Briti suursaatkond Tallinnas annab edasi oma tervitused Eesti Vabariigi Välisministeeriumile ning tal on au viidata Suurbritannia ja Põhja-Iirimaa Ühendatud Kuningriigi valitsuse ning Eesti Vabariigi valitsuse (ühiselt nimetatud pooled) vahelisele investeeringute soodustamise ja kaitse lepingule (edaspidi leping), mis sõlmiti 12. mail 1994 Londonis.
Tuginedes suursaatkonna ja ministeeriumi vahel toimunud kõnelustele, on suursaatkonnal au teha Suurbritannia ja Põhja-Iiri Ühendkuningriigi (edaspidi Ühendkuningriik) valitsuse nimel järgmine ettepanek.
1. Pooled nõustuvad lepingu sõnaselgelt lõpetama.
2. Olenemata lepingu artikli 13 lõikest 2, kaotavad lepingu sätted pärast lepingu lõpetamist kehtivuse lepingu kehtivusajal tehtud investeeringute suhtes.
Kui see ettepanek on Eesti Vabariigi valitsusele vastuvõetav, on suursaatkonnal ühtlasi au teha ettepanek käsitada käesolevat nooti koos Eesti Vabariigi vastusnoodiga kui Suurbritannia ja Põhja-Iiri Ühendkuningriigi ning Eesti Vabariigi vahelist 12. mail 1994 Londonis allakirjutatud Suurbritannia ja Põhja-Iirimaa Ühendatud Kuningriigi ja Eesti Vabariigi valitsuse vahelise investeeringute soodustamise ja kaitse lepingu lõpetamise kokkulepet (edaspidi lõpetamiskokkulepe). Lõpetamiskokkulepe jõustub kuupäeval, mil Eesti Vabariik edastab vastusnoodi.
Briti suursaatkond Tallinnas kasutab siinkohal võimalust kinnitada Eesti Vabariigi Välisministeeriumile veel kord oma sügavat lugupidamist.

The British Embassy Tallinn presents its compliments to the Ministry of Foreign Affairs of the Republic of Estonia and has the honour to refer to the Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Estonia (together “the Parties”) for the Promotion and Protection of Investments done at London on 12 May 1994 (“the Agreement”).
Further to discussions which have taken place between the Embassy and the Ministry, the Embassy has the honour to propose on behalf of the Government of the United Kingdom of Great Britain and Northern Ireland (“the United Kingdom”) the following:
1. The Parties agree to expressly terminate the Agreement; and
2. Notwithstanding Article 13(2) of the Agreement, following the termination of the Agreement, the provisions of the Agreement shall cease to have effect in respect of investments made while the Agreement was in force.
If the aforementioned proposal is acceptable to the Government of the Republic of Estonia, the Embassy has further the honour to propose that this Note together with the Note of the Republic of Estonia in reply shall constitute the Agreement between the United Kingdom of Great Britain and Northern Ireland and the Republic of Estonia on Termination of the Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Estonia for the Promotion and Protection of Investments signed at London on 12 May 1994 (“the Termination Agreement”). The Termination Agreement shall enter into force on the date of the Note of the Republic of Estonia in reply.
The British Embassy Tallinn avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Estonia the assurances of its highest consideration.

Eesti Vabariigi Välisministeerium annab edasi oma tervitused Briti suursaatkonnale Tallinnas ja tal on au viidata Ühendkuningriigi 31. märtsi 2021 noodile nr 07/21, mille sisu on järgmine.
„Briti suursaatkond Tallinnas annab edasi oma tervitused Eesti Vabariigi Välisministeeriumile ning tal on au viidata Suurbritannia ja Põhja-Iirimaa Ühendatud Kuningriigi valitsuse ning Eesti Vabariigi valitsuse (ühiselt nimetatud pooled) vahelisele investeeringute soodustamise ja kaitse lepingule (edaspidi leping), mis sõlmiti 12. mail 1994 Londonis.
Tuginedes suursaatkonna ja ministeeriumi vahel toimunud kõnelustele, on suursaatkonnal au teha Suurbritannia ja Põhja-Iiri Ühendkuningriigi (edaspidi Ühendkuningriik) valitsuse nimel järgmine ettepanek.

Välisministeerium vastab omalt poolt, et tal on au teatada Briti suursaatkonnale, et Eesti Vabariigi valitsus nõustub tehtud ettepanekuga ja kinnitab, et Ühendkuningriigi 31. märtsi 2021 nooti nr 07/21 ja käesolevat nooti käsitatakse kui Eesti Vabariigi ning Suurbritannia ja Põhja-Iiri Ühendkuningriigi vahelist 12. mail 1994 Londonis allakirjutatud Suurbritannia ja Põhja-Iirimaa Ühendatud Kuningriigi ja Eesti Vabariigi valitsuse vahelise investeeringute soodustamise ja kaitse lepingu lõpetamise kokkulepet, mis jõustub käesoleva noodi edastamise kuupäeval.

“The British Embassy Tallinn presents its compliments to the Ministry of Foreign Affairs of the Republic of Estonia and has the honour to refer to the Agreement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the Republic of Estonia (together “the Parties”) for the Promotion and Protection of Investments done at London on 12 May 1994 (“the Agreement”).

In reply, the Ministry of Foreign Affairs has the honour to inform the British Embassy that the Government of the Republic of Estonia accepts the foregoing proposal and confirms that Note No. 07/21 of the United Kingdom of 31 March 2021 and this Note in reply shall constitute the Agreement between the Republic of Estonia and the United Kingdom of Great Britain and Northern Ireland on Termination of the Agreement between the Government of the Republic of Estonia and the Government of the United Kingdom of Great Britain and Northern Ireland for the Promotion and Protection of Investments, done at London on 12 May 1994, which shall enter into force on the date of this Note.
The Ministry of Foreign Affairs of the Republic of Estonia avails itself of this opportunity to renew to the British Embassy Tallinn the assurances of its highest consideration.
