Madalmaade Kuningriigi Välisministeerium avaldab lugupidamist Eesti Vabariigi suursaatkonnale ning tal on au viidata uutele õigusnõuetele, mis reguleerivad Schengeni liikmesriikide esindamist Schengeni viisade menetlemisel ja väljastamisel. Uued õigusnõuded on sätestatud Euroopa Parlamendi ja nõukogu 13. juuli 2009 määruse (EÜ) nr 810/2009, millega kehtestatakse ühenduse viisaeeskiri (viisaeeskiri), artiklis 8, mida kohaldatakse alates 5. aprillist 2010.
Madalmaade Kuningriigi Välisministeerium kavatseb viisaeeskirja kohaldamisel säilitada kõik kehtivad kokkulepped Eesti Vabariigiga.
Madalmaade Kuningriigi Välisministeerium teeb ettepaneku sõlmida järgmine Schengeni viisaküsimustes esindamise kokkulepe.
1. Esindamise ulatus
Alates 12. aprillist 2010 esindab Madalmaade Kuningriik Eesti Vabariiki Schengeni viisaküsimustes kooskõlas viisaeeskirjaga järgmistes kohtades:

Alates 12. aprillist 2010 esindab Eesti Vabariik Madalmaade Kuningriiki Schengeni viisaküsimustes kooskõlas viisaeeskirjaga järgmistes kohtades:

Esindamine tähendab:
a) avalikkuse teavitamist;
b) viisa väljastamist, kui see on kohane;
c)
viisa väljastamisest keeldumist, kui see on kohane, ning kaebuste
menetlemist esindava liikmesriigi õiguse kohaselt.
2. Esindamise tingimused
a) Viisataotlusi menetletakse ja viisad väljastatakse kooskõlas viiseeskirjas sätestatud menetluste, tingimuste ja kriteeriumidega.
b) Liikmesriik ei vastuta teise liikmesriigi nimel tehtud toimingute eest, välja arvatud viisaeeskirjas ettenähtud juhtudel.
c) Viisatasu (viisaeeskirja artikkel 16) jääb esindavale liikmesriigile.
d) Esindav liikmesriik võib teha koostööd välise teenuseosutajaga ühes või mitmes asukohas kooskõlas viisaeeskirjas sätestatud tingimustega.
e) Taotleja esitatavad lisadokumendid peavad olema tõlgitud esindava liikmesriigi konsulaadi töökeelde.
f) Kui eelnev konsulteerimine teiste liikmesriikidega on nõutav (kooskõlas viisaeeskirja artikliga 22), korraldab seda esindatav liikmesriik Schengeni konsultatsioonivõrgustiku tehniliste spetsifikatsioonide punkti 2.1.1.2 (dokument nr 5124/08) kohaselt. Menetlust muudetakse niipea, kui mõlemal poolel on seadusandlik ja tehniline valmisolek selleks, et konsulteerimist korraldab esindav riik.
g) Esindav riik teavitab teisi liikmesriike (viisaeeskirja artikli 31 kohaselt).
h) Küsimuste korral, eriti kui need puudutavad kutsujat või sponsorit, võib esindava liikmesriigi konsulaat võtta ühendust esindatava liikmesriigi keskse ja/või kohaliku kontaktpunktiga. Kontaktpunktide nimekiri on lisatud (lisa 1). Juhul, kui vastust ei anta seitsme kalendripäeva jooksul, võib esindav liikmesriik eeldada, et esindataval liikmesriigil ei ole vastuväiteid viisa väljastamise kohta.
i) Esindatav liikmesriik võtab kohustuse koordineerida esindava liikmesriigiga riikide, kus teda esindatakse, reisidokumentide tunnustamist. Esindav liikmesriik teavitab esindatavat liikmesriiki uutest reisidokumentidest, mida need riigid väljastavad, ning palub esindatava liikmesriigi jaoks näidiseid.
j) Igas riigis, kus liikmesriiki esindatakse, võib esindatava liikmesriigi kohalik (või keskne) kontaktpunkt esitada esindava liikmesriigi konsulaadile nimekirja isikutest, äriühingutest ja asutustest, kes on esindatava liikmesriigi jaoks riikliku tähtsusega või on esindatavale liikmesriigile hästi tuntud. Esindav liikmesriik lihtsustab viisataotluste menetlust selle kategooria isikute suhtes ning võimaldab neil esitada taotlusi nagu oma sarnase kategooria isikutel. Lihtsustus võib puudutada taotluste esitamist, otsuse tegemise tähtaega, paindlikkust lisadokumentide esitamise suhtes ning mitmekordsete viisade väljastamist kehtivusega kuuest kuust kuni viie aastani.
k) Iga aasta kohta ja esindatava liikmesriigi taotlusel esitab esindav liikmesriik igas riigis esindatava liikmesriigi nimel väljastatud ja keeldutud viisade statistika.
l) Kokkuleppe rakendamise võib üle vaadata igal aastal ning eelkõige juhul, kui viisataotluste arv esindatavasse liikmesriiki kasvab.
3. Lõppsätted
Esindamise kokkulepe jõustub ja seda hakatakse kohaldama 12. aprillil 2010; kokkulepe kehtib määramata aja, välja arvatud juhul, kui:
– seda muudetakse mõlema liikmesriigi kirjalikul nõusolekul;
–
üks liikmesriikidest peatab selle täielikult või osaliselt. See
liikmesriik teavitab võimaluse korral teist liikmesriiki peatamisest
vähemalt 30 päeva varem, märkides peatamise põhjuse;
–
üks liikmesriikidest lõpetab kokkuleppe, teavitades teist liikmesriiki
kirjalikult. Kokkulepe kaotab kehtivuse 30 päeva möödumisel teate
saamisest.
Kokkuleppe jõustumise kuupäeval lõpetatakse 27. jaanuaril 2009, 27. märtsil 2009 ja 2. novembril 2009 nootide vahetamise teel sõlmitud viisaküsimustes esindamise kokkulepped.
Kui ülaltoodu on Eesti Vabariigile vastuvõetav, on Madalmaade Kuningriigi Välisministeeriumil au teha ettepanek, et käesolev noot ja Eesti Vabariigi suursaatkonna vastusnoot moodustavad kahe riigi valitsustevahelise kokkuleppe.
Madalmaade Kuningriigi Välisministeerium kasutab avanenud võimalust, et veel kord avaldada Eesti Vabariigi suursaatkonnale oma sügavaimat austust.

VERBAALNOOT
Eesti Vabariigi suursaatkond avaldab oma lugupidamist Madalmaade Kuningriigi Välisministeeriumile ning tal on au viidata ministeeriumi 9. aprilli 2010 noodile nr DCM/VV/229/10-ES, mille sisu oli järgmine.
„Madalmaade Kuningriigi Välisministeerium avaldab lugupidamist Eesti Vabariigi suursaatkonnale ning tal on au viidata uutele õigusnõuetele, mis reguleerivad Schengeni liikmesriikide esindamist Schengeni viisade menetlemisel ja väljastamisel. Uued õigusnõuded on sätestatud Euroopa Parlamendi ja nõukogu 13. juuli 2009 määruse (EÜ) nr 810/2009, millega kehtestatakse ühenduse viisaeeskiri (viisaeeskiri), artiklis 8, mida kohaldatakse alates 5. aprillist 2010.
Madalmaade Kuningriigi Välisministeerium kavatseb viisaeeskirja kohaldamisel säilitada kõik kehtivad kokkulepped Eesti Vabariigiga.
Madalmaade Kuningriigi Välisministeerium teeb ettepaneku sõlmida järgmine Schengeni viisaküsimustes esindamise kokkulepe.
1. Esindamise ulatus

2. Esindamise tingimused

Liikmesriik ei vastuta teise liikmesriigi nimel tehtud toimingute eest,
välja arvatud viisaeeskirjas ettenähtud juhtudel.
c)
Viisatasu (viisaeeskirja artikkel 16) jääb esindavale liikmesriigile.
d)
Esindav liikmesriik võib teha koostööd välise teenuseosutajaga ühes või
mitmes asukohas kooskõlas viisaeeskirjas sätestatud tingimustega.
e)
Taotleja esitatavad lisadokumendid peavad olema tõlgitud esindava
liikmesriigi konsulaadi töökeelde.
f) Kui eelnev
konsulteerimine teiste liikmesriikidega on nõutav (kooskõlas
viisaeeskirja artikliga 22), korraldab seda esindatav liikmesriik
Schengeni konsultatsioonivõrgustiku tehniliste spetsifikatsioonide
punkti 2.1.1.2 (dokument nr 5124/08) kohaselt. Menetlust muudetakse
niipea, kui mõlemal poolel on seadusandlik ja tehniline valmisolek
selleks, et konsulteerimist korraldab esindav riik.
g) Esindav riik
teavitab teisi liikmesriike (viisaeeskirja artikli 31 kohaselt).
h)
Küsimuste korral, eriti kui need puudutavad kutsujat või sponsorit, võib
esindava liikmesriigi konsulaat võtta ühendust esindatava liikmesriigi
keskse ja/või kohaliku kontaktpunktiga. Kontaktpunktide nimekiri on
lisatud (lisa 1). Juhul kui vastust ei anta seitsme kalendripäeva
jooksul, võib esindav liikmesriik eeldada, et esindataval liikmesriigil
ei ole vastuväiteid viisa väljastamise kohta.
i) Esindatav
liikmesriik võtab kohustuse koordineerida esindava liikmesriigiga

esindatava liikmesriigi kohalik (või keskne) kontaktpunkt esitada
esindava liikmesriigi konsulaadile nimekirja isikutest, äriühingutest ja
asutustest, kes on esindatava liikmesriigi jaoks riikliku tähtsusega või
on esindatavale liikmesriigile hästi tuntud. Esindav liikmesriik
lihtsustab viisataotluste menetlust selle kategooria isikute suhtes ning
võimaldab neil esitada taotlusi nagu oma sarnase kategooria isikutel.
Lihtsustus võib puudutada taotluste esitamist, otsuse tegemise tähtaega,
paindlikkust lisadokumentide esitamise suhtes ning mitmekordsete viisade
väljastamist kehtivusega kuuest kuust kuni viie aastani.
k) Iga
aasta kohta ja esindatava liikmesriigi taotlusel esitab esindav
liikmesriik igas riigis esindatava liikmesriigi nimel väljastatud ja
keeldutud viisade statistika.
l) Kokkuleppe rakendamise võib üle
vaadata igal aastal ning eelkõige juhul, kui viisataotluste arv
esindatavasse liikmesriiki kasvab.

Suursaatkond kinnitab, et ülaltoodu on Eesti Vabariigile vastuvõetav. Seega ministeeriumi noot ja see vastusnoot moodustavad Eesti Vabariigi ja Madalmaade Kuningriigi Schengeni viisaküsimustes esindamise kokkuleppe, mis jõustub käesoleva vastusnoodi kättesaamise kuupäeval.

The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the Embassy of the Republic of Estonia and has the honour to refer to the new legal framework for the representation of Schengen States for the purpose of examining applications and issuing Schengen visas. This new legal framework is contained in Article 8 of the Regulation (EC) No 810/2009 of the European Parliament and of the Council of 13 July 2009 establishing a Community Code on Visas (Visa Code) and will apply from 5 April 2010.
The Ministry of Foreign Affairs of the Kingdom of the Netherlands has the intention to maintain all the existing arrangements with the authorities of the Republic of Estonia once the Visa Code is applicable.
The Ministry of Foreign Affairs of the Kingdom of the Netherlands proposes to conclude the representation arrangement with regard to Schengen visas as follows:
1. Extent of representation
As of 12 April 2010 the Kingdom of the Netherlands will represent the Republic of Estonia in accordance with the Visa Code with regard to all types of Schengen visas at the following locations.

a. informing the public;
b. issuing the visa when appropriate;
c.
refusing to issue the visa when appropriate and dealing with appeals, in
accordance with the national law of the representing Member State.
2. Conditions of representation
a. Visa applications will be assessed and visas issued in accordance
with the procedures, conditions and criteria laid down in the Visa Code.
a.
Except in the cases specified in the Visa Code, a Member State cannot be
held liable for activities performed on behalf of the other Member State.
c.
The visa fee (art. 16 of the Visa Code) is for the representing Member
State.
d. The representing Member State may work with an external
service provider at one or more locations, in accordance with and under
the conditions stipulated by the Visa Code.
e. The supporting
documents submitted by the applicant may need to be translated into (one
of) the working language(s) used by the consulate of the representing
Member State.
f. When applicable, prior consultation with other
Member States (in accordance with art. 22 of the Visa Code) will be
carried out by the represented Member State, as specified in point
2.1.1.2 of the Schengen Consultation Network Technical Specifications
(doc. 5124/08). This procedure will be amended as soon as both parties
have the legislation and technical conditions in place to enable the
representing country to conduct these consultations. g. As applicable,
notification of other Member States will be carried out by the
representing country (in accordance with art. 31 of the Visa Code).
h.
In the event of questions, in particular when related to the inviting
party or sponsor, the representing Member State’s consulate may contact
the central and/or local contact point of the represented Member State.
A list of contact points is attached (Annex 1). If an answer is not
provided within seven calendar days, the representing Member State may
assume that the represented Member State does not object to the visa
being issued.
i. The represented Member State undertakes to
coordinate with the representing Member State on the recognition of
travel documents issued by the country/countries where it is
represented. The representing Member State will inform the represented
Member State of new travel documents issued by these countries and
request specimens for the represented Member State.
j. For each
location where it is represented, the represented Member State’s local
(or central) contact point(s) may provide the consulate of the
representing Member State with a list of persons, companies and
institutions that are of national importance to or are well known in the
represented Member State. The representing Member State will facilitate
the visa application process for parties in this category and grant them
the same level of access for submission of applications as it does for
parties in its own similar category. Facilitation may relate to the
provision of access for submission of applications, the duration of a
decision, leniency concerning supporting documents and the issuing of
multiple entry visas with a period of validity ranging from six months
to five years.
k. On a yearly basis and upon request by the
represented Member State, the representing Member State will provide
statistical data for each location on visas issued and refused on behalf
of the represented Member State.
l. The practical implementation of
this arrangement may be reviewed on a yearly basis and in particular if
the number of visa applications for the represented Member State is
increasing.
3. Final provisions
This representation arrangement will enter into force and apply from 12 April 2010 and will remain valid for an indefinite period, unless:
– it is amended by written mutual consent of both Member States;
–
it is suspended in whole or in part by one of the Member States. This
Member State will, if possible, notify the other Member State
accordingly, if possible at least 30 days in advance, stating the
reason(s) for the suspension;
– one of the Member States terminates
this arrangement by giving written notice of termination to the other
Member State. This arrangement will cease to be valid 30 days after the
date of the receipt of such notification.
On the date of entry into force of this arrangement the previous arrangements on visa representation concluded by the exchange of notes on 27 January 2009, 27 March 2009 and 2 November 2009 are terminated.
If the foregoing proposal is acceptable to the Republic of Estonia, the Ministry of Foreign Affairs of the Kingdom of the Netherlands has the honour to suggest that the present Note Verbale and the reply Note from the Embassy of the Republic of Estonia to that effect shall constitute an agreement between our two Governments.
The Ministry of Foreign Affairs of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Embassy of the Republic of Estonia the assurances of their highest consideration.

representing country to conduct these consultations. g. As applicable,
notification of other Member States will be carried out by the
representing country (in accordance with art. 31 of the Visa Code).
h.
In the event of questions, in particular when related to the inviting
party or sponsor, the representing Member State’s consulate may contact
the central and/or local contact point of the represented Member State.
A list of contact points is attached (Annex 1). If an answer is not
provided within seven calendar days, the representing Member State may
assume that the represented Member State does not object to the visa
being issued.
i. The represented Member State undertakes to
coordinate with the representing Member State on the recognition of
travel documents issued by the country/countries where it is
represented. The representing Member State will inform the represented
Member State of new travel documents issued by these countries and
request specimens for the represented Member State.
j. For each
location where it is represented, the represented Member State’s local
(or central) contact point(s) may provide the consulate of the
representing Member State with a list of persons, companies and
institutions that are of national importance to or are well known in the
represented Member State. The representing Member State will facilitate
the visa application process for parties in this category and grant them
the same level of access for submission of applications as it does for
parties in its own similar category. Facilitation may relate to the
provision of access for submission of applications, the duration of a
decision, leniency concerning supporting documents and the issuing of
multiple entry visas with a period of validity ranging from six months
to five years.
k. On a yearly basis and upon request by the
represented Member State, the representing Member State will provide
statistical data for each location on visas issued and refused on behalf
of the represented Member State.
l. The practical implementation of
this arrangement may be reviewed on a yearly basis and in particular if
the number of visa applications for the represented Member State is
increasing.
3. Final provisions
This representation arrangement will enter into force and apply from 12 April 2010 and will remain valid for an indefinite period, unless:
– it is amended by written mutual consent of both Member States;
–
it is suspended in whole or in part by one of the Member States. This
Member State will, if possible, notify the other Member State
accordingly, if possible at least 30 days in advance, stating the
reason(s) for the suspension;
– one of the Member States terminates
this arrangement by giving written notice of termination to the other
Member State. This arrangement will cease to be valid 30 days after the
date of the receipt of such notification.
On the date of entry into force of this arrangement the previous arrangements on visa representation concluded by the exchange of notes on 27 January 2009, 27 March 2009 and 2 November 2009 are terminated.
If the foregoing proposal is acceptable to the Republic of Estonia, the Ministry of Foreign Affairs of the Kingdom of the Netherlands has the honour to suggest that the present Note Verbale and the reply Note from the Embassy of the Republic of Estoniato that effect shall constitute an agreement between our two Governments.
The Ministry of Foreign Affairs of the Kingdom of the Netherlands avails itself of this opportunity to renew to the Embassy of the Republic of Estonia the assurances of their highest consideration.”
The Embassy confirms that the foregoing is acceptable to the Republic of Estonia. Accordingly the Ministry’s Note and this reply Note shall constitute the Arrangement between the Republic of Estonia and the Kingdom of the Netherlands on the representation with regard to Schengen visas, which shall enter into force on the date of the receipt of this reply Note.
The Embassy of the Republic of Estonia avails itself of this opportunity to renew to the Ministry of Foreign Affairs and Cooperation of the Kingdom of Spain the assurances of its highest consideration.
