RAHVUSVAHELISE TSIVIILLENNUNDUSE KONVENTSIOONI MUUDATUSPROTOKOLL

kirjutatud 1998. aasta 1. oktoobril Montrealis
Rahvusvahelise Tsiviillennunduse Organisatsiooni assamblee
olles kohtunud kolmekümne teisel istungjärgul 1998. aasta 22. septembril Montrealis,
olles märkinud, et osalisriikide üldiseks sooviks on võtta meetmed kindlustamaks, et 1944. aasta 7. detsembril Chicagos koostatud rahvusvahelise tsiviillennunduse konventsioon oleks kättesaadav hiinakeelse tekstina,
võtnud arvesse vajaduse muuta konventsiooni eespool mainitud põhjusel,
1. kinnitab vastavalt konventsiooni artikli 94 lõikele a
järgmise muudatusettepaneku, mis peab asendama konventsiooni lõppsätete
praegust teksti:
«Koostatud 1944. aasta 7. detsembril Chicagos
inglise keeles. Käesoleva konventsiooni inglis-, araabia-, hiina-,
prantsus-, vene- ja hispaaniakeelne tekst on autentsed. Tekste
deponeeritakse Ameerika Ühendriikide valitsuse arhiivis ja Ameerika
Ühendriikide valitsus edastab tõestatud koopiad kõigi nende riikide
valitsustele, kes võivad käesolevale konventsioonile alla kirjutada või
sellega ühineda. Käesolev konventsioon on avatud allakirjutamiseks
Washingtonis, D.C.»,
2. määrab kindlaks vastavalt konventsiooni artikli 94 lõikele a, et eespool mainitud muudatus jõustub, kui selle on ratifitseerinud sada kakskümmend neli osalisriiki,
3. otsustab, et Rahvusvahelise Tsiviillennunduse Organisatsiooni peasekretär koostab inglis-, araabia-, hiina-, prantsus-, vene- ja hispaaniakeelse protokolli, mis on kõik autentsed, sisaldades eespool mainitud muudatust ja alljärgnevat materjali.
Tulenevalt assamblee eespool mainitud tegevusest,
koostas
organisatsiooni peasekretär käesoleva protokolli.
Protokolli võivad ratifitseerida riigid, kes on ratifitseerinud rahvusvahelise tsiviillennunduse konventsiooni või sellega ühinenud.
Ratifitseerimiskirju deponeeritakse Rahvusvahelises Tsiviillennunduse Organisatsioonis.
Protokoll jõustub nende riikide suhtes, kes on selle ratifitseerinud, päeval, millal saja kahekümne neljas ratifitseerimiskiri on deponeeritud.
Peasekretär teavitab kohe konventsiooni kõiki osalisriike protokolli ratifitseerimiskirjade deponeerimise kuupäevast.
Peasekretär teavitab kohe konventsiooni kõiki osalisriike kuupäevast, millal protokoll jõustub.
Osalisriigi suhtes, kes ratifitseerib protokolli pärast eespool mainitud kuupäeva, jõustub protokoll tema ratifitseerimiskirja deponeerimisel Rahvusvahelises Tsiviillennunduse Organisatsioonis.
Selle kinnituseks kirjutavad käesolevale protokollile alla assamblee kolmekümne teise istungjärgu president ja organisatsiooni peasekretär, keda assamblee on selleks volitanud.
Koostatud tuhande üheksasaja üheksakümne kaheksanda aasta esimesel oktoobrikuu päeval Montrealis ühes eksemplaris inglise, araabia, hiina, prantsuse, vene ja hispaania keeles, mis on kõik autentsed. Käesolevat protokolli deponeeritakse Rahvusvahelise Tsiviillennunduse Organisatsiooni arhiivis ja organisatsiooni peasekretär edastab tõestatud koopiad rahvusvahelise tsiviillennunduse konventsiooni (koostatud 1944. aasta 7. detsembril Chicagos) osalisriikidele.

PROTOCOL RELATING TO AN AMENDMENT TO THE CONVENTION ON INTERNATIONAL
CIVIL AVIATION
Signed at Montreal on 1 October 1998
The Assembly of the International Civil Aviation Organization
Having met in its Thirty-second Session at Montreal on 22 September 1998,
Having noted that it is the general desire of Contracting States to take action to ensure that the Convention on International Civil Aviation done at Chicago on 7 December 1944 is available as the authentic Chinese text,
Having considered it necessary to amend the said Convention, for the purpose aforesaid,
1. Approves, in accordance with the provisions of Article 94(a) of the
Convention aforesaid, the following proposed amendment which is to
replace the present text of the final paragraph of the said Convention:
“Done
at Chicago the seventh day of December 1944 in the English language. The
texts of this Convention drawn up in the English, Arabic, Chinese,
French, Russian and Spanish languages are of equal authenticity. These
texts shall be deposited in the archives of the Government of the United
States of America, and certified copies shall be transmitted by that
Government to the Governments of all the States which may sign or adhere
to this Convention. This Convention shall be open for signature at
Washington, D.C.”,
2. Specifies, pursuant to the provisions of the said Article 94(a) of the said Convention, one hundred and twenty-four as the number of Contracting States upon whose ratification the proposed amendment aforesaid shall come into force, and
3. Resolves that the Secretary General of the International Civil Aviation Organization draw up a Protocol in the English, Arabic, Chinese, French, Russian and Spanish languages each of which shall be of equal authenticity embodying the proposed amendment above mentioned and the matter hereinafter appearing.
Consequently, pursuant to the aforesaid action of the Assembly,
This Protocol has been drawn up by the Secretary General of the Organization.
The Protocol shall be open to ratification by any State which has ratified or adhered to the said Convention on International Civil Aviation.
The instruments of ratification shall be deposited with the International Civil Aviation Organization.
The Protocol shall come into force in respect of the States which have ratified it on the date on which the one hundred and twenty-fourth instrument of ratification is so deposited.
The Secretary General shall immediately notify all Contracting States of the date of deposit of each ratification of the Protocol.
The Secretary General shall immediately notify all States parties to the said Convention of the date on which the Protocol comes into force.
With respect to any Contracting State ratifying the Protocol after the date aforesaid, the Protocol shall come into force upon deposit of its instrument of ratification with the International Civil Aviation Organization.
In witness whereof, the President of the aforesaid Thirty-second Session of the Assembly and the Secretary General of the Organization, being authorized thereto by the Assembly, sign this Protocol.
Done at Montreal on the first day of October of the year one thousand nine hundred and ninety-eight, in a single document in the English, Arabic, Chinese, French, Russian, and Spanish languages, each of which shall be of equal authenticity. This Protocol shall remain deposited in the archives of the International Civil Aviation Organization, and certified copies thereof shall be transmitted by the Secretary General of the Organization to all States parties to the Convention on International Civil Aviation done at Chicago on the seventh day of December 1944.
