Eesti Vabariigi valitsuse ja Moldova Vabariigi valitsuse haridus-, kultuuri-, noorte- ja spordikoostöö kokkulepe

Vabariigi Valitsuse 13.10.2011 korraldus nr 439 kokkuleppe eelnõu heakskiitmise kohta
Välisministeeriumi teadaanne välislepingu jõustumise kohta
Eesti Vabariigi valitsus ja Moldova Vabariigi valitsus, edaspidi pooled,
– soovides arendada ja mitmekesistada poolte sõbralikke suhteid,
– tuginedes Euroopa Liidu Kagu-Euroopa algatustele,
– teadvustades, et haridus-, kultuuri-, noorte- ja spordikoostöö aitab süvendada rahvastevahelist teineteisemõistmist,
– soovides aktiivselt osaleda Bologna deklaratsiooni põhimõtetel rajaneva Euroopa kõrgharidusruumi loomisel,
on kokku leppinud järgmises.
Artikkel 1
Pooled toetavad mitmesuguses vormis haridus-, kultuuri-, noorte- ja spordikoostööd, mis põhineb vastastikuse austuse ja partnerluse põhimõtetel ning on kooskõlas poolte õigusaktidega.
Artikkel 2
Pooled soodustavad kogemuste vahetamist hariduse, kultuuri, noorte ja spordi valdkonnas, vahetades normdokumente ja muud teavet, mis on vajalik asjakohase tegevuse korraldamiseks.
Pooled toetavad suundumusi ja eesmärke, mis soodustavad kultuuridevahelise hariduse ja demokraatliku ühiskonna arendamist.
Artikkel 3
Pooled peavad vastastikusel vajadusel ja huvil põhinevat otsekontaktide loomist üldhariduskoolide, kutseõppeasutuste, kõrgkoolide, täiskasvanute koolitusasutuste ja teadusasutuste vahel peamiseks haridus- ja teaduskoostöö vormiks.
Artikkel 4
Pooled edendavad ja soodustavad nii kõrgkoolidevahelist teadus- ja kultuurikoostööd kui ka akadeemilist liikuvust ning teevad koostööd Bologna deklaratsiooni põhimõtete rakendamisel.
Artikkel 5
Kõrgkoolidevahelise liikuvuse soodustamiseks pakuvad pooled partnerriigi üliõpilastele, õppejõududele ja teadlastele stipendiume õppe- ja uurimistööks avalik-õiguslikes või riiklikes ülikoolides.
Artikkel 6
Pooled edendavad kultuurikoostööd, keskendudes järgmistele valdkondadele:
– koostöö ja vahetused teatri, muusika, filmi ning kirjanduse ja rahvakunsti vallas, samuti muuseumide ja raamatukogude vahel ning muudes kultuurivaldkondades;
– näituste, kunstimesside ja muude kultuuriürituste korraldamine eesmärgiga tutvustada eri kunstialade tippteoseid ja -saavutusi, kasutades poolte asjakohase valdkonna asjatundjate abi;
– suhete tugevdamine poolte kunstnike liitude vahel, kunsti- ja kunstiõpetuse asjatundjate, samuti autorite, kriitikute ja loovisikute vahetuse korraldamine;
– koostöö arheoloogia, ajaloo- ja kultuuriväärtuste kaitse, säilitamise ja restaureerimise valdkonnas, samuti ajaloo- ja kultuuriväärtuslike esemete ebaseadusliku sisse- ja väljaveo tõkestamise alal;
– ekspertide, kunstnike ja muude esinejate osalemine poolte organiseeritud seminaridel, näitustel, võistlustel, meistriklassides, festivalidel, konverentsidel ja teadussümpoosionidel.
Artikkel 7
Pooled loovad tingimused vastastikuseks keele, kultuuri, kirjanduse ja ajaloo õppimiseks.
Artikkel 8
Pooled soodustavad noorte-, kehakultuuri- ja spordikoostööd ning otsekontaktide loomist noorteorganisatsioonide, spordiklubide ja spordialaliitude vahel.
Artikkel 9
Pooled soodustavad kokkuleppes nimetatud valdkondades avalike ja erainstitutsioonide, kohalike omavalitsuste, riigiasutuste ja vabaühenduste koostööd.
Artikkel 10
Pooled loovad kokkuleppe hindamiseks ja täitmiseks ühiskomisjoni, mille kohtumised toimuvad vähemalt kord kolme aasta jooksul. Kohtumisi korraldatakse vaheldumisi kummagi poole territooriumil.
Artikkel 11
Pooled toetavad kokkuleppes nimetatud tegevusi oma rahaliste võimaluste piires.
Artikkel 12
1. Pooled teevad kokkuleppesse muudatusi vastastikusel nõusolekul, sõlmides selleks lisaprotokollid, mis moodustavad kokkuleppe lahutamatu osa.
2. Vaidlused kokkuleppe rakendamise ja tõlgendamise üle lahendatakse pooltevaheliste läbirääkimiste teel.
Artikkel 13
1. Kokkulepe on sõlmitud määramata ajaks. Kokkulepe jõustub järgneval päeval pärast viimase sellise kirjaliku teate saabumist, millega pooled teatavad kokkuleppe jõustumiseks vajalike riigisiseste nõuete täitmisest.
2. Pooltel on igal ajal õigus kokkulepe kirjalikult lõpetada. Sellisel juhul kaotab kokkulepe kehtivuse, kui teise poole sellekohase kirjaliku teate saabumise päevast on möödunud kuus kuud.
Koostatud 19. oktoobril 2011 Tallinnas kahes eksemplaris eesti, moldova ja inglise keeles; kõik tekstid on võrdselt autentsed. Tõlgenduserinevuste korral võetakse aluseks ingliskeelne tekst.

Agreement
between
the Government of the Republic of Estonia
and
the Government of the Republic of Moldova
on cooperation in the fields of education, culture, youth and sports
The Government of the Republic of Estonia and the Government of the Republic of Moldova, hereinafter the Parties:
wishing to develop and diversify the friendly relations which exist between the Parties;
based on the European Union initiatives for South-Eastern Europe;
being aware of the fact that the cooperation in the fields of education, culture, youth, and sports contributes to a better understanding between nations;
aiming for active participation in the creation of the European Higher Education Area, based on the principles of the Bologna Declaration,
have agreed on the following:
Article 1
The Parties will support different forms of cooperation in the fields of education, culture, youth, and sports, based on the principles of mutual respect and partnership and in compliance with their respective legislations.
Article 2
The Parties will encourage exchange of experience in the fields of education, culture, youth and sports by exchanging normative documents and other information that is necessary for setting up activities.
The Parties will contribute to the trends and objectives of intercultural education and a democratic society.
Article 3
The Parties consider direct co-operation between their institutions of general education, vocational education and training, higher education, adult education and the research institutes – on the basis of mutual need and interest – as the fundamental form of their educational and scientific co-operation.
Article 4
The Parties will promote and encourage interuniversity, scientific and cultural cooperation as well as academic mobility and will cooperate in the implementation of the Bologna Declaration principles.
Article 5
In order to encourage mobility in higher education, the Parties will annually offer scholarships to students of higher education institutions as well as to lecturers and researchers seeking to develop their knowledge and widen their professional experience in higher education institutions.
Article 6
The Parties will promote cooperation in the field of culture, focusing on the following:
– cooperation and exchanges in the fields of theatre, music, cinema, literature, folk art, museums and libraries as well as other domains of culture;
– organization of exhibitions, art fairs and other cultural events with the aim of promoting different artworks or masterpieces, with the help of the competent authorities of the Parties;
– development of relationships between the artists associations of the Parties and the exchange of specialists in arts and arts training, as well as the exchange of authors, critics and creative persons;
– cooperation in the fields of archeology, protection, preservation and restoration of historical and cultural heritage and prevention of illegal import and export of objects of cultural and historical value;
– mutual participation of experts, artists and other performers in seminars, exhibitions, contests, master classes, festivals, conferences, scientific symposia organized by the Parties.
Article 7
The Parties will facilitate access to learning the language, culture, literature and history of the other Party.
Article 8
The Parties will encourage cooperation in the fields of youth, physical training, and sports in order to create direct contacts between youth organizations, sports clubs and sports federations of the Parties.
Article 9
The Parties will encourage direct cooperation between public and private institutions, local authorities, governmental and non-governmental organizations in the fields mentioned in this Agreement.
Article 10
The Parties will set up a Joint Commission in order to evaluate and implement this Agreement. The Joint Commission will meet at least once in three years. Meetings of the Joint Committee shall be held alternately in the territories of the Parties.
Article 11
The Parties shall provide financial assistance for the activities mentioned in this Agreement based on the availability of their respective finances.
Article 12
1. Amendments to this Agreement shall be made on the basis of mutual consent of the Parties by concluding additional protocols that form an integral part of this Agreement.
2. Any disputes arising in the course of the implementation and interpretation of this Agreement shall be settled through consultations between the Parties.
Article 13
1. This Agreement is concluded for an indefinite period of time. It is subject to approval in accordance with the national legal procedures of the Parties and shall enter into force on the first day following the receipt of the last of the notifications between the Parties that the necessary requirements for this Agreement to enter into force have been fulfilled.
2. Each Party has the right to terminate this Agreement in writing at any time. In such a case the validity of the Agreement will expire 6 months following the day on which the termination notice is received by the other Party.
Done in Tallinn on 19 of October in two originals in the Estonian, Moldovan and English languages, each text being equally authentic. In case of a different interpretation, the English text shall prevail.
