Välisministeeriumi teadaanne välislepingu jõustumise kohta
Muude ainetega kui nafta reostuse korral avamerel sekkumise 1973. aasta protokolli lisa muudatused
Protokolliosalised,
olles 29. novembril 1969 Brüsselis koostatud naftareostuse korral avamerel sekkumise rahvusvahelise konventsioon osalised;
võttes arvesse 1969. aastal toimunud rahvusvahelisel juriidilisel merereostuskahju konverentsil vastu võetud resolutsiooni, milles käsitleti muude saasteainete kui nafta suhtes tehtavat rahvusvahelist koostööd;
võttes veel arvesse, et nimetatud resolutsiooni kohaselt on Valitsustevaheline Meresõidu Konsultatiivorganisatsioon koostöös kõikide asjahuviliste rahvusvaheliste organisatsioonidega tõhustanud oma tegevust kõikides aspektides, mis puudutavad merereostust muude ainetega kui nafta,
on kokku leppinud järgmises.
I artikkel
1. Protokolliosalised võivad avamerel võtta vajalikke meetmeid, et ära hoida, vähendada või kõrvaldada suurt ja otsest ohtu, mida põhjustab nende rannikule või sellega seotud huvidele reostus või reostusoht muude ainetega kui nafta, mis järgneb laevaõnnetusele või sellega seotud tegevusele ning millel võivad olla ulatuslikud kahjulikud tagajärjed.
2. Lõikes 1 nimetatud muud ained kui nafta on:
a) need
ained, mis on loetletud organisatsiooni määratud asjakohase organi
koostatud nimekirjas ning mis lisatakse käesolevale protokollile, ja
b)
muud ained, mis võivad ohustada inimese tervist, tekitada kahju
elusressurssidele ning mere loomastikule ja taimestikule, kahjustada
puhketingimusi või takistada muud mere õiguspärast kasutamist.
3. Kui sekkuv osalisriik võtab meetmeid lõike 2 punktis b nimetatud aine suhtes, peab ta tõendama, et see aine võib olukorda arvestades kujutada suurt ja otsest ohtu analoogiliselt lõike 2 punktis a viidatud nimestikus loetletud mis tahes ainele.
II artikkel
1. 1969. aasta naftareostuse korral avamerel sekkumise rahvusvahelise konventsiooni I artikli lõige 2, II–VIII artikli ja selle konventsiooni lisa naftat käsitlevaid sätteid kohaldatakse käesoleva protokolli I artiklis nimetatud ainete suhtes.
2. Käesoleva protokolli eesmärgil täiendatakse konventsiooni III artikli punktis c ja IV artiklis toodud ekspertide nimekirja, et see sisaldaks eksperte, kes on pädevad andma nõu muude ainete suhtes kui nafta. Nimekirja võivad kandidaate esitada nii organisatsiooni liikmesriigid kui ka käesoleva protokolli osalisriigid.
III artikkel
1. I artikli lõike 2 punktis a toodud nimekirja haldab organisatsiooni määratud asjakohane organ.
2. Protokolliosalise esitatud muudatusettepanek nimekirja kohta esitatakse organisatsioonile, kes edastab selle kõigile organisatsiooni liikmesriikidele ja protokolliosalistele vähemalt kolm kuud enne muudatusettepaneku läbivaatamist asjakohases organis.
3. Protokolliosalistel, olenemata sellest, kas nad on organisatsiooni liikmesriigid, on õigus osaleda asjakohase organi istungitel.
4. Muudatused võetakse vastu ainult kohal olevate ja hääletamisel osalevate protokolliosaliste kahekolmandikulise häälteenamusega.
5. Kui muudatus võetakse vastu kooskõlas lõikega 4, edastab organisatsioon selle kõikidele protokolliosalistele heakskiitmiseks.
6. Muudatus loetakse heakskiidetuks kuue kuu möödumisel pärast selle edastamist, välja arvatud juhul, kui vähemalt kolmandik protokolliosalistest on sama ajavahemiku jooksul esitanud organisatsioonile vastuväite muudatuse suhtes.
7. Kolme kuu möödumisel muudatuse heakskiitmisest lõike 6 kohaselt jõustub see kõigi protokolliosaliste suhtes, välja arvatud need, kes on enne seda kuupäeva deklareerinud, et ei nõustu asjakohase muudatusega.
IV artikkel
1. Protokoll on avatud allakirjutamiseks riikidele, kes on II artiklis nimetatud konventsioonile alla kirjutanud või sellega ühinenud, ja igale riigile, keda on kutsutud osalema 1973. aasta rahvusvahelisele merereostuse konverentsile. Protokoll jääb allakirjutamiseks avatuks 15. jaanuarist 1974 kuni 31. detsembrini 1974 organisatsiooni peakorteris.
2. Lõike 4 kohaldamisel võivad protokolli ratifitseerida või heaks kiita riigid, kes on sellele alla kirjutanud.
3. Lõike 4 kohaldamisel on protokoll avatud ühinemiseks riikidele, kes ei ole sellele alla kirjutanud.
4. Protokolli võivad ratifitseerida või heaks kiita ainult need riigid, kes on II artiklis nimetatud konventsiooni ratifitseerinud, heaks kiitnud või sellega ühinenud.
V artikkel
1. Ratifitseerimiseks, heakskiitmiseks või ühinemiseks antakse asjakohane dokument hoiule organisatsiooni peasekretärile.
2. Ratifitseerimis-, heakskiitmis- või ühinemiskiri, mis antakse hoiule pärast protokolli muudatuse jõustumist kõikide protokolliosaliste suhtes või kõikide protokolliosaliste suhtes muudatuse jõustumiseks nõutavate meetmete lõpuleviimist, loetakse kehtivaks muudetud protokolli suhtes.
VI artikkel
1. Protokoll jõustub üheksakümnendal päeval pärast kuupäeva, mil viisteist riiki on organisatsiooni peasekretärile hoiule andnud ratifitseerimis-, heakskiitmis- või ühinemiskirjad. Protokoll ei jõustu siiski enne II artiklis nimetatud konventsiooni jõustumist.
2. Riigi suhtes, kes protokolli hiljem ratifitseerib, heaks kiidab või sellega ühineb, jõustub protokoll üheksakümnendal päeval pärast asjakohase dokumendi hoiuleandmist.
VII artikkel
1. Protokolliosaline võib protokolli denonsseerida alati pärast kuupäeva, mil protokoll on selle osalisriigi suhtes jõustunud.
2. Denonsseerimiseks antakse asjakohane dokument hoiule organisatsiooni peasekretärile.
3. Denonsseerimine jõustub ühe aasta möödumisel või denonsseerimiskirjas nimetatud pikema ajavahemiku möödumisel selle hoiuleandmisest organisatsiooni peasekretärile.
4. Kui osalisriik denonsseerib II artiklis nimetatud konventsiooni, loetakse, et ta denonsseerib ka käesoleva protokolli. Denonsseerimine jõustub samal kuupäeval kui konventsiooni artikli XII lõike 3 kohane denonsseerimine.
VIII artikkel
1. Organisatsioon võib kokku kutsuda konverentsi protokolli uuesti läbivaatamiseks või muutmiseks.
2. Organisatsioon kutsub kokku protokolliosaliste konverentsi protokolli uuesti läbivaatamiseks või muutmiseks vähemalt ühe kolmandiku protokolliosaliste taotlusel.
IX artikkel
1. Protokoll antakse hoiule organisatsiooni peasekretärile.
2. Organisatsiooni peasekretär:
a) teeb kõigile protokollile
alla kirjutanud või sellega ühinenud riikidele teatavaks iga:
i)
allakirjutamise või kirja hoiuleandmise ja selle kuupäeva;
ii)
protokolli jõustumise kuupäeva;
iii) protokolli
denonsseerimiskirja hoiuleandmise ja denonsseerimise jõustumise kuupäeva;
iv)
protokolli või selle lisa muudatuse ning vastuväite või avalduse
asjakohase muudatusega mittenõustumise kohta.
b) edastab
protokolli kinnitatud ja tõestatud koopiad kõikidele riikidele, kes on
protokollile alla kirjutanud või sellega ühinenud.
X artikkel
Protokolli jõustumise järel edastab organisatsiooni peasekretär viivitamata selle tõestatud koopia Ühinenud Rahvaste Organisatsiooni sekretariaadile registreerimiseks ja avaldamiseks kooskõlas Ühinenud Rahvaste Organisatsiooni põhikirja artikliga 102.
XI artikkel
Protokoll on koostatud ühes eksemplaris hispaania, inglise, prantsuse ja vene keeles; kõik neli teksti on võrdselt autentsed.
Selle kinnituseks on täievolilised esindajad protokollile alla kirjutanud.
Koostatud Londonis novembrikuu teisel päeval tuhande üheksasaja seitsmekümne kolmandal aastal.

1973. AASTA SEKKUMISE PROTOKOLLI I ARTIKLI LÕIKE 2 PUNKTIS A NIMETATUD AINETE LOETELU
1973. aasta sekkumise protokolli kohaldatakse järgmistele ainetele, kui neid veetakse lastina laeva pardal, või selliselt veetud ainete jäätmetele.
1. Naftasaadused, mis on määratletud 1973. aasta rahvusvahelise laevade põhjustatava merereostuse vältimise konventsiooni I lisas (muudetud 1978. aasta protokolliga, edaspidi MARPOL 73/78) ja mida veetakse mahtlastina, sealhulgas I lisas loetletud naftasaadused, välja arvatud 1969. aasta sekkumise konventsioonis käsitletud toornafta, vedelkütus, diisliõli ja määrdeõli.
2. Kahjulikud vedelained, mis on määratletud MARPOL 73/78
II lisas (koos muudatustega), mida veetakse vedellastina ja mis on
nimetatud:
saastusastmega A või B
rahvusvahelise ohtlikku
kemikaali mahtlastina vedava laeva ehituse ja seadmete koodeksi (IBC
koodeks) 17. peatükis või
merekeskkonna kaitse komitee
MEPC.2 iga aasta detsembris avaldatavate ringkirjade loeteludes 1–4 või
koos
perioodiliselt BLG ringkirjana avaldatavas GESAMP ohtlike omaduste
liitnimekirjas, kas
a 2 veerus B ja XX veerus E või
XXX
veerus E.
3. Kahjulikud ained, pakendatud kujul, mis on määratletud MARPOL 73/78 III lisas (koos muudatustega) ning mida loetakse tõsisteks merereostusaineteks (PP) rahvusvahelise ohtlike kaupade mereveo eeskirja kohaselt (edaspidi IMDG) või mis vastavad IMDG koodeksis kehtestatud kriteeriumitele.
4. Radioaktiivsed ained, mida veetakse B- või C-tüüpi pakendites või lõhustuva materjalina või eritingimustes IMDG koodeksi 7. klassi kohaselt.
5. Vedelgaasid, mis on määratletud 1983. aasta rahvusvahelise veeldatud gaasi vedellastina vedava laeva ehituse ja seadmete koodeksi (koos muudatustega, edaspidi IGC koodeks) 19. peatükis ja mida veetakse vedellastina, ning tooted, mille veoks on administratsioon ja asjassepuutuvad sadama-administratsioonid eelnevalt kehtestanud vajalikud tingimused kooskõlas IGC koodeksi lõikega 1.1.6.

PROTOCOL RELATING TO INTERVENTION ON THE HIGH SEAS IN CASES OF POLLUTION BY SUBSTANCES OTHER THAN OIL, 1973
London, 2 November 1973
The Parties to the Present Protocol,
Being Parties to the International Convention relating to Intervention on the High Seas in Cases of Oil Pollution Casualties, done at Brussels on 29 November 1969,
Taking into account the Resolution on International Co-operation concerning Pollutants other than Oil adopted by the International Legal Conference on Marine Pollution Damage, 1969,
Further taking into account that pursuant to the Resolution, the Inter-Governmental Maritime Consultative Organization has intensified its work, in collaboration with all interested international organizations, on all aspects of pollution by substances other than oil,
Have agreed as follows:
Article I
1. Parties to the present Protocol may take such measures on the high seas as may be necessary to prevent, mitigate or eliminate grave and imminent danger to their coastline or related interests from pollution or threat of pollution by substances other than oil following upon a maritime casualty or acts related to such a casualty, which may reasonably be expected to result in major harmful consequences.
2. “Substances other than oil” as referred to in paragraph 1 shall be:
(a)
those substances enumerated in a list which shall be established by an
appropriate body designated by the Organization and which shall be
annexed to the present Protocol, and
(b) those other substances which
are liable to create hazards to human health, to harm living resources
and marine life, to damage amenities or to interfere with other
legitimate uses of the sea.
3. Whenever an intervening Party takes action with regard to a substance referred to in paragraph 2(b) above that Party shall have the burden of establishing that the substance, under the circumstances present at the time of the intervention, could reasonably pose a grave and imminent danger analogous to that posed by any of the substances enumerated in the list referred to in paragraph 2(a) above.
Article II
1. The provisions of paragraph 2 of Article I and of Articles II to VIII of the Convention Relating to Intervention on the High Seas in Cases of Oil Pollution Casualties, 1969, and the Annex thereto as they relate to oil, shall be applicable with regard to the substances referred to in Article I of the present Protocol.
2. For the purpose of the present Protocol the list of experts referred to in Articles III(c) and IV of the Convention shall be extended to include experts qualified to give advice in relation to substances other than oil. Nominations to the list may be made by Member States of the Organization and by Parties to the present Protocol.
Article III
1. The list referred to in paragraph 2(a) of Article I shall be maintained by the appropriate body designated by the Organization.
2. Any amendment to the list proposed by a Party to the present Protocol shall be submitted to the Organization and circulated by it to all Members of the Organization and all Parties to the present Protocol at least three months prior to its consideration by the appropriate body.
3. Parties to the present Protocol whether or not Members of the Organization shall be entitled to participate in the proceedings of the appropriate body.
4. Amendments shall be adopted by a two-thirds majority of only the Parties to the present Protocol present and voting.
5. If adopted in accordance with paragraph 4 above, the amendment shall be communicated by the Organization to all Parties to the present Protocol for acceptance.
6. The amendment shall be deemed to have been accepted at the end of a period of six months after it has been communicated, unless within that period an objection to the amendment has been communicated to the Organization by not less than one-third of the Parties to the present Protocol.
7. An amendment deemed to have been accepted in accordance with paragraph 6 above shall enter into force three months after its acceptance for all Parties to the present Protocol, with the exception of those which before that date have made a declaration of non-acceptance of the said amendment.
Article IV
1. The present Protocol shall be open for signature by the States which have signed the Convention referred to in Article II or acceded thereto, and by any State invited to be represented at the International Conference on Marine Pollution 1973. The Protocol shall remain open for signature from 15 January 1974 until 31 December 1974 at the Headquarters of the Organization.
2. Subject to paragraph 4 of this Article, the present Protocol shall be subject to ratification, acceptance or approval by the States which have signed it.
3. Subject to paragraph 4, this Protocol shall be open for accession by States which did not sign it.
4. The present Protocol may be ratified, accepted, approved or acceded to only by States which have ratified, accepted, approved or acceded to the Convention referred to in Article II.
Article V
1. Ratification, acceptance, approval or accession shall be effected by the deposit of a formal instrument to that effect with the Secretary-General of the Organizations.
2. Any instrument of ratification, acceptance, approval or accession deposited after the entry into force of an amendment to the present Protocol with respect to all existing Parties or after the completion of all measures required for the entry into force of the amendment with respect to all existing Parties shall be deemed to apply to the Protocol as modified by the amendment.
Article VI
1. The present Protocol shall enter into force on the ninetieth day following the date on which fifteen States have deposited instruments of ratification, acceptance, approval or accession with the Secretary-General of the Organization, provided however that the present Protocol shall not enter into force before the Convention referred to in Article II has entered into force.
2. For each State which subsequently ratifies, accepts, approves or accedes to it, the present Protocol shall enter into force on the ninetieth day after the deposit by such State of the appropriate instrument.
Article VII
1. The present Protocol may be denounced by any Party at any time after the date on which the Protocol enters into force for that Party.
2. Denunciation shall be effected by the deposit of an instrument to that effect with the Secretary-General of the Organization.
3. Denunciation shall take effect one year, or such longer period as may be specified in the instrument of denunciation, after its deposit with the Secretary-General of the Organization.
4. Denunciation of the Convention referred to in Article II by a Party shall be deemed to be a denunciation of the present Protocol by that Party. Such denunciation shall take effect on the same day as the denunciation of the Convention takes effect in accordance with paragraph 3 of Article XII of that Convention.
Article VIII
1. A conference for the purpose of revising or amending the present Protocol may be convened by the Organization.
2. The Organization shall convene a conference of Parties to the present Protocol for the purpose of revising or amending it at the request of not less than one-third of the Parties.
Article IX
1. The present Protocol shall be deposited with the Secretary-General of the Organization.
2. The Secretary-General of the Organization shall:
(a) inform all
States which have signed the present Protocol or acceded thereto of:
(i)
each new signature or deposit of an instrument together with the date
thereof;
(ii) the date of entry into force of the present Protocol;
(iii)
the deposit of any instrument of denunciation of the present Protocol
together with the date on which the denunciation takes effect;
(iv)
any amendments to the present Protocol or its Annex and any objection or
declaration of nonacceptance of the said amendment;
(b) transmit
certified true copies of the present Protocol to all States which have
signed the present Protocol or acceded thereto.
Article X
As soon as the present Protocol enters into force, a certified true copy thereof shall be transmitted by the Secretary-General of the Organization to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.
Article XI
The present Protocol is established in a single original in the English, French, Russian and Spanish languages, all four texts being equally authentic.
In witness whereof the undersigned being duly authorized for that purpose have signed the present Protocol.

LIST OF SUBSTANCES REFERRED TO IN PARAGRAPH 2(A) OF ARTICLE I OF THE
1973 INTERVENTION PROTOCOL
Adopted on 11 October, 2002
Any of the following products are subject to the 1973 Intervention Protocol if they are either carried on board a ship as cargo or are residues of such products previously carried:
1. Oils, as defined in Annex I to the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating thereto (MARPOL 73/78), as amended, when carried in bulk, including those listed in Appendix I with the exception of crude oil, fuel oil, diesel oil and lubricating oil which are covered by the 1969 Intervention Convention;
2. Noxious Liquid Substances, as defined in Annex II to MARPOL 73/78, as
amended, when carried in bulk, and identified:
.1 as Pollution
Category A or B, in:
.1 Chapter 17 of the International Bulk Chemical
Code (IBC Code); or
.2 Lists 1 to 4 of MEPC.2/Circulars, issued
annually in December; or
.2 in the composite list of GESAMP Hazard
Profiles, issued periodically as BLG Circulars, with either:
.1 a ‘2’
in column B and ‘XX’ in column E; or
.2 ‘XXX’ in column E;
3. Harmful substances, in packaged form, as defined in Annex III to MARPOL 73/78, as amended, and which have been identified as Severe Marine Pollutants (PP) in the International Maritime Dangerous Goods Code (IMDG Code) or which meet the criteria for such as defined in the IMDG Code;
4. Radioactive material, transported in type B or type C packages, or as fissile material, or under special arrangements, as covered by the provisions of class 7 of the IMDG Code; and
5. Liquefied gases, identified in chapter 19 of the International Code for the Construction and Equipment of Ships Carrying Liquefied Gases in Bulk, 1983 (IGC Code), as amended, when carried in bulk, and the products for which preliminary suitable conditions for the carriage have been prescribed by the Administration and port administrations involved in accordance with paragraph 1.1.6 of the IGC Code.
