Teadaanne välislepingu jõustumise kohta
Koostatud 12. oktoobril 2004. a Tallinnas, jõustunud 21. veebruaril 2005. a
Eesti Vabariigi valitsus ja Gruusia valitsus, edaspidi «lepingupooled»,
soovides tugevdada sõbralikke suhteid Eesti ja Gruusia rahva vahel ning arendada nende suhteid kultuuri, hariduse, teaduse, noorsoo, spordi ja massimeedia alal;
veendunud, et kahe riigi koostöö on vastastikuse mõistmise ja sõpruse tugevdamise väärtuslik vahend;
nende riikide õigusaktide kohaselt,
on kokku leppinud järgmises.
Artikkel 1. Koostöö ulatus
Lepingupooled soodustavad otsekontakte ja asutuste koostööd ning vahetavad mõlema riigi kultuuri, hariduse, teaduse ja teadusuuringute, noorsoo, spordi ja massimeedia valdkonna kohta teavet ning edendavad kunstnike, üliõpilaste, lektorite, teadlaste, noorte, sportlaste, ajakirjanike ja ekspertide vahetust.
Artikkel 2. Kultuur
Lepingupooled soodustavad järgmist tegevust:
1. Delegatsioonide vahetamine kaunite kunstide ja lavakunsti alal.
2. Teineteise esindajate kutsumine mõlemas riigis peetavatele keele, kirjanduse ja kultuuri lühikursustele, et edendada teise lepingupoole keele ja kultuuri tundmist.
3. Gruusias elavate eestlaste ühenduste ja Eestis elavate gruusia rahvaste ühenduste, samuti muude kahe riigi kultuurisuhteid arendavate ühiskondlike organisatsioonide tegevuse toetamine.
4. Mõlemas riigis toimuvatel muusika- ja muudel kultuuriüritustel osalemine ning muusikute ja teiste artistide vahetus.
5. Kultuuripärandi ebaseadusliku sisse- ja väljaveo ennetamine lepingupoolte õiguse ja rahvusvaheliste lepingute kohaselt, mille osalised nad on.
6. Arheoloogia, museoloogia ning ajaloo- ja arhitektuuripärandi säilitamise ning restaureerimise alase koostöö ning asjaomaste valdkondade publikatsioonide vahetamine.
7. Mõlema riigi rahvusraamatukogude ja riiklike arhiivide koostöö ning raamatukogude ja arhiivide vahel publikatsioonide vahetamine ühist huvi pakkuvatel aladel.
8. Teineteise esindajate kutsumine rahvusvahelistele kongressidele, kollokviumidele, sümpoosionidele, seminaridele ja muudele samalaadsetele kohtumistele.
Artikkel 3. Haridus ja teadus
Lepingupooled soodustavad järgmist tegevust:
1. Kõrgkoolide kultuuri, ajaloo ja geograafia ning usulise hariduse õppematerjalide vahetamine, et anda teineteisele oma riikide kohta korrektset ja adekvaatset teavet.
2. Üliõpilaste, lektorite ja ekspertide vahetamine.
3. Koostöö edendamine bakalaureuse-, magistri- ja doktoriõppe üliõpilaste teadusuuringutes ja stipendiumiprogrammides.
Artikkel 4. Noored ja sport
Lepingupooled soodustavad mõlema riigi noorte- ja spordiorganisatsioonide koostööd ning delegatsioonide, võistkondade ja treenerite vahetust.
Artikkel 5. Massimeedia
Lepingupooled soodustavad mõlema riigi uudisteagentuuride ja ringhäälinguasutuste koostööd ning programmide vahetust.
Artikkel 6. Rakendamise vormid
Kokkuleppes nimetatud tegevuse elluviimiseks võivad kummagi riigi asjaomased asutused või organisatsioonid välja töötada erileppeid, -programme või -projekte. Lepped, programmid või projektid peaksid muu hulgas hõlmama eri ettevõtmistega seotud eesmärke, rahastamiskorda ja muid üksikasju.
Artikkel 7. Autoriõigus
Kokkuleppe alusel teaduse, kunsti ja kirjanduse valdkonnas korraldatud tegevuse tulemuste suhtes kehtivad lepingupoolte territooriumidel autoriõiguse ja sellega kaasnevate õiguste kaitset käsitlevad õigusaktid, niivõrd kui need õigused ei ole hõlmatud rahvusvahelise üldkokkuleppega.
Artikkel 8. Vaidluste lahendamine
Kokkuleppe rakendamisest tuleneva vaidluse lahendavad lepingupooled konsultatsioonide või läbirääkimiste teel.
Artikkel 9. Muutmine
Kokkulepet võib vajaduse korral muuta või uuesti läbi vaadata lepingupoolte vastastikusel kirjalikul nõusolekul. Muudatus, mille suhtes lepingupooled on kokku leppinud, jõustub lepingupoolte kindlaksmääratud kuupäeval.
Artikkel 10. Jõustumine, kestus ja lõpetamine
1. Kokkulepe jõustub päeval, mil saadakse kätte viimane teade, millega lepingupooled teatavad teineteisele diplomaatiliste kanalite kaudu sellest, et kokkuleppe jõustumiseks vajalikud riigisisesed nõudmised on täidetud.
2. Kokkulepe kehtib määramata aja. Lepingupool võib igal ajal diplomaatiliste kanalite kaudu kirjalikult teisele lepingupoolele teatada oma kavatsusest kokkulepe lõpetada. Sellisel juhul lõpeb kokkulepe teate kättesaamisest arvates kuue kuu pärast.
3. Kokkuleppe lõpetamine ei mõjuta ühegi selle kokkuleppe kohase leppe, programmi või projekti kehtivust ega kestust kuni selle leppe, programmi või projekti lõpuleviimiseni, kui lepingupooled ei ole kokku leppinud teisiti.
Selle kinnituseks on valitsuste täievolilised esindajad kokkuleppele alla kirjutanud.
Koostatud 12. oktoobril kahe tuhande neljandal aastal Tallinnas eesti,
gruusia ja inglise keeles, kõik tekstid on võrdselt autentsed.
Kokkuleppe tõlgendamisel tekkivate lahkarvamuste korral võetakse aluseks
ingliskeelne tekst.

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF ESTONIA AND THE GOVERNMENT OF GEORGIA ON CO-OPERATION IN THE FIELDS OF CULTURE, EDUCATION, SCIENCE, YOUTH AND SPORTS
The Government of the Republic of Estonia and the Government of Georgia, hereinafter referred to as “the Parties”
Desiring to strengthen the existing friendly relations between the Estonian and the Georgian peoples and to promote and develop their relations in the fields of culture, education, science, youth, sports and mass media;
Convinced that said co-operation is a valuable instrument for enhancing mutual understanding and friendship between both countries;
Pursuant to the prevailing laws and regulations of their respective countries;
Have agreed as follows:
Article 1. Scope of Co-operation
The Parties shall encourage and facilitate direct contacts and co-operation between institutions in the fields of culture, education, science and scientific research, youth, sports and mass media of both countries and exchange of information between them, they shall also promote the exchange of artists, students, lecturers, scientists, youth, sportsmen, journalists and experts.
Article 2. Culture
The Parties shall encourage the following activities:
1. To exchange missions in the fields of fine and performing arts.
2. To promote the knowledge of the other Party’s language and/or culture, the Parties shall invite each other to short courses in language, literature and culture held in the two countries.
3. To encourage the activities of the associations of Estonians living in Georgia, and of Georgians living in Estonia respectively, as well as the activities of the other non-profit organisations aimed to develop cultural relations between the two countries.
4. To take part in music and other cultural events held in both countries and promote the exchange of musicians and other artists.
5. To prevent the illegal importation and exportation of goods, which are part of their respective cultural heritages in accordance with their national legislation and in the enforcement of the related multilateral international agreements to which both countries are the Parties.
6. To promote co-operation in the fields of archaeology, museology and the preservation and restoration of historical and architectural heritage and exchange publications in the respective fields.
7. To promote co-operation between the National Libraries and National Archives of both countries and the exchange of publications between the libraries and archives in the fields of common interest.
8. To invite each other to international congresses, colloquia, symposia, seminars and other similar meetings.
Article 3. Education and Science
The Parties shall encourage the following activities:
1. To exchange educational material on culture, history and geography and religious education in higher education institutions in order to give each other correct and adequate information about their respective countries.
2. To exchange students, lecturers and experts.
3. To promote co-operation in scientific research and scholarship program for graduate and postgraduate students.
Article 4. Youth and Sports
The Parties shall encourage co-operation between youth and sports organisations of the two countries in order to promote the exchange of delegations, teams and trainers.
Article 5. Mass Media
The Parties shall encourage the co-operation and the exchange of the programs between News Agencies and broadcasting institutions of both countries.
Article 6. Forms of Implementation
Activities described in this Agreement may be implemented through the development of specific arrangements, programs or projects between the appropriate institutions or organisations of each Party. Such arrangements, programs or projects should specify, inter alia, the objectives, financial arrangements and other details relating to the specific undertaking.
Article 7. Copyright
Any activities in the field of science, arts and literature which are performed under this Agreement shall be subject to the laws and regulations concerning the protection of copyright and its neighbouring rights in the respective territories of the Parties insofar if these rights are not covered by a multilateral international agreement to which both countries are the Parties.
Article 8. Settlement of Disputes
Any dispute arising out of the implementation of the provisions of this Agreement shall be settled amicably by consultations or negotiations between the Parties.
Article 9. Amendment
This Agreement may be amended or revised, if it is deemed necessary, by mutual written consent by the Parties. Any modification or amendment, which has been agreed upon by the Parties, shall enter into force in accordance with the procedures listed in the Article 10.
Article 10. Entry into Force, Duration and Termination
1. This Agreement shall enter into force on the date of the receipt of the last notification by which the Parties inform each other, through diplomatic channels, that their respective domestic legal requirements for giving effect to the present Agreement have been fulfilled.
2. This Agreement shall be concluded for an indefinite period of time. Either Party may at any time, in writing, through diplomatic channels, give notice to the other Party of its intention to terminate this Agreement. In such case this Agreement shall terminate six months after the date of receipt of the notice by the other Party.
3. The termination of this Agreement shall not affect the validity and duration of any arrangement, program or project under this Agreement until the completion of such arrangement, program or project, unless the Parties agreed otherwise.
In witness whereof, the undersigned, being duly authorised thereto by their respective governments, have signed this Agreement.
Done at Tallinn on the 12th day of October in the year two thousand and
four, in Estonian, Georgian and English languages, all texts being
equally authentic. In case of any divergence on the interpretation of
this Agreement, the English text shall prevail.
