Eesti Vabariigi valitsuse ja Poola Vabariigi valitsuse vaheline organiseeritud kuritegevuse ja muu kuritegevuse vastu võitlemise koostöökokkulepe

Välisministeeriumi teadaanne välislepingu jõustumise kohta
Koostöökokkuleppe muutmise kokkulepe
Eesti Vabariigi valitsus ja Poola Vabariigi valitsus, edaspidi pooled,
–
seades eesmärgiks arendada Eesti Vabariigi ja Poola Vabariigi suhteid
sõpruse ning koostöö vaimus;
– tundes muret
organiseeritud kuritegevuse ja muu kuritegevuse kasvu pärast;
–
olles veendunud, et korrakaitseasutustel on vaja teha organiseeritud
kuritegevuse ja terrorismi ning muud liiki kuritegevuse vastu
võitlemiseks koostööd;
– seades eesmärgiks arendada
nende asutuste operatiiv- ja ennetustegevuse põhimõtteid, vorme ja
meetodeid, järgides rahvusvahelise õiguse akte ja oma riigi seadusi ning
juhindudes võrdõiguslikkuse printsiibist ja mõlema riigi kasust;
–
tundes muret rahvusvahelise terrorismi poolt põhjustatud ohu pärast ning
pidades silmas organiseeritud kuritegevuse ja rahvusvahelise terrorismi
tihedat seost;
on kokku leppinud järgmises.
Artikkel 1
1. Pooled teevad koostööd kuritegevuse vastu võitlemiseks oma
korrakaitseasutuste vahel, võttes ennetusmeetmeid ja tehes kindlaks
järgmiste kuritegude toimepanijaid:
1) elu ja tervise vastane
kuritegu;
2) tuumamaterjali või muu radioaktiivse aine vargus või
vedu või selle ainega ebaseaduslik kauplemine, kahjustuste tekitamiseks
materjali või aine väärkasutus või sellega ähvardamine;
3)
keskkonnavastane kuritegu;
4) kõlblusevastane kuritegu;
5)
inimkaubandus või inimeselt vabaduse võtmisega seotud muu kuritegu;
6)
relvade, laskemoona, lõhkeainetega või muu ohtliku ainega ebaseaduslik
kauplemine või nende ebaseaduslik tootmine;
7) illegaalne
immigratsioon;
8) kunstiväärtuse, mootorsõiduki või muu eseme vargus
või salakaubavedu või nende esemetega kauplemine;
9) raha
või väärtpaberite võltsimine ja avalikku käibesse laskmine;
10)
dokumendi võltsimine või võltsitud dokumendi kasutamine;
11)
rahandus-, majandus-, rahapesu- või korruptsioonikuritegu;
12)
narkootilise või psühhotroopse aine või selle lähteaine ebaseaduslikuks
valmistamiseks taimede kasvatamine või nimetatud aine või lähteaine
tootmine, töötlemine, vedu või ebaseaduslik ringlusse laskmine või
narkootilise või psühhotroopse aine tootmiseks vajalike lähteainete või
pooltoodete salakaubavedu;
13) terrorism.
2. Pooled teevad koostööd ka järgmistes valdkondades:
1)
lõikes 1 nimetatud kuriteo toimepanemises kahtlustatava või kohtuotsuse
täitmisest kõrvalehoiduja tagaotsimine;
2) kadunud isiku
tagaotsimine või isiku või laiba tuvastamine;
3)
kriminaalkuriteo toimepanemisega seotud esemete otsimine.
Artikkel 2
1. Poolte pädevad asutused, kellel on õigus luua otsesidemeid ja sõlmida koostöökokkuleppe täitmiseks lisakokkuleppeid, on:
Eesti Vabariigis:
1) Siseministeerium;
2) Politseiamet;
3)
Kaitsepolitseiamet;
4) Piirivalveamet;
5) Maksuamet;
6)
Tolliamet
Poola Vabariigis:
1) siseküsimustes pädev minister;
2)
riigikaitseameti ülem;
3) politseiülem;
4)
piirivalveülem;
5) avalikes finantsküsimustes pädev minister;
6)
finantsinstitutsioonide küsimustes pädev minister.
2. Oma riigis kehtivat menetluskorda järgides võivad poolte pädevad asutused oma pädevuse piires vahetada sideohvitsere ja sõlmida rakenduskokkuleppeid, millega määratakse kindlaks koostöö täpsemad reeglid ja eesmärgid. Koostöö tõhustamiseks võivad asutused vajaduse korral nõu pidada.
3. Ühe poole pädev asutus edastab teise poole pädevale asutusele ekspertide, kes osalevad ekspertide vahetusel, nimed vähemalt kaks nädalat enne projekti elluviimise alustamist. Kui pool otsustab, et teise poole määratud eksperdi viibimine tema territooriumil võib ohustada tema riigi julgeolekut või muid põhihuve, kohaldatakse artikli 5 sätteid.
Artikkel 3
1. Poolte pädevad asutused tagavad teineteisele edastatava salajase informatsiooni kaitse.
2. Teisele poolele edastatud salajase informatsiooni või tehnovarustuse võib kolmanda riigi korrakaitseasutusele edastada informatsiooni või tehnovarustuse edastanud korrakaitseasutuse nõusolekul.
3. Kui ühe poole pädeva asutuse edastatud salajane informatsioon tuleb avalikuks või satub avalikuks tuleku ohtu, peab teise poole pädev asutus viivitamata teavitama salajast informatsiooni edastanud poole pädevat asutust sellest sündmusest ja sellega seotud asjaoludest ning tagajärgedest ning sellise olukorra edaspidiseks vältimiseks võetud meetmetest.
Artikkel 4
Isikuandmete kaitseks kohaldatakse järgmisi nõudeid:
1)
andmeid kasutades peab järgima andmeid väljastanud poole sätestatud
eesmärke ja tingimusi;
2) kui andmed väljastanud pool seda
taotleb, teavitatakse teda andmete kasutamisest ning nende kasutamise
tagajärgedest;
3) isikuandmeid võib väljastada
korrakaitseasutustele; muule asutusele võib andmeid väljastada andmed
väljastanud poole nõusolekul;
4) väljastatavate andmete
õigsuse eest vastutab andmeid väljastav pool. Kui ilmneb, et on esitatud
valeandmeid või et andmed on esitatud ilma loata, peab teist poolt
sellest kohe teavitama; sellisel juhul on teine pool kohustatud tegema
andmetes asjakohased muudatused või ta peab andmed hävitama;
5)
informatsiooni väljastanud pool teeb teisele poolele teatavaks
informatsiooni arvutifailidest kustutamise tähtaja.
Artikkel 5
Kui pool tuvastab, et artiklites 6–9 nimetatud informatsiooni vahetus või ühisprojekti rakendamine ei ole kooskõlas tema seadustega, ohustab tema julgeolekut või muid põhihuve või rikub tema õiguskorda, võib ta koostööst täielikult või osaliselt loobuda või seada see sõltuvusse vastavate tingimuste täitmisest.
Artikkel 6
Kuritegude ennetamiseks ja tõkestamiseks rakendab poole pädev asutus
järgmisi abinõusid:
1) vajaduse korral edastab teisele
poolele kurjategijate isikuandmed ja informatsiooni, mis käsitleb:
a)
kuriteo organiseerijaid ja kuriteole kihutajaid;
b)
kurjategijatevahelisi sidemeid;
c) kuritegeliku grupi või
organisatsiooni struktuuri ja tegevuse meetodeid;
d) kurjategija ja
kuritegeliku grupi tüüpilist käitumist;
e) juhtumit
puudutavaid erilisi asjaolusid, kuriteo toimepanemise kohta, aega,
viisi, eesmärki ja eritunnuseid;
f) rikutud kriminaalõiguse
sätetest;
g) menetlustoiminguid ja nende tulemusi.
2) teise
poole taotluse alusel viib läbi vajalikud menetlustoimingud ja võtab
viivitamata kokkulepitud meetmeid esmajoones piiriülese jälgimise,
kontrollostude ja kontrolltarnete osas.
Artikkel 7
Poolte pädevad asutused vahetavad informatsiooni avaliku korra ja julgeoleku vastu toimepandud kuriteokatsete või kuritegude uurimise või kavandatava tegevuse kohta ning nende meetodite kohta, mida kurjategija või terroristlik organisatsioon kasutab või kavatseb kasutada poole oluliste huvide kahjustamiseks, ning võtavad ühismeetmeid terrorismi ärahoidmiseks või terrorismi vastu võitlemiseks.
Artikkel 8
Poolte pädevad asutused vahetavad vajalikku informatsiooni illegaalse immigratsiooni ärahoidmiseks ning selle vastu võitlemiseks, eriti sellise kuriteo korraldajate ja nende tegevuse meetodite kohta ning riigipiiri ületamist lubavate dokumentide ja neid kinnitavate pitserite ning viisade ja neis kasutatud sümbolite näidiseid.
Artikkel 9
Narkokuritegevuse vastu võitlemiseks pädevad asutused:
1)
edastavad teineteisele informatsiooni:
a) narkootilise või
psühhotroopse ainega või selle lähteainega kauplemise kohta;
b)
narkootilise või psühhotroopse aine või selle lähteaine tootmise või
ladustamise asukoha ja meetodite ning aine veoks kasutatavate sõidukite
kohta;
c) narkootilise või psühhotroopse aine või selle lähteaine veo
sihtpunkti kohta;
2) vahetavad uute narkootiliste ja psühhotroopsete
ainete ning nende lähteainete ja teiste ohtlike taimsete või
sünteetiliste ainete näidiseid;
3) vahetavad informatsiooni
selle kohta, milliseid õigusakte on vastu võetud ja milliseid kogemusi
omandatud narkootiliste ja psühhotroopsete ainetega ning nende
lähteainete tootmiseks vajalike pooltoodetega seadusliku kauplemise
järelevalve valdkonnas.
Artikkel 10
Teaduse ja tehnika ning väljaõppe valdkonnas tehtava koostöö raames
vahetavad poolte pädevad asutused:
1) kogemusi ja informatsiooni
organiseeritud kuritegevuse vastu võitlemise meetodite, kuritegevuse
uute vormide ning eritehnika kasutamise ja arengu kohta;
2)
kuritegevusega läbi saadud tulu legaliseerimise, narkosõltuvusevastase
võitluse ja muu sellise valdkonna kohta tehtud kriminalistika- ja
kriminoloogiauuringute tulemusi ning kriminaalõiguslikke lahendeid;
3)
informatsiooni kuriteo objektide kohta ja kuritegevusevastaseks
võitluseks vajalikke tehnovahendeid;
4) tasulisi eksperte
väljaõppe või erialase täiendamise valdkonnas, eriti
kuritegevusevastases võitluses kriminaaltehnika ja operatiivmeetodite
kasutamise valdkonnas;
5) koostöökokkuleppega seotud erialast
kirjandust ja muid erialatrükiseid.
Artikkel 11
1. Koostöökokkuleppe tõlgendamise vaidluse või kokkuleppe alusel esitatud nõude üle tekkinud vaidluse lahendavad poolte pädevad asutused läbirääkimiste teel oma pädevuse piires.
2. Kui punktis 1 nimetatud läbirääkimiste teel kokkulepet ei saavutata, lahendatakse vaidlus kolmandat isikut kaasamata diplomaatiliste kanalite kaudu.
Artikkel 12
Koostöökokkuleppega ei ole vastuolus teha koostööd kriminaalasjades õigusabi andmiseks ja maksustamiseks sõlmitud kokkulepete alusel ning kahe- ja mitmepoolsetest rahvusvahelistest lepingutest tulenevate muude kohustuste täitmine.
Artikkel 13
Koostöökokkuleppe täitmisel kasutavad pooled oma riigikeelt või inglise keelt.
Artikkel 14
Koostöökokkuleppe täitmisest tulenevad kulud katab pool, kelle territooriumil kulud tekivad, kui pooled ei ole kokku leppinud teisiti.
Artikkel 15
1. Koostöökokkulepe kuulub heakskiitmisele vastavalt mõlema poole seadustele, mida kinnitatakse nootide vahetuse teel. Koostöökokkulepe jõustub nootide kättesaamisest arvates 30 päeva möödumisel.
2. Koostöökokkulepe sõlmitakse määramata ajaks. Kumbki pool võib koostöökokkuleppe lõpetada, kui ta on sellest teisele poolele kirjalikult teatanud. Koostöökokkulepe kaotab kehtivuse teate saamisest arvates kolme kuu pärast.
Koostatud Varssavis 26. juunil 2003 kahes eksemplaris eesti, poola ja inglise keeles, kusjuures kõik tekstid on autentsed. Tõlgendamiserinevuste korral võetakse aluseks ingliskeelne tekst.

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF ESTONIA AND THE GOVERNMENT OF THE REPUBLIC OF POLAND ON CO-OPERATION IN COMBATING ORGANIZED CRIME AND OTHER CRIME
The Government of the Republic of Estonia and the Government of the Republic of Poland,
hereinafter referred to as the “Contracting Parties”,
–
aiming at further development of relations in the spirit of friendship
and good co-operation between the Republic of Estonia and the Republic
of Poland,
– alarmed by the growth of crime in general and organized
crime in particular,
– convinced of the vital importance of
co-operation between law enforcement authorities for efficient combating
crime, especially organized one and terrorism,
– aiming at the
development of optimal principles, forms and methods of operational
activity and preventive actions of these authorities, subject to the
observance of governing regulations of international law and internal
laws of their States, guided by the principles of equality, reciprocity
and mutual benefits,
– concerned about the danger created by
international terrorism and keeping in mind the concern about the close
relations between organised crime and international terrorism
have agreed as follows:
Article 1
1. The Contracting Parties hereby undertake to co-operate between their
law enforcement authorities in the field of combating crime by means of
preventive measures and detecting perpetrators of the following crimes:
1)
against life and health,
2) theft of nuclear and radioactive
materials, transport thereof, illicit trafficking therein, misuse or
threatening to misuse them for the purpose of inflicting damage,
3)
against natural environment protected by law,
4) against decency,
5)
trafficking in human beings and deprivation a human being of freedom,
6)
illicit trafficking in firearms, ammunition, explosives and other
hazardous materials, and illicit production thereof,
7) illegal
immigration,
8) theft of art values, motor vehicles or any other
objects, illicit trafficking therein and smuggling thereof,
9)
counterfeiting and altering of national currencies and securities and
introducing them into public trade,
10) forging documents and using
them,
11) financial and economic crimes, laundering of criminal
proceeds and accepting financial or personal benefits by public
officials,
12) illegal cultivation of plants for the manufacturing of
narcotic drugs, psychotropic substances and precursors, production of
those substances, illegal processing, transport, smuggling thereof and
trafficking therein as well as trafficking in source substances and
semi-finished products for the production thereof,
13) terrorism.
2. The Contracting Parties shall also co-operate in the field of:
1)
searching for persons suspected of committing crimes listed under
Paragraph 1 above or evading the service of the sentence adjudged for
the commission thereof,
2) searching for missing persons and
undertaking actions prompted by the need to identify persons of
undetermined identity and unknown corpses,
3) searching for objects
deriving from the commission of criminal acts.
Article 2
1. The competent authorities of the Contracting Parties, which shall have the right to establish direct contacts and to conclude additional arrangements for the implementation of the provisions of this Agreement, are:
– in the Republic of Estonia:
1) Ministry of Internal Affairs,
2)
Police Board,
3) Security Police Board,
4) Board of Border Guard,
5)
Estonian National Tax Board,
6) Estonian National Customs Board
– in the Republic of Poland:
1) the Minister competent for
internal affairs,
2) the Head of the State Protection Office,
3)
the Chief Police Commanding Officer,
4) the Chief Border Guard
Commanding Officer,
5) the Minister competent for public financial
affairs,
6) the Minister competent for financial institutions affairs.
2. The competent authorities of the Contracting Parties, within their competence, may exchange liaison officers, conclude executive agreements hereto with the observance of internal procedures and set out detailed rules and the object of co-operation in them. They may also, whenever appropriate, carry consultations to ensure the efficiency of the co-operation being the object hereof.
3. The competent authorities of the Contracting Parties shall exchange the names of persons who are to participate in the exchange of experts two weeks prior to the scheduled date of the project at the latest. If one of the Contracting Parties decides that the stay in the territory of its State of the person designated by the other Contracting Party may pose a threat to the safety or to any other crucial interests of the State of this Contracting Party, the provisions of Article 5 of this Agreement shall apply.
Article 3
1. The competent authorities of the Contracting Parties shall ensure the protection of secret information imparted to each other.
2. All information of this kind or technical equipment delivered by the competent authority of one Contracting Party to the competent authority of the other Contracting Party may be delivered to law enforcement authorities of third states exclusively subject to the consent of the competent delivering authority.
3. Should the secret information imparted by the competent authority of one Contracting Party, be exposed to disclosure or be disclosed, the competent authority of the other Contracting Party shall immediately notify the competent authority of the imparting Party about this event, and inform it about the circumstances and consequences of the event and about measures undertaken to prevent the occurrence of any such events in the future.
Article 4
For the purpose of protection of the imparted personal data the
following rules of conduct shall be applied:
1) using data shall be
allowed solely pursuant to the purpose and terms set out by the
imparting Party;
2) the imparting Party shall be advised, at its
request, about the manner of the data use and about the result of the
case;
3) personal data shall be imparted exclusively to law
enforcement authorities; this data may be imparted to other authorities
Only subject to the consent of the imparting Party;
4) the imparting
Party is responsible for the authenticity of the imparted data; if this
data turns out to be false or imparting thereof was not allowed, the
other Contracting Party should be immediately notified about that; in
such event the other Contracting Party is obliged to correct or destroy
it.
5) the Party imparting information shall specify the deadline of
excluding this information from computer files.
Article 5
If one Contracting Party establishes that the exchange of information referred to in Articles 6–9 of this Agreement or the implementation of the joint project could violate its sovereign laws, pose a threat to its safety or other crucial interests or infringe the rules of its legal order, it may refuse to co-operate in part or in full or subject it to the satisfaction of specified terms.
Article 6
In order to prevent and combat criminal offences the competent
authorities of the Contracting Parties shall:
1) impart to each
other, when appropriate, personal data of the perpetrators of crimes and
the information on:
a) inspirers and persons secretly guiding
criminal actions,
b) criminal ties among perpetrators,
c)
structures of criminal groups and organizations and methods of their
operation,
d) typical ways of behaviour of particular perpetrators
and groups of perpetrators,
e) important circumstances pertaining to
the case, location, time, manner of commission of the crime, the purpose
and particular features thereof,
f) violated provisions of Criminal
Law,
g) commenced actions and the results thereof,
2) at the
request of the other Contracting Party, commence appropriate police
actions and perform without unnecessary delay jointly agreed police
measures, particularly those regarding trans-border surveillance,
controlled purchase and controlled delivery.
Article 7
The competent authorities of the Contracting Parties shall exchange information and results of examination on intended or committed attempts against public order and safety, data on the operational methods of criminals and terrorist organizations intending to commit or committing crimes to the detriment of vital interests of the state of one of the Contracting Parties, and shall take joint actions prompted by the need to prevent or to combat terrorism.
Article 8
The competent authorities of the Contracting Parties shall exchange information indispensable to prevent illegal immigration and to combat it, and particularly any information regarding those who mastermind such crimes, methods of their operation, specimens of documents authorizing to cross state borders, seals affixed on those documents, and various types of visas and their symbols.
Article 9
In order to combat drug trafficking the competent authorities of the
Contracting Parties shall:
1) impart to each other information on:
a)
trafficking in narcotic drugs, psychotropic substances and precursors,
b)
locations and methods of production and storage of narcotic drugs and
psychotropic substances, precursors and on means of transport used to
carry them,
c) destinations of transported narcotic drugs,
psychotropic substances and precursors;
2) offer to each other
samples of new narcotic drugs, psychotropic substances and precursors as
well as other hazardous substances both of plant or synthetic origin,
3)
exchange information on legal regulations and experience regarding
supervision of legal trade in narcotic drugs, psychotropic substances
and precursors as well as in source substances and semi-finished
products necessary for the production thereof.
Article 10
With regard to the scientific-technical and training co-operation the
competent authorities of the Contracting Parties shall exchange:
1)
experience and information especially on the methods of combating
organized crime as well as new forms of criminal activity and the usage
and development of special equipment,
2) results of research in the
field of crime detection and criminology and criminal-legal solutions on
regulating the legalization of criminal proceeds, combating drug habit
and the like,
3) information on crime-related objects and shall also
offer technical equipment for combating crime,
4) experts, against
payment, with the view of training and professional improvement
especially with regard to criminal techniques and operational methods
used to combat crime,
5) professional literature and other
publications on the object of this Agreement.
Article 11
1. Any disputes on the interpretation or application of this Agreement shall be settled by direct negotiations between the appropriate authorities of the Contracting Parties within their competence.
2. In case of the failure to achieve agreement by negotiations referred to in Paragraph 1, the dispute shall be settled by diplomatic channel and it shall not be addressed to any third party.
Article 12
This Agreement does not violate the provisions of agreements on legal assistance with regard to criminal matters, on official assistance with regard to tax matters, or other obligations of the Contracting Parties resulting from bilateral and multilateral international agreements.
Article 13
The Contracting Parties shall use their official languages or the English language with regard to the performance of the provisions of this Agreement.
Article 14
Costs resulting from the performance of the provisions hereof shall be incurred by the Contracting Party on the territory of the State of which these costs have arisen unless it is agreed otherwise in particular cases by the Parties.
Article 15
1. This Agreement subject to acceptance pursuant to the laws of States of each of the Contracting Parties which shall be confirmed by exchange of notes. The Agreement shall enter into force after the lapse of thirty days from the date the later of the notes has been received.
2. This Agreement shall be concluded for the indefinite period of time. It may be terminated by each of the Contracting Parties upon notice, whereby it shall become null and void after a lapse of three months from the receipt of the notice.
This Agreement has been drawn up in Warsaw on 26 June 2003 in two counterparts, each in the Estonian, Polish and English languages, all versions being identical. In case of interpretation discrepancies the English version shall prevail.
