Lääne-Euroopa Liidu ja Eesti Vabariigi julgeolekukokkulepe

Eesti Vabariik ja Lääne-Euroopa Liit, edaspidi pooled,
võttes arvesse Lääne-Euroopa Liidu Ministrite Nõukogu ja Kesk-Euroopa riikide erakorralisel kohtumisel 19. juunil 1992. a Bonnis koostatud deklaratsiooni,
võttes arvesse Lääne-Euroopa Liidu Ministrite Nõukogu 9. mai 1994. a Kirchbergi deklaratsiooni,
võttes arvesse otsuseid, mille Lääne-Euroopa Liidu Ministrite Nõukogu on vastu võtnud 14. novembril 1994. a Noordwijkis,
võttes arvesse, et tulemuslikuks koostööks on lepingupooltel vaja vahetada salastatud teavet ja materjale,
olles kokku leppinud konsulteerida suhete ja koostöö osas, mis on sätestatud 19. juunil 1992. a Lääne-Euroopa Liidu Ministrite Nõukogu humanitaarmissioone, rahuvalvemissioone ja kriisilahendusoperatsioone käsitlevas Petersbergi deklaratsioonis.
Artikkel 1
Pool:
1) kaitseb ja hoiab teise poole edastatud või selle kokkuleppe
alusel edastatud või toodetud salastatud teavet ja materjale,
2)
säilitab salastatuse taseme, mille teine pool on kehtestanud oma
edastatud teabele ja materjalidele, ning kaitseb sellist teavet ja
materjali vastavalt,
3) kasutab sellist teavet ainult eesmärkidel,
mille teabe edastaja on määranud ja milleks seda teavet on vahetatud,
4)
ei avalda sellist teavet ja materjali kolmandatele isikutele ilma selle
edastaja nõusolekuta.
Artikkel 2
Vastavalt kokkuleppe artiklile 1 määrab Eesti Vabariik riikliku julgeolekuasutuse ja julgeolekuorgani ning kehtestab programmid, järgides Lääne-Euroopa Liidu julgeolekueeskirjades sätestatud peamisi põhimõtteid ja julgeoleku miinimumnorme, mida hakatakse kohaldama poolte julgeolekusüsteemides, et tagada kaitsenormide ühtsus. Lisaks sellele on Eesti Vabariik valmis kohaldama Lääne-Euroopa Liidu julgeolekueeskirju Lääne-Euroopa Liidu salastatud teabe kaitseks.
Artikkel 3
1. Pooled tagavad, et selle kokkuleppe kohaselt vahetatud salastatud teabele või materjalile oma ametikohustuste täitmise tõttu juurdepääsu vajavad või omavad isikud on korrakohaselt kontrollitud ja neid on põhjalikult instrueeritud nende julgeolekualasest vastutusest, enne kui neile võimaldatakse juurdepääs sellisele teabele ja materjalile.
2. Julgeolekukontrolli protseduuriga määratakse kindlaks, kas isikule võib tema lojaalsust ja usaldusväärsust arvestades võimaldada juurdepääsu salastatud teabele, ilma et see ohustaks julgeolekut, nagu see on määratletud Lääne-Euroopa Liidu julgeolekueeskirjades.
Artikkel 4
Pooled osutavad vastastikust abi ühist huvi pakkuvates julgeolekuküsimustes.
Artikkel 5
1. Lääne-Euroopa Liidu Nõukogu ja Eesti Vabariigi valitsus tagavad kokkuleppe oluliste sätete kohaldamise Lääne-Euroopa Liidus ja Eestis.
2. Lääne-Euroopa Liidu Nõukogu juhtimisel ja nimel vastutab peasekretär julgeolekumeetmete rakendamise eest, et kaitsta kokkuleppe alusel vahetatavat salastatud teavet ja materjali.
3. Eesti Vabariigi valitsuse nimel vastutab Eesti Vabariigi riiklik julgeolekuasutus julgeolekumeetmete rakendamise eest, et kaitsta kokkuleppe alusel vahetatavat salastatud teavet ja materjali.
4. Lääne-Euroopa Liidu ja Eesti Vabariigi vahel töötatakse välja
kokkulepped, et määrata kindlaks
– poolte vahetatava
salastatud teabe kaitsmiseks kohaldatavad julgeolekunormid, mis vastavad
Lääne-Euroopa Liidu salastatuse klassifikatsioonile ja on koostatud
vastavalt Lääne-Euroopa Liidu kriteeriumitele;
–
sidepidamine Lääne-Euroopa Liidu ja Eesti Vabariigi vahel.
5. Lääne-Euroopa Liidu ja Eesti Vabariigi pädevad asutused teevad koostööd Lääne-Euroopa Liidu ja Eesti Vabariigi vahel vahetatava Lääne-Euroopa Liidu salastatud teabe kaitsemeetmete tõhususe perioodilisel hindamisel.
Artikkel 6
Kokkulepe ei takista pooltel sõlmida kahepoolseid lepinguid teiste riikide või organisatsioonidega samal eesmärgil. Juba sõlmitud kahepoolseid kokkuleppeid käesolev kokkulepe ei mõjuta.
Artikkel 7
1. Oma nõusolekut sõlmida kokkulepe kinnitavad pooled Lääne-Euroopa Liidu Nõukogu ja Eesti Vabariigi valitsuse nõuetekohaselt volitatud ametiisikute allkirjadega.
2. Kokkulepe jõustub poolte poolt ettenähtud vastava menetluse lõppemisel, kuid selle sätteid kohaldatakse kolmekümne esimesest päevast peale allakirjutamise kuupäeva.
Artikkel 8
Kumbki pool võib kokkuleppe tühistada, teavitades sellest kirjalikult teist poolt. Teade jõustub teate kätte saamisest arvates kuue kuu pärast, kuid see ei mõjuta kokkuleppe kohaselt juba võetud kohustusi.
Sõltumata kokkuleppe lõppemisest kaitstakse kogu selle kokkuleppe alusel edastatud salastatud teavet edasi vastavalt kokkuleppes toodud sätetele.
Selle tõenduseks on Lääne-Euroopa Liidu Nõukogu ja Eesti Vabariigi valitsuse täievolilised esindajad kokkuleppele alla kirjutanud.
Koostatud 22. septembril 1998 Brüsselis kahes eksemplaris inglise ja prantsuse keeles; mõlemad tekstid on võrdselt autentsed ja jäävad mõlema poole valdusesse.

SECURITY AGREEMENT BETWEEN THE REPUBLIC OF ESTONIA AND WESTERN EUROPEAN UNION
The Republic of Estonia and Western European Union (WEU), hereinafter
referred to as “the Parties”,
– considering the
Declaration following the Extraordinary Meeting of the WEU Council of
Ministers with States of Central Europe in Bonn on 19 June 1992,
–
considering the Kirchberg Declaration by the WEU Council of Ministers on
9 May 1994,
– considering the decisions taken by the WEU Council
of Ministers at Noordwijk on 14 November 1994,
– considering
that effective co-operation entails the exchange between the Parties of
classified information and material,
– having agreed to consultation
within the framework of relations and co-operation set out in the
Petersberg Declaration by the WEU Council of Ministers on 19 June 1992
for humanitarian-type missions, peacekeeping missions and crisis
management operations,
have agreed as follows:
Article 1
The Parties shall:
1) protect and safeguard the classified
information and material provided by either Party or that may be
provided or produced under this Agreement,
2) maintain the security
classification established by the other Party with respect to
information and material originating from that Party and safeguard such
information and material accordingly,
3) not use such information and
material for purposes other than those established by the originator and
those for which the information is exchanged,
4) not disclose such
information and material to third parties without the consent of the
originating authority.
Article 2
Pursuant to Article 1 of this Agreement, the Republic of Estonia shall designate a national security authority and a security organization and establish programmes, founded on the basic principles and minimum standards of security as defined in the WEU Security Regulations, which shall be implemented in the security system of the Parties to ensure that a common standard of protection is applied. Moreover, the Republic of Estonia is prepared to apply the WEU Security Regulations for the protection of WEU classified information.
Article 3
1) The Parties shall ensure that all persons under their authority who, in the conduct of their official duties, require or may have access to classified information or material exchanged under this Agreement have been investigated, appropriately security-cleared and thoroughly briefed on their security responsibilities before they are granted access to such information and material.
2) The security clearance procedures shall be designed to determine whether an individual can, taking into account his or her loyalty and trustworthiness, have access to classified information without this constituting a security risk, as defined in the WEU Security Regulations.
Article 4
The Parties shall provide mutual assistance with regard to security matters of common interest.
Article 5
1) The Government of the Republic of Estonia and the WEU Council shall ensure that the relevant provisions of this Agreement are applied by the Republic of Estonia and WEU.
2) Under the direction and on behalf of the WEU Council the Secretary-General is responsible for security arrangements for the protection of classified information and material exchanged under this Agreement.
3) On behalf of the government of the Republic of Estonia, the National Security Authority of the Republic of Estonia is responsible for security arrangements for the protection of classified information and material exchanged under this Agreement.
4) Reciprocal arrangements shall be worked out between the Republic of
Estonia and WEU to define:
– the security standards applied by the
Parties for the protection, in conformity with the WEU classification
levels established in accordance with WEU criteria, of the classified
information to be exchanged;
– and the liaison between the Republic
of Estonia and WEU.
5) The competent Authorities of the Republic of Estonia and WEU will cooperate in carrying out a periodic assessment of the effectiveness of the measures for the protection of the WEU classified information exchanged between the Republic of Estonia and WEU.
Article 6
This Agreement shall in no way prevent the Parties from entering into bilateral agreements with other States or organizations for the same purpose. Existing bilateral agreements shall remain unaffected.
Article 7
1) The Parties shall express their consent to being bound by this Agreement by signature by an authority duly mandated by the Government of the Republic of Estonia and the WEU Council.
2) This Agreement shall enter into force upon the completion of the due process required by their respective mandating bodies, but its provisions are to be applied from the 31st day after its signature.
Article 8
This Agreement may be denounced by any Party on giving the other Party written notice thereof. The notice shall take effect six months after its receipt by the other Party, but shall not affect obligations already contracted under the provisions of this Agreement.
Notwithstanding the termination of this Agreement, all classified information provided pursuant to this Agreement shall continue to be protected in accordance with the provisions set forth herein.
In witness whereof, the undersigned, duly authorized thereto by the Government of the Republic of Estonia and by the WEU Council respectively, have signed this Agreement.
Done at Brussels, this twenty-second day of September 1998, in two copies in the English and French languages, each text being equally authoritative, which shall be deposited with the two Parties.
