Eesti Vabariik ja Läti Vabariik (edaspidi pooled),

arvestades heanaaberlikkuse põhimõtet,

soovides paremini organiseerida piirikontrolli Eesti Vabariigi ja Läti Vabariigi vahelisel piiril,

võttes arvesse 10. juuli 1996. a Eesti Vabariigi valitsuse ja Läti Vabariigi valitsuse vahelist piiripunktide kokkulepet,

ja 31. augusti 1994. a Eesti Vabariigi valitsuse ja Läti Vabariigi valitsuse vahelist ühise piirikontrolli organiseerimise kokkulepet,

leppisid kokku alljärgnevas:

Artikkel 1

Läti Vabariik annab Eesti Vabariigile üle kasutusõiguse maatükile, mis asub Valka linnas, Rujienas’e tänav 31, üldsuurusega 42 150 ruutmeetrit (edaspidi maatükk), et luua Valga-Valka ühiselt kasutatav piiripunkt.

Artikkel 2

Poolte volitatud institutsioonid sõlmivad lepingu ühise piiripunkti ehitamise ja ülalpidamise tingimuste kohta. Volitatud institutsioonid on Eesti Vabariigi poolt Eesti Vabariigi Rahandusministeerium ja Läti Vabariigi poolt Läti Vabariigi Rahandusministeerium.

Artikkel 3

Eesti Vabariik ehitab ja rajab ühise piiripunkti oma kuludega.

Artikkel 4

Ehitised, rajatised ja kommunikatsioonid, mis moodustavad ühise piiripunkti, kuuluvad Eesti Vabariigile.

Artikkel 5

Pooled maksavad võrdse osa maatüki kinnisvaramaksust, mis on määratud Läti Vabariigi seaduste kohaselt.

Artikkel 6

Kõik lepingu täitmisest, muutmisest ja lõpetamisest tulenevad vaidlused lahendatakse läbirääkimiste teel.

Lepingu täitmisest, muutmisest ja lõpetamisest tulenevad vaidlused, mida ei ole võimalik lahendada läbirääkimiste teel, lahendatakse kohtus Läti Vabariigi seaduste kohaselt.

Artikkel 7

Leping jõustub päeval, mil mõlemad pooled on vahetanud noodid selle kohta, et kõik lepingu jõustumiseks vajalikud siseriiklikud protseduurid on lõpule viidud.

Leping kehtib kogu ühise piiripunkti olemasolu ja tegevuse aja.

Leping on sõlmitud 5. märtsil 1999. aastal 2 (kahes) eksemplaris eesti, läti ja inglise keeles, kõik tekstid on võrdselt autentsed. Lepingu tõlgendamisest tulenevate vaidluste korral prevaleerib ingliskeelne tekst.

AGREEMENT BETWEEN THE REPUBLIC OF ESTONIA AND THE REPUBLIC OF LATVIA
ON THE TRANSFER OF THE USER’S RIGHTS OF THE PLOT OF LAND

  

The Republic of Estonia and the Republic of Latvia (hereinafter – Parties),

considering the principles of good neighbouring relationships,

desiring to improve the organisation of the border control on the border of the Republic of Estonia and the Republic of Latvia,

considering the Agreement of July 10, 1996 between the Governments of the Republic of Estonia and the Republic of Latvia regarding Border Crossing Points,

and the Agreement of August 31, 1994 between the Governments of the Republic of Estonia and the Republic of Latvia On Joint Border Control,

have agreed on the following:

Article 1

The Republic of Latvia shall transfer to the Republic of Estonia the user’s right to the plot of land located in the city of Valka, Rujienas street 31, total size of 42 150 square meters (hereinafter – the Plot of Land), for establishing and managing of a joint customs border control post Valga-Valka on it.

Article 2

The authorised institutions of the Parties shall conclude an agreement on terms of the building and maintenance of the joint customs border control post. The authorised institution from the Republic of Estonia is the Ministry of Finance of the Republic of Estonia and from the Republic of Latvia – Ministry of Finance of the Republic of Latvia.

Article 3

The Republic of Estonia shall construct and establish the joint customs border control post on its expenses.

Article 4

Buildings, constructions and communications that form the joint customs border control post, shall belong to the Republic of Estonia.

Article 5

The Parties shall pay equal share of immovable property tax for the Plot of Land in accordance with the legislation of the Republic of Latvia.

Article 6

Any disputes arising upon the fulfilment, amending and termination of the Agreement shall be settled by negotiations.

The disputes arising upon the fulfilment, amending and termination of the Agreement, which cannot be solved by negotiating, shall be resolved in a court in order provided for in the legislation of the Republic of Latvia.

Article 7

The Agreement shall enter into force on the date on which the Parties have notified each other that all necessary constitutional procedures for its entry have been completed.

This Agreement shall remain in force for all the time of existence and management of the joint border control post.

This Agreement has been signed in Valka on March 05, 1999 in 2 (two) copies in Estonian, Latvian and English, all texts being equally authentic. In case of any dispute of interpretation of the text of the Agreement the English text shall prevail.
