inglise keeles; kõik tekstid on võrdselt autentsed. Tõlgenduserinevuste korral võetakse aluseks ingliskeelne tekst.

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF ESTONIA AND THE GOVERNMENT OF THE REPUBLIC OF BULGARIA ON CO-OPERATION IN THE FIELDS OF EDUCATION, SCIENCE AND CULTURE
Done at Sofia on 1 March 2004, in force as of 1 April 2004

The Government of the Republic of Estonia and the Government of the Republic of Bulgaria (hereinafter referred to as “the Parties”)

Based on the friendly relations between the two countries,

Led by their desire for better mutual knowledge and understanding of the cultural and historical knowledge of the peoples of the two countries,

Convinced that for this aim the development in the field of education, science and culture has a paramount importance,

have agreed as follows:

Article 1

The Parties encourage the co-operation in the fields of education, science and culture, according to the principles based on this Agreement.

Article 2

1. The Parties shall encourage the exchange of university students, postgraduates, lecturers, scholars, teachers and scientists as well as other experts in the field of education.

2. The Parties shall award, within the availability of their resources and on a reciprocal basis, scholarships for university and postgraduate studies as well as for research in institutions of higher education.

Article 3

The Parties shall encourage within the availability of their resources the teaching and study of the language of the other Party in the institutions of higher education and other educational and scientific institutions.

Article 4

1. The Parties shall periodically coordinate their plans for co-operation and areas of research that they consider essential for achieving common scientific goals.

2. The Parties shall define by mutual agreement their priorities in pursuing their scientific goals.

3. In order to intensify their co-operation in the fields of science and technology the Parties shall foster:
a. the exchange of scientific and technological information;
b. the exchange of experts and specialists;
c. the organization of joint conferences and seminars;
d. joint participation in European scientific programs;
e. the carrying out of joint research, studies and programs in the fields to be agreed upon;
f. creation and mutual access to specialised data bases.

4. The Parties shall support and contribute to the development of contacts and co-operation between their state or private scientific organizations and institutions that are relevant for the introduction of new technologies.

5. The Parties shall support and develop the co-operation in the field of health and medical sciences on the basis of mutual agreements.

Article 5

The Parties shall develop their bilateral cultural co-operation on mutually beneficial basis. The Parties shall make the efforts to popularise art and cultural values of the other Party, making them widely accessible for its citizens and encourage the state, public and individual contacts.

Article 6

The Parties shall encourage the co-operation between museums, institutions for protection of monuments of culture, libraries, publishers, as well as exchange of books, newspapers, magazines and periodicals.

Article 7

The Parties shall exchange information in due time about international competitions, festivals, conferences and other activities in the field of culture and arts on their territory.

Article 8

The Parties shall encourage the co-operation within UNESCO and the interrelations between the National UNESCO Commissions of their two states.

Article 9

The Parties shall, in order to protect their national heritage, undertake to prevent the illegal traffic of works of art, documents and other objects of historical, archaeological or heritage value, as well as to ensure their safety while temporarily imported.

Article 10

The Parties shall encourage the exchange of information about their political, social and cultural life aiming at widening the mutual knowledge and understanding.

Article 11

The Parties shall co-operate in the field of mass media through exchange of information, programmes, and materials. They encourage the direct co-operation between their respective radio and television institutions and telegraph agencies.

Article 12

The Parties shall contribute to the creation of favourable conditions for co-production in the field of film and audio-visual industries according to their national legislation and international obligations.

Article 13

The Parties shall co-operate in the field of intellectual property protection in accordance with the relevant international agreements to which they are Parties.

Article 14

The Parties shall encourage the co-operation between their national archives providing free access to them and facilitating exchange of experience and exchange of copies of documentation, publications, and specialized literature in accordance with their national legislation.

Article 15

The Parties shall support the youth exchange and encourage direct contacts between the youth work specialists, youth organizations and associations.

Article 16

The Parties shall support and develop the co-operation in the field of sports and by encouraging direct contacts between respective sports organisations and associations, sports societies and clubs of which the framework and details of this co-operation shall be decided directly between such authorities.

Article 17

The Parties promote the co-operation in the framework of governmental and non-governmental organizations.

Article 18

The specific activities under this Agreement, the financial and other conditions concerning the exchange shall be determined in three-year programs for co-operation between the relevant Ministries and separate Agreements for direct co-operation between similar institutions and organizations in the respective areas.

Article 19

This Agreement shall enter into force on the receiving date of the last notification in which the Parties notify each other of the completion of necessary internal legal procedures required for the entry into force of this Agreement.

This Agreement is concluded for an indefinite period of time. Each Party may terminate it by notifying of its intent in writing through diplomatic channels at least six months prior to the termination.

Done at Sofia on the 1 of March in the year two thousand and four in two original copies, each in Estonian, Bulgarian and English languages, all texts being equally authentic. In case of divergence of interpretation, the English text shall prevail.
