«protokolliosalised»),
arvestades, et
• 23. aprillil
1996. a allkirjastasid Eesti ja CERN teadus- ja tehnikakoostöö
edendamise kokkuleppe, edaspidi «1996. a koostöökokkulepe»;
•
13. septembril 1996. a kaasati Keemilise ja Bioloogilise Füüsika
Instituut, Eesti, Tallinn, edaspidi «KBFI», koostööprojekti «M-solenoid»
(ingl k Compact Muon Solenoid, edaspidi «CMS koostööprojekt»),
mille osalised valmistavad praegu suurte hadronite kiirendi (ingl k Large
Hadron Collider) programmi (edaspidi «LHC programm») raames suure
energiaga elementaarosakeste detektorit (kava kohaselt valmib
2007. aastal), millega seoses võõrustab CERN projektis osalejaid;
•
29. mail 1998. a allkirjastasid CERN ja KBFI «Vastastikuse mõistmise
memorandumi CMS detektori valmistamisega seotud koostöö kohta» (RRB
CMS-D 98-31, 27. aprill 1998), edaspidi «memorandum»;
•
memorandumi kohaselt on KBFI eraldanud esialgsed rahalised vahendid ja
võimaldab Eesti teadlastel LHC programmis osaleda, andes seega oma
panuse CMS detektori valmistamisse;
• teadus- ja tehniliste töötajate
vahetus on vastastikusest huvist lähtuvalt vajalik, et Eesti saaks CERNi
füüsikaprogrammis osaleda;
• Eesti teadlaste osalemine
Euroopa riikidevahelise organisatsiooni korraldatavates rahvusvahelistes
kõrgtasemel teadusprojektides ning noorte teadlaste koolitamine ja
tehnoloogiaalase oskusteabe vahetamine on kasulik nii Eestile kui ka
rahvusvahelisele teadlaskonnale,
lepivad kokku järgmises.
Artikkel 1. Protokolli eesmärk
Protokolli eesmärk on esitada Eesti ülikoolide ning teadusasutuste teadus- ja tehniliste töötajate pikemaajalised tegevussuunad seoses osalemisega suure energiaga elementaarosakeste füüsikalistes eksperimentides CERNi juures LHC programmiga sarnanevate ettevõtmiste raames.
Artikkel 2. Koostöö
2.1. Protokolliosalised teevad uurimise, arendamise ja ehitustegevuse alast koostööd, mida on käsitletud käesolevas protokollis.
2.2. Eesti määrab KBFI nende ülesannete täitjaks, mis protokolli kohaselt kuuluvad KBFI kohustuste hulka, ning viimane annab selleks oma nõusoleku.
2.3. KBFI vahendab CERNi ning Eesti ülikoolide ja teadusasutuste (kaasa
arvatud KBFI) tihedat koostööd, arvestades, et Eesti kvalifitseeritud
teadus- ja tehnilised töötajad osalevad järgmistes projektides:
a)
koostöö seoses CMS TOTEMiga;
b) LHC GRID-võrgustiku (LCG)
projekt;
c) KBFI ja CERNi eelneva ametliku kokkuleppe kohaselt kõik
muud CERNi projektid, mis on seotud suure energiaga elementaarosakeste
füüsikaga.
2.4. Koostöö lõpetatakse pärast asjakohase projekti lõppemist või protokolli lõpetamise korral või kirjaliku kokkuleppe alusel.
2.5. CERN nõustub Eesti üliõpilaste ja keskkooliõpetajate osalemisega asjakohastes programmides kvootide piires, mille CERN ja KBFI eelnevalt aastaste perioodide kaupa kokku lepivad. Kvoodi suurus sõltub kandidaatide arvust ja CERNi võimalustest kandidaate vastu võtta. Erandjuhtudel ning tingimusel, et ka Eesti ettevõtmist rahaliselt toetab, võib CERN kandidaate vastu võtta ka tehnikaeriala või doktoriõppe üliõpilastele mõeldud programmidesse.
2.6. Eesti osaleb koostöös memorandumi kohaselt CERNiga sõlmitud ametlike kokkulepete alusel, näiteks CMS/TOTEMi detektori või LHC Computing Gridi valmistamisel, hooldamisel ja kasutamisel.
Artikkel 3. Eesti toetus KBFI-le ja teistele Eesti koostööpartneritele
Eesti tagab KBFI-le ja teistele Eesti koostööpartneritele kuni 2010. aasta lõpuni, kuid vähemalt kuni protokolli kehtivusaja lõpuni, rahalised vahendid, mis on vajalikud KBFI protokollist tulenevate kohustuste täitmiseks. Selleks loob Eesti kooskõlas protokolli artikliga 5 Eesti fondi.
Artikkel 4. Organisatsioon
Eesti täidab protokollis sätestatud kohustusi KBFI vahendusel tihedas koostöös CERNi ja teiste Eesti koostööpartneritega. Koostöö tagamiseks määrab Eesti CERNi ja Eesti koostöörühma koordinaatori.
Artikkel 5. Eesti fond
5.1. CERNi ja Eesti koostöörühma koordinaator tagab Eesti fondi kasutamise kooskõlas protokolli tingimustega Eesti volituste kohaselt ning tihedas koostöös KBFIga.
5.2. Eesti poolt CERNi koostöörühma kontole kantud rahalisi vahendeid haldab CERN, kes esitab CERNi ja Eesti koostöörühma koordinaatorile iga kuu tulude ja kulude aruande.
5.3. Eesti fondi vahendeid kasutatakse vaid järgmistel eesmärkidel:
a)
Eesti füüsikute, inseneride ning tehnikute reisikuludeks ja päevarahaks,
et võimaldada neil LHC programmis osaleda;
b) LHC detektorite
valmistamise, hooldamise ja kasutamise fondi sissemaksete tegemiseks
vastavalt Eesti osalusele nimetatud eksperimentides;
c) nende
materjalide ja seadmete eest tasumiseks, mida Eesti esindajad CERNis
vajavad ning mille soetamise kulusid CERN tavalise tehnilise toe raames
külalisesindajatele eraldatavatest vahenditest ei kanna;
d)
nende materjalide ja seadmete eest tasumiseks, mis ostetakse CERNist ja
mida kasutatakse Eestis CERNiga KBFI vahendusel tehtava koostöö raames.
Artikkel 6. Töötajad
6.1. KBFI tagab, et töötajate oskused ja kvalifikatsioon vastavad koostööks ettenähtud vajadustele.
6.2. KBFI ning selle koostööpartneritest ülikoolid ja teadusasutused tasuvad oma töötajate CERNi territooriumile reisimise kulud, kui ei ole sätestatud teisiti.
6.3. CERNi juures viibivaid Eesti teadlasi loetakse CERNi töötajate reeglite ja juhiste tähenduses kasutajateks või töötasu mittesaavateks partneriteks. Nad määratakse CERNis tööle eksperimentaalse koostööga tegelevatesse uurimisrühmadesse ja/või CERNi osakondadesse. Lisaks võetakse nimetatud teadlased arvele CERNi kasutajate büroos ja/või asjakohases CERNi osakonnas.
6.4. Eesti teadlased jätkavad CERNi juures viibides töösuhet oma kodumaiste tööandjatega, kes vastutavad ainuisikuliselt oma töötajate töötasu, sotsiaalhoolekande, sotsiaalkindlustuse ja tervisekindlustuse eest ning kolmandate isikute kahjudega seotud vastutuskindlustuse eest. Kõik nimetatud aspektid peavad vastama CERNi liikmesriikides – Šveitsis ja Prantsusmaal – kehtivatele standarditele. Eespool nimetatuga seoses vabastab Eesti CERNi vastutusest.
6.5. Protokollisalised võtavad meetmeid, et tagada teise protokolliosalise töötajatele, kes viibivad tema territooriumil või CERNi puhul ka tema töökohas, rahvusvahelise organisatsiooni töötajatele tagatud kaitse.
Artikkel 7. Kahjudega seotud vastutus ja kohustused
Kui ühe protokolliosalise tegevusest tingituna tekib kahjusid, lahendatakse vastutuse ja kohustuste jagamise küsimus 1996. a koostöökokkuleppe ning kahju tekkimise riigi õigusaktide kohaselt.
Artikkel 8. Ohutus
8.1. Mõlema protokolliosalise töötajad järgivad võõrustava organisatsiooni kodukorda ja ohutuseeskirju.
8.2. Kõiki konstruktsioone või seadmeid valmistatakse ning kasutatakse kooskõlas selle protokolliosalise tööstusohutuse eeskirjaga, kelle riigis neid konstruktsioone või seadmeid kasutatakse ja installeeritakse.
Artikkel 9. Intellektuaalne omand
Protokolli täitmisel tekkiv intellektuaalne omand kuulub protokolliosaliste ühisomandisse ning käesolevaga on nad nõus andma teineteisele vaba, tagasivõetamatu ja piiramatu kehtivusajaga litsentsi nimetatud omandiõiguse kasutamiseks teaduslikel ja rahumeelsetel eemärkidel ning väljastama samade piirangute alusel all-litsentse; eeltoodud säte kehtib koos memorandumis kirjeldatud korraga. Mõlemad protokolliosalised lubavad vabastada teise osalise vastutusest kahjude või kulude eest, mis võivad tekkida seoses nimetatud õiguste teostamisega (kaasa arvatud litsentseerimisega).
Artikkel 10. Protokolli kestus
10.1. Protokoll kehtib kuni 31. detsembrini 2010. a (kaasa arvatud), kuid üksnes juhul, kui kehtib ka 1996. a koostöökokkulepe. Kui protokoll lõpetatakse, kasutatakse Eesti fondis olevad rahalised vahendid ära protokolli artikli 5 lõike 3 kohaselt.
10.2. Protokolli kehtivuse pikendamist arutatakse enne 2008. aasta lõppemist, et Eesti teadlased saaksid jätkuvalt osaleda CERNi programmides.
Artikkel 11. Allakirjutamine
Arvestades 1996. a koostöökokkuleppe artikli 7 punkti a ja KBFI kaasatust protokolli rakendamisel (artikli 2 lõige 2) ning et kinnitada oma nõusolekut sellest tuleneva töö mahuga allkirjastab protokolli lisaks protokolliosaliste volitatud esindajatele ka KBFI juhatuse esimees.
Artikkel 12. 1996. a koostöökokkulepe
Protokoll on 1996. a koostöökokkuleppe lahutamatu osa, selle tingimused jäävad kehtima, kui protokollis ei sätestata teisiti.

PROTOCOL TO THE CO-OPERATION AGREEMENT DATED 23 APRIL 1996 BETWEEN THE REPUBLIC OF ESTONIA AND THE EUROPEAN ORGANIZATION FOR NUCLEAR RESEARCH (CERN)
concerning Participation of Universities and Scientific Institutions
from the Republic of Estonia in the High-Energy Particle Physics
Experiments at CERN
Done on 25 May 2004
The Republic of Estonia, hereafter referred to as “Estonia
”, represented by its Minister of Education and Research, Dr Toivo
Maimets,
on the one hand,
and
The European Organization for
Nuclear Research, hereafter referred to as “CERN”, having
its seat in Geneva, Switzerland, and represented by its
Director-General, Dr Robert Aymar,
on the other hand,
(hereafter
referred to as “the Parties”);
Considering that
– On 23 April 1996, CERN and Estonia have signed a
Co-operation Agreement concerning the further development of scientific
and technical co-operation, hereafter referred to as “the 1996
Co-operation Agreement”;
– On 13 September 1996, the National
Institute for Chemical Physics and Biophysics, in Tallinn, Estonia,
hereafter referred to as “NICPB”, was accepted as a
participant of the Compact Muon Solenoid (CMS) Collaboration
which is now constructing, for completion in the year 2007, a high-
energy particle physics detector as part of the LHC Programme, with CERN
acting as the host institution;
– On 29 May 1998, CERN and NICPB have
signed a “Memorandum of Understanding for Collaboration in the
Construction of the Compact Muon Solenoid Detector”, (RRB CMS-D 98-31,
dated 27 April 1998), hereafter referred to as “the MoU”;
–
Initial funding provided by NICPB under the terms of the MoU has enabled
Estonian scientists to participate in the Large Hadron Collider (LHC)
Programme, by making appropriate contributions to the construction of
the CMS detector;
– The exchange of scientific and technical
personnel is a necessary element for the participation of Estonia in the
physics programmes of CERN on a basis of reciprocity;
– The
participation of Estonian scientists in an international, cutting- edge
science project hosted by a European Intergovernmental Organization,
through the education of young scientists and through the transfer of
technological know-how, will be of mutual benefit to both Estonia and
the international science community;
It is agreed as follows:
Article 1. Purpose of Protocol
The purpose of this Protocol is to provide a long-term operational framework for the participation of scientific and technical personnel of Estonian Universities and Scientific Institutions in high-energy particle physics experiments at CERN, such as provided by the LHC Project.
Article 2. Collaboration
2.1. The Parties shall co-operate in the research, development and construction activities specified in this Protocol.
2.2. Estonia herewith appoints NICPB, and the latter herewith accepts, to execute those aspects of the collaboration which are designated in this Protocol as to be executed by NICPB.
2.3. NICPB shall set up dedicated collaborations between CERN and
Estonian Universities and Scientific Institutions (including NICPB),
with a view to the participation of qualified Estonian scientific and
technical personnel in:
(a) the CMS TOTEM Collaboration, and
(b)
the LHC Computing Grid Project (LCG), and,
(c) subject to prior
formal agreement by NICPB and CERN, any other project at CERN related to
high-energy particle physics.
2.4. Any such collaboration shall only cease through the termination of the respective project, or of this Protocol, or by written agreement.
2.5. CERN accepts the participation of Estonian students and high-school teachers in its respective training programmes within firm quotas to be agreed on an annual basis between CERN and NICPB, it being understood that these quota depend on the number of candidates and CERN’s capacity to host them. In exceptional cases, and subject to financial support from Estonia, CERN could also accept Estonian candidates in its programmes for technical or doctoral students.
2.6. Estonia shall make its due contributions as far as these have formally been agreed with CERN in the form of Memoranda of Understanding, such as for the construction, maintenance and operation of the CMS/TOTEM Detector, or for the LHC Computing Grid.
Article 3. Contributions by Estonia to NICPB and its Estonian Collaborators
Estonia shall provide to NICPB and its Estonian collaborators, until the year of 2010, but for at least the duration of validity of this Protocol, the funding required for the performance of NICPB’s obligations under this Protocol, For this purpose Estonia shall set up an “Estonia Fund” in accordance with Article 5 of this Protocol.
Article 4. Organization
Estonia, through NICPB, shall execute this Protocol in close collaboration with CERN and any other agreed partner in Estonia. To this end, Estonia shall appoint a CERN-Estonia Team Co-ordinator.
Article 5. The Estonia Fund
5.1. The CERN-Estonia Team Co-ordinator shall ensure that the Estonia Fund is used in accordance with the terms of this Protocol, under the authority of Estonia and in close consultation with NICPB.
5.2. For funds placed by Estonia in a CERN Team Account, CERN shall ensure the administrative handling and provide CERN-Estonia Team Co-ordinator with a monthly statement of income and expenditure of these funds.
5.3. The Estonia Fund shall be used for the following purposes only:
(a)
To cover the travel expenses and subsistence payments of physicists,
engineers and technicians from Estonia to allow them to participate in
the LHC Programme;
(b) Contributions to cover the agreed
“Construction” and “Maintenance & Operation Funds” for the LHC detectors
in proportion to the Estonian participation in these experiments;
(c)
Expenditures for materials and equipment as required by Estonian teams
at CERN and which fall outside the normal technical support provided by
CERN for visiting teams;
(d) Expenditures at CERN for materials and
equipment to be used in Estonia for research work by Estonian
institutions in relation to their collaborations with CERN, via NICPB.
Article 6. Personnel
6.1. NICPB shall ensure the selection of personnel with the necessary skills and competence to take part in the collaborations.
6.2. NICPB and its collaborating Universities and Scientific Institutions shall pay for the travel of their own personnel when coming CERN, unless otherwise agreed upon.
6.3. The Estonian scientists, for the duration of their presence at CERN, shall be given the status of Users or Unpaid Associates in the sense of the CERN Staff Rules and Regulations. They shall be assigned to Research Teams of the experimental Collaborations at CERN and/or to the CERN Departments; They shall be registered in the CERN Users Office and/or in the relevant CERN Department.
6.4. The Estonian scientists shall remain employees of their home institutions, which, as employers, shall bear exclusive responsibility for their remuneration and for the procurement of social security insurance, health insurance and third party liability insurance, all of which must be adequate in relation to the levels prevailing in CERN’s Host States, Switzerland and France. Estonia shall hold CERN free and harmless from any liability in this respect.
6.5. Each Party shall take the necessary steps to ensure a level of protection for the personnel of the other Party, when being on its territory or, in the case of CERN, the site, of the former, equivalent to that granted to the members of the personnel of an Intergovernmental Organization.
Article 7. Liability and responsibility for damages of all kinds
The liability and responsibility for any potential damage of all kinds caused by one of the Parties shall be settled in accordance with the terms of the 1996 Co-operation Agreement on the basis of the law of the country where the damage has been caused.
Article 8. Safety
8.1. The personnel of each Party shall comply with the rules for conduct and safety in force at the host establishment.
8.2. Any item or equipment constructed and used by personnel from either Party shall conform to the rules for industrial safety in force at the host establishment where it will be installed and operated.
Article 9. Intellectual Property
Without prejudice to the mechanism laid down in any applicable Memorandum of Understanding, the intellectual property rights resulting from the execution of this Protocol shall be jointly vested in the Parties, who herewith agree to grant each other a free, irrevocable and perpetual license to use such rights for any scientific, non-military purpose, including the right to sub-license such rights to any other party for scientific, non-military purposes. Each Party shall hold the other Party free and harmless from, and indemnify it for, any loss or damage resulting from its use (including any licensing) of such rights.
Article 10. Duration
10.1. This Protocol shall be in force until/inclusive 31 December 2010, subject to the continued validity of the 1996 Co-operation Agreement. In case of termination of this Protocol, any remaining amount in the Estonia Fund shall be utilised in accordance with Article 5.3 of this Protocol.
10.2. The extension of this Protocol shall be discussed before the end of the year 2008 with the aim of ensuring a continued access of Estonian scientists to the CERN programme.
Article 11. Signature
In consideration of Article 7(a) of the 1996 Co-operation Agreement and of its involvement in the execution of this Protocol (Article 2.2) and to confirm its agreement to the scope of the work it shall thereby undertake, the Chairman of the Board of NICPB shall add his signature to those of the authorized representatives of the Parries.
Article 12. 1996 Co-operation Agreement
This Protocol shall form an integral part of the 1996 Co-operation Agreement, whose terms shall apply hereto in so far as this Protocol does not stipulate.
