Ühinenud Rahvaste Organisatsiooni põhikiri ning Rahvusvahelise Kohtu statuut

Ühinenud Rahvaste Organisatsiooni põhikiri1
1Eesti Vabariik võeti Ühinenud Rahvaste Organisatsiooni liikmeks 17. septembril 1991. a.

San Francisco, 26. juuni 1945

Meie, ühinenud rahvad, olles otsustanud

päästa järeltulevad põlved sõjaviletsustest, mis on kaks korda meie elu kestel toonud inimkonnale kirjeldamatut muret;

taas kinnitada usku inimese põhiõigustesse, tema väärikusse ja väärtusse, meeste ja naiste võrdõiguslikkusesse ning suur- ja väikerahvaste õiguste võrdsusse;

luua tingimused, milles võivad püsida õiglus ning lugupidamine lepinguist ja muudest rahvusvahelise õiguse allikaist tulenevate kohustuste vastu; kaasa aidata sotsiaalsele progressile ja elatustaseme parandamisele suurema vabaduse tingimustes,

ja neil eesmärkidel

olla leplik ja elada omavahel rahus heade naabritena;

ühendada oma jõud rahvusvahelise rahu ja julgeoleku säilitamiseks;

kindlustada põhimõtete vastuvõtmise ja meetodite kindlaksmääramisega, et relvajõudusid rakendataks üksnes üldistes huvides;

kasutada rahvusvahelisi institutsioone kõigi rahvaste majandusliku ja sotsiaalse arengu soodustamiseks,

otsustasime ühendada oma jõupingutused.

Vastavalt sellele nõustusid meie valitsused San Franciscos kokkutulnud esindajate kaudu, kes esitasid oma nõutavalt vormistatud volikirjad, vastu võtma käesoleva põhikirja ja asutavad rahvusvahelise organisatsiooni nimetusega Ühinenud Rahvaste Organisatsioon (edaspidi ÜRO).

Artikkel 40

3. Need saadetakse sekretäri kaudu, kohtu poolt määratud korras ja tähtaegadel.

4. Iga dokument, mis on esitatud ühe poole poolt, tuleb teisele poolele saata tõestatud ärakirjana.

2. Sama sätet rakendatakse juhtudel, kui on vaja astuda samme tõendite saamiseks kohapeal.

Artikkel 45

Artikkel 46

Artikkel 47

1. Igat kohtuistungit protokollitakse. Protokollile kirjutavad alla sekretär ja esimees.

2. Ainult nimetatud protokoll on autentne.

Artikkel 48

Kohus teeb korraldused kohtuasja käigu kohta, määrab vormi ja tähtaja, millal kumbki pool peab oma kaalutlused lõplikult esitama, ja korraldab tõendite kogumist.

Artikkel 49

Artikkel 58

Otsusele kirjutavad alla kohtu esimees ja sekretär. Otsus kuulutatakse välja kohtu avalikul istungil pärast poolte esindajate nõuetekohast informeerimist.

Artikkel 59

Kohtuotsus on kohustuslik ainult kohtuasja pooltele ja ainult antud kohtuasjas.

Artikkel 60

Otsus on lõplik ega kuulu edasikaebamisele. Vaidluse puhul otsuse tähenduse ja ulatuse kohta on kohtul õigus seda kummagi poole palvel tõlgendada.

Artikkel 61

SOOVITUSLIKU ISELOOMUGA ARVAMUSED

Artikkel 65

1. Kohus võib anda soovitusliku iseloomuga arvamusi igas juriidilises küsimuses iga asutuse järelpärimise peale, kes vastavalt ÜRO põhikirjale on volitatud selliseid järelpärimisi esitama.

Artikkel 68

Oma soovituslike funktsioonide teostamisel juhindub kohus käesoleva statuudi sätetest, mis puudutavad vaidlusaluseid asju, määral, mil kohus tunnistab neid kohaldatavaks.

V peatükk

PARANDUSED

Artikkel 69

Käesolevat statuuti parandatakse samadel alustel, mis on ette nähtud ÜRO põhikirja parandamise kohta, kuid kinni pidades kõikidest sätetest, mida Peaassamblee võib Julgeolekunõukogu soovitusel kehtestada riikide osavõtu kohta, kes ei ole ÜRO liikmed, kuid on statuudi pooled.

Artikkel 70

Kohtul on õigus esitada käesoleva statuudi kohta vajalikke parandusettepanekuid, teatades neist kirjalikult peasekretärile nende edasiseks läbivaatamiseks vastavalt artikli 69 sätetele.

Charter of the United Nations

We the peoples of the United Nations determined

to save succeeding generations from the scourge of war, which twice in our lifetime has brought untold sorrow to mankind, and

to reaffirm faith in fundamental human rights, in the dignity and worth of the human person, in the equal rights of men and women and of nations large and small, and

And for these ends

to practice tolerance and live together in peace with one another as good neighbours, and
