Eesti Vabariigi valitsuse ja Aserbaidžaani Vabariigi valitsuse diplomaatiliste passide kasutajate suhtes viisanõude kaotamise kokkulepe

Eesti
Vabariigi valitsus ja Aserbaidžaani Vabariigi valitsus, edaspidi pooled,
soovides arendada kahe riigi sõbralikke suheteid ning vastastikust koostööd;
soovides lihtsustada diplomaatiliste passide kasutajate sisenemist Eesti Vabariiki ja Aserbaidžaani Vabariiki,
on kokku leppinud järgmises.
Artikkel 1
1. Eesti Vabariigi kodanikud, kellel on kehtiv diplomaatiline pass, võivad siseneda Aserbaidžaani Vabariigi territooriumile, sealt lahkuda, seda läbida ning seal viibida ilma viisata kuni 90 päeva kuue kuu jooksul saabumise päevast arvates.
2. Aserbaidžaani Vabariigi kodanikud, kellel on kehtiv diplomaatiline pass, võivad siseneda Eesti Vabariigi territooriumile, sealt lahkuda, seda läbida ning seal viibida ilma viisata kuni 90 päeva kuue kuu jooksul saabumise päevast arvates.
Artikkel 2
Kokkuleppega kehtestatud viisanõude kaotamine ei vabasta artiklis 1 nimetatud passide kasutajaid riiki sisenemist, riigis viibimist ja riigist lahkumist käsitlevate õigusaktide täitmisest.
Artikkel 3
Kokkulepe ei piira kummagi poole pädevate asutuste õigust mitte lubada riiki siseneda ja seal viibida isikutel, keda peetakse ebasoovitavaks.
Artikkel 4
1. Pooled võivad kokkuleppe kohaldamise täielikult või osaliselt peatada julgeoleku, tervise või avaliku korra huvides.
2. Peatamise ja selle lõpetamise otsusest teatatakse diplomaatiliste kanalite kaudu viivitamata teisele poolele; peatamine ja lõpetamine jõustuvad kaks päeva pärast sellekohase teate saamist.
Artikkel 5
1. Pooled vahetavad kokkuleppes nimetatud passide näidised diplomaatiliste kanalite kaudu hiljemalt 30 päeva enne kokkuleppe jõustumist.
2. Kui pool võtab kasutusele uue passi või muudab neid, mille näidised edastati, teatatakse sellest diplomaatiliste kanalite kaudu hiljemalt 30 päeva enne uue passi või muudatuste jõustumist, lisades uue dokumendi näidise.
Artikkel 6
1. Kokkulepe on sõlmitud määramata ajaks. Pooled teavitavad teineteist kirjalikult kokkuleppe jõustumiseks vajalike riigisiseste nõuete täitmisest. Kokkulepe jõustub 30. päeval arvates päevast, mil saadakse kätte viimane selline teade.
2. Kokkulepet võib muuta poolte kirjalikul nõusolekul. Muudatused tehakse eraldi protokollidena, mis on kokkuleppe lahutamatud osad ja jõustuvad kokkuleppe jõustumiseks ettenähtud korra kohaselt.
3. Kumbki pool võib kokkuleppe lõpetada, teatades sellest diplomaatiliste kanalite kaudu; kokkulepe kehtib sellekohase teate saamisest arvates veel 90 päeva.
Koostatud 7. aprillil 2010. aastal Tallinnas kahes eksemplaris eesti, aserbaidžaani ja inglise keeles; kõik tekstid on võrdselt autentsed.Tõlgenduserinevuste korral võetakse aluseks ingliskeelne tekst.

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF ESTONIA AND THE GOVERNMENT OF THE REPUBLIC OF AZERBAIJAN
ON ABOLITION OF VISA REQUIREMENT FOR THE HOLDERS OF DIPLOMATIC PASSPORTS
The Government of the Republic of Estonia and the Government of the Republic of Azerbaijan,
hereinafter referred to as “the Parties”,
desirous to further contribute to the strengthening of the friendly relations between both States and to the development of reciprocal cooperation,
wishing to facilitate the movement of their holders of diplomatic passports to the Republic of Estonia and to the Republic of Azerbaijan,
have agreed as follows:
Article 1
1. The nationals of the Republic of Estonia holding valid diplomatic passports may enter, leave, transit through and stay on the territory of the Republic of Azerbaijan without a visa up to ninety days within six months, since the day of arrival.
2. The nationals of the Republic of Azerbaijan holding valid diplomatic passports may enter, leave, transit through and stay on the territory of the Republic of Estonia without a visa up to ninety days within six months, since the day of arrival.
Article 2
The abolishment of the visa requirement established in this Agreement does not exempt holders of such passports mentioned in Article 1, to observe the laws and rules in force related to the entry into, stay in and departure from the state territories of the respective Parties.
Article 3
This Agreement does not affect the right of the competent authorities of any of the Parties to deny the entry into or stay in their territories to those persons considered undesirable.
Article 4
1. The Parties may totally or partially suspend the application of this Agreement due to national security reasons, health or public order preservation.
2. The decision on adoption and termination of such measures shall be immediately notified to the other Party through diplomatic channels and shall enter into force two days after the date of the receipt of such notification.
Article 5
1. The Parties shall exchange samples of the passports mentioned in this Agreement through diplomatic channels not later than thirty days before the entry into force of this Agreement.
2. Whenever any of the Parties issues a new passport or modifies those already exchanged, such modifications shall be notified through diplomatic channels not later than thirty days before the date the new passports or modifications enter into force, enclosing a sample of the new document.
Article 6
1. This Agreement has been concluded for an indefinite period of time. The Parties shall notify each other in writing when their internal legal procedures necessary for the entry into force of this Agreement have been fulfilled. This Agreement shall enter into force on the thirtieth day following the date of receipt of the latter notification.
2. This Agreement may be amended in writing by the mutual consent of the Parties. Such amendments being an integral part of this Agreement shall be made in the form of separate Protocols and shall enter into force according to the same procedure as the Agreement.
3. This Agreement may be terminated by any of the Parties by giving prior notification through diplomatic channels and shall remain valid ninety days following the date of the receipt of such notification.
Done at Tallinn on the 7 April 2010 in two originals in the Estonian, Azerbaijani and English languages, all texts being equally authentic. In the case of any divergence of interpretation of this Agreement, the English text shall prevail.
