Chapter 1 GENERAL PROVISIONS 

§ 1.  Scope of application of Act

  This Act provides the legal bases for the organisation of youth work.

§ 2.  Application of Administrative Procedure Act

  The provisions of the Administrative Procedure Act apply to administrative proceedings prescribed in this Act, taking account of the specifications provided for in this Act.

§ 3.  Definitions

  In this Act, the following definitions are used:
 1) a young person is a natural person between 7 and 26 years of age;
 2) a youth work agency is a state agency administered by a ministry, a rural municipality or city administrative agency or an institution administered by a rural municipality or city administrative agency, a legal person in private law, or an undertaking of a legal person in private law the main activity of which is the organisation of youth work;
 3) a youth work association is a non-profit association, an union of non-profit associations or a foundation the objective of which is the integration of youth workers, youth work agencies or other exercisers and organisers of youth work and representation of their interests;
 4) a permanent youth camp (hereinafter youth camp) is a camp of a person entered in the commercial register, the non-profit associations and foundations register or the register of religious associations, or a camp of an agency entered in state register of state and local government agencies, or a camp of a legal person in public law (hereinafter youth camp manager) which is conducted on the basis of youth camp statutes and activity licence issued by the minister responsible for the area and the duration of one camp period of which is at least six twenty-four hour periods and which operates more than sixty days in a year;
 5) a youth project camp (hereinafter project camp) is a camp of a person entered in the commercial register, the non-profit associations and foundations register or the register of religious associations, or a camp of an agency entered in state register of state and local government agencies, or a camp of a legal person in public law (hereinafter project camp manager) which is conducted with the permission of rural municipality or city government and the duration of one camp period of which is at least six twenty-four hour periods and which operates up to sixty days in a year;
 6) a youth council is an advisory participation council consisting of young people which operates at rural municipality or city council;
 7) a youth programme is an action plan in the field of youth work together with the forecast of value and the duration of which exceeds one year;
 8) a youth project is an action plan in the field of youth work together with a budget and the duration of which is up to one year;
 9) a youth association is a non-profit association at least two thirds of the members of which are young people and the objective of which is the organisation and performance of youth work;
 10) a union of youth associations is a non-profit association the members of which are youth associations.

§ 4.  Youth work

 (1) Youth work is the creation of conditions to promote the diverse development of young persons which enable them to be active outside their families, formal education acquired within the adult education system, and work on the basis of their free will.

 (2) The organisation of youth work proceeds from the following principles:
 1) youth work is performed for the benefit of and together with young people by involving them in the decision making process;
 2) upon creating the conditions for the acquisition of knowledge and skills the needs and interests of young people shall be proceeded from;
 3) youth work is based on the participation and free will of young people;
 4) youth work supports the initiative of young people;
 5) youth work proceeds from the principle of equal treatment, tolerance and partnership.

§ 5.  Restriction on working with young people

Chapter 2 ORGANISATION OF YOUTH WORK 

§ 6.  Functions of the Ministry of Education and Research

  The Ministry of Education and Research shall:
 1) prepare the national programmes of youth work;
 2) support the activities of youth associations and allocate annual grants thereto;
 3) exercise state and administrative supervision in the field of youth work within the competence provided in the legislation and monitor the purposeful use of funds allocated for youth work from the state budget;

 4) perform other functions provided by law.

§ 7.  Functions of county governors

§ 8.  Functions of rural municipality and city councils

  Rural municipality and city councils shall:
 1) determine the priorities of youth work in their administrative territories and set out the tasks necessary for the achievement thereof in the rural municipality or city development plans;
 2) approve the support principles of youth associations, youth programmes and youth projects from the rural municipality or city budget, the procedure and conditions for applying for and payment of support, providing the terms and conditions of cost-sharing for the grant of support if necessary as well as the application forms of support and the procedure for reporting the use of support;
 3) support the youth programmes and youth projects of youth associations operating in the administrative territory of the given rural municipality or city in case of existing budget funds;
 4) consult with the youth council, in case it exists, upon planning, implementation and assessment of youth work;

 6) perform other functions connected with the organisation of youth work in their administrative territories.

§ 9.  Youth council

 (1) Youth council can be established at a rural municipality or city council. The objective of youth council shall be the discussion of issues concerning young people which are in the competence of the rural municipality or city and the making of proposals to the rural municipality or city council and rural municipality or city government in connection therewith proceeding from the needs and interests of young people.

 (2) Youth council shall be elected democratically by the young people of the rural municipality or city pursuant to the procedure established by the rural municipality or city council.

 (3) The bases for the activities of youth council shall be established by the rural municipality or city council.

 (4) The rural municipality or city shall support the sustainable activities of the youth council in their administrative territory pursuant to the procedure established by the rural municipality or city council.

 (5) Upon the request of the youth council the rural municipality or city council shall forward the drafts of their hearing agendas and draft legislations regarding young people to the youth council and before the taking place of the rural municipality or city council hearings.

§ 10.  Activity licence obligation

 (1) An activity licence is required for the organisation of youth and project camps.

 (2) The activity licence of a project camp is for a specified term and is valid for up to 60 days.

§ 101.  Requirements for youth and project camp manager

 (1) A youth camp manager shall offer young people the service of diverse recreational holidays promoting their development in a consistent manner.

 (2) A project camp manager shall offer young people the service of recreational holidays promoting their development mainly in one field of youth work.

 (3) A youth camp shall correspond to the health protection requirements established on the basis of Public Health Act. A young person shall not be admitted to youth camp if the young person’s state of health may endanger his or her health or the health of other people considering the orientation of the camp.

 (4) Each year, a youth camp manager shall submit to the Estonian Education Information System the number of young persons having participated in the youth camp per rural municipality or city.

§ 102.  Application for activity licence

 (1) An application for a youth camp activity licence shall be resolved by the Ministry of Education and Research or an agency authorised by the minister responsible for the area. An application for a youth camp activity licence shall be submitted through the Estonian Education Information System at least three months before the commencement of activities of a youth camp. The data on the youth camp activity licence shall be entered in the Estonian Education Information System.

 (2) An application for a project camp activity licence shall be resolved by the rural municipality or city government in the administrative territory of which the conduct of a project camp is applied for. An application for a project camp activity licence shall be submitted through the Estonian Education Information System at least two months before the commencement of activities of a project camp. The data on the project camp activity licence shall be entered in the Estonian Education Information System.

 (3) In addition to the provisions of the General Part of the Economic Activities Code Act, an application for a youth and project camp activity licence shall set out the following data:
 1) in case of a youth camp the statutes thereof;
 2) the written consents of the director and counsellors of the youth and project camp complying with the qualification requirements and documents which allow to assess their compliance with the requirements;
 3) information on the premises (buildings), furnishings and area necessary for the activities of the youth and project camp, and information concerning the compliance thereof with health protection, fire safety and rescue requirements;
 4) in case of a youth camp an activity plan for camp periods including a list of activities which promote the development of young people;
 5) in case of a project camp the name, personal identification code and place of residence of the person responsible for organising the project camp and the exact location in which the project camp is conducted;
 6) in case of a project camp the objective and schedule thereof.

 (4) The statutes of youth camp shall be approved by the youth camp manager and it shall set out:
 1) the name of the youth camp;
 2) the location of the youth camp;
 3) the objective and tasks of the activity of youth camp;
 4) the structure of the youth camp;
 5) the competence and functions of the director and counsellors of the youth camp;
 6) the rights and obligations of young people participating in the youth camp;
 7) the conditions for admission of a young person to the youth camp;
 8) the language of the youth camp;
 9) the bases for calculating the rate of the fee for participation in the youth camp;
 10) the bases for financing the youth camp;
 11) the procedure for termination of the activities of the youth camp.

 (5) The qualification requirements for the directors and counsellors of youth and project camps and the procedure for establishing the compliance therewith shall be approved by the minister responsible for the area.

 (6) A person having acquired foreign professional qualification may also work as the director or counsellor of a youth or project camp provided that his or her professional qualification has been recognised according to the Recognition of Foreign Professional Qualifications Act. The competent authority provided for in subsection 7 (2) of the Recognition of Foreign Professional Qualifications Act is the Estonian Youth Work Centre.

§ 103.  Object of inspection of activity licence

  An activity licence shall be granted if:
 1) the director and counsellors of a youth an project camp comply with the qualification requirements and the requirements provided for in § 20 of the Child Protection Act;

 2) the statutes of a youth camp comply with the requirements provided for in this Act;
 3) the youth and project camp has the premises (buildings), furnishings and area necessary for the activities of the youth and project camp, and which comply with health protection, fire safety and rescue requirements;
 4) the youth an project camp complies with the requirements established in this Act for the conduct of youth and project camp;
 5) the youth and project camp has complied with the requirements for processing sensitive personal data arising from the Personal Data Protection Act.

§ 11.  Operation of project camps

§ 12.  State or administrative supervision over activities of youth camps

 (1) State or administrative supervision over the educational activities of youth camps shall be exercised by the Ministry of Education and Research by appointing the officials exercising state or administrative supervision.

 (11) For the execution of state supervision provided for in this section, the law enforcement agency may apply the special state supervision measures provided for in §§ 30 and 50 of the Law Enforcement Act on the basis of and pursuant to the procedure provided for in the Law Enforcement Act.

 (2) Officials exercising administrative supervision shall have the right to visit the youth camp by informing the youth camp manager thereof in advance, inspect the documents of the youth camp and receive information concerning the application of legislation.

 (4) Upon failure to observe the precept the official exercising state supervision shall have the right to impose penalty payment pursuant to the procedure specified in Substitutive Enforcement and Penalty Payment Act. Maximum penalty payment shall be 640 euros.

§ 13.  State or administrative supervision over project camps

 (1) Rural municipality or city government shall exercise state or administrative supervision over compliance with the conditions and procedure for operation of project camp.

 (11) For the execution of state supervision provided for in this section, the law enforcement agency may apply the special state supervision measures provided for in §§ 30 and 50 of the Law Enforcement Act on the basis of and pursuant to the procedure provided for in the Law Enforcement Act.

§ 131.  Special state supervision measures

  For the execution of state supervision provided for in this Act, the law enforcement agency may apply the special state supervision measures provided for in §§ 30 and 50 of the Law Enforcement Act on the basis of and pursuant to the procedure provided for in the Law Enforcement Act.

Chapter 3 FINANCING OF YOUTH WORK 

§ 14.  Financing from state budget

 (1) The following grants shall be prescribed in the state budget within the budget of the Ministry of Education and Research:
 1) youth programmes and youth projects;
 2) national programmes for development of youth work;
 3) youth research;
 4) youth work agencies;
 5) international co-operation in youth work;
 6) training for youth workers;
 7) youth work associations;
 8) activities of youth associations (annual grant).

 (2) The conditions and procedure for applying for and allocating grants for youth programmes, youth projects, national programmes for the development of youth work, youth research and youth work agencies shall be approved by a regulation of the minister responsible for the area.

§ 15.  Annual grants for youth associations

 (1) The objective of annual grants for youth associations shall be the increase of the capability of youth associations and the achievement of national objectives of youth policy.

 (2) The following shall have the right to apply for an annual grant for youth association:
 1) youth association the membership of which includes at least 500 young persons and the local units of which operate in the territory of at least one third of the counties;
 2) union of youth associations the members of which include at least 30 youth associations;
 3) school student councils' union if it aggregates at least one third of Estonian basic school, upper secondary school or vocational educational institution students through its members;
 4) federation of student unions the members of which include at least one half of all student unions of educational institutions implementing higher education level studies.

 (3) The allocation of annual grants to youth associations, refusal to allocate annual grants and the amount thereof shall be decided by the minister responsible for the area, taking into account:
 1) the national priorities of youth work and youth policy;
 2) the youth association development plan, activities and former achievements in the field;
 3) the scope of activities of youth association, target group, membership and capability including the performance of former duties;
 4) the compliance of the applicant and application with the established requirements. The minister responsible for the area may involve experts for the decision making.

 (4) The specific conditions and procedure for applying for, allocating and refusal to allocate annual grants shall be established by the minister responsible for the area.

 (5) The applicant shall be notified of the decision to allocate, refusal to allocate the annual grant for youth association within five working days as of the date on which the decision is made in a format which can be reproduced in writing.

§ 151.  Additional support for hobby education and recreational activities to rural municipalities and cities

 (1) An additional support shall be granted from the state budget, if possible, in conformity with the State Budget Act to rural municipalities and cities to improve the accessibility and diversity of systematic and supervised hobby education and recreational activities for 7 to 19-year-old young persons with the aim of increasing their opportunities for the acquisition of knowledge, skills and attitudes relating to the chosen hobby (hereinafter hobby education and recreational activities support).

 (2) 50 per cent of the hobby education and recreational activities support shall be allocated to rural municipalities and cities for ensuring the accessibility of hobby education and recreational activities based on the number of 7 to 19-year-old young persons, young persons living in families having difficulties in coping and disabled young persons in a rural municipality or city and the financial capacity of the local government.

 (3) 50 per cent of the hobby education and recreational activities support shall be allocated to rural municipalities and cities for ensuring the diversity of hobby education and recreational activities based on the number of 7 to 19-year-old young persons and disabled young persons in a rural municipality or city and the financial capacity of the local government and the regional accessibility of hobby education and recreational activities by the settlement units located in the territory of a rural municipality or city.

 (4) A rural municipality or city may not use the hobby education and recreational activities support for the acquisition and taking into use of real estate and vehicles, construction of buildings and structures and for the payment of maintenance costs of registered immovables, buildings and premises. Upon the use of the hobby education and recreational activities support the rural municipality and city must proceed from the principle that the expenses to be covered from their budget shall not be replaced with the hobby education and recreational activities support.

§ 152.  Hobby education and recreational activities plan of rural municipality or city

 (1) A rural municipality or city shall, individually or with other rural municipalities or cities, prepare the youth hobby education and recreational activities plan which may be drawn for a period longer than one year and be part of the rural municipality or city development plan (hereinafter hobby education and recreational activities plan). The hobby education and recreational activities plan must include the following:
 1) the number of young persons participating in hobby education and recreational activities as of 1 October;
 2) the possibilities of participating in hobby education and recreational activities as of 1 October;
 3) the problems in the accessibility and diversity of hobby education and recreational activities;
 4) the activities for solving the problems.

 (2) The rural municipality or city shall submit the hobby education and recreational activities plan or the amendments made to the submitted plan, and the annual performance results of the plan by 15 January to the Ministry of Education and Research or to an institution authorised thereby.

§ 153.  Quality development support for fields of hobby

 (1) A support for specific purposes for developing the quality of fields of hobby and increasing cooperation within a field of hobby shall be prescribed for in the state budget, if possible.

 (2) The applicant for support specified in subsection (1) of this section shall:
 1) proceed from the principles provided for in subsection 4 (2) of this Act;
 2) represent the providers of youth hobby education and recreational activities relating to more than one hobby;
 3) cooperate with other associations of the field of hobby.

 (3) The list of fields of hobby receiving the quality development support for fields of hobby and the conditions and procedure for application, allocation and refusal to allocate the support shall be established by a regulation of the minister responsible for the area.

Chapter 5 IMPLEMENTING PROVISIONS 

§ 18.  Termination of the register of youth associations and register of youth camps

  The register of youth associations and the register of youth camps shall be liquidated in conformity with the requirements specified in the Archives Act and Public Information Act.

§ 19.  Validity of youth camp activity licence

  Youth camp activity licence which has been issued to the manager according to the requirements applicable prior to entry into force of this Act shall be valid until the period of validity specified on the licence.

§ 191.  Submission of hobby education and recreational activities plan of rural municipality or city in 2017 and submission of performance results of hobby education and recreational activities plan of 2017

 (1) In 2017, a rural municipality or city shall submit the hobby education and recreational activities plan as of 1 July to the Ministry of Education and Research or an institution authorised thereby by 1 September 2017.

 (2) The performance results of the hobby education and recreational activities plan of 2017 shall be submitted by the rural municipality or city together with the performance results of the hobby education and recreational activities plan of 2018 to the Ministry of Education and Research or an institution authorised thereby by 15 January 2019.

1. peatükk ÜLDSÄTTED 

§ 1.  Seaduse reguleerimisala

  Käesolev seadus sätestab noorsootöö korraldamise õiguslikud alused.

§ 2.  Haldusmenetluse seaduse kohaldamine

  Käesolevas seaduses ettenähtud haldusmenetlusele kohaldatakse haldusmenetluse seaduse sätteid, arvestades käesoleva seaduse erisusi.

§ 3.  Mõisted

  Käesolevas seaduses kasutatakse mõisteid järgmises tähenduses:
  1) noor – seitsme kuni kahekümne kuue aastane füüsiline isik;
  2) noorsootööasutus – ministeeriumi hallatav riigiasutus, valla või linna ametiasutus, valla või linna ametiasutuse hallatav asutus, eraõiguslik juriidiline isik või eraõigusliku juriidilise isiku ettevõte, mille põhitegevuseks on noorsootöö korraldamine;
  3) noorsootööühing – mittetulundusühing, mittetulundusühingute liit või sihtasutus, mille eesmärgiks on noorsootöötajate, noorsootööasutuste või teiste noorsootöö tegijate ja korraldajate ühendamine ning nende huvide esindamine;
  4) noorte püsilaager (edaspidi noortelaager) – äriregistrisse, mittetulundusühingute ja sihtasutuste registrisse või usuliste ühenduste registrisse kantud isiku, riigi- ja kohaliku omavalitsuse asutuste riiklikusse registrisse kantud asutuse või avalik-õigusliku juriidilise isiku (edaspidi noortelaagri pidaja) laager, mida peetakse noortelaagri põhimääruse ning valdkonna eest vastutava ministri antud noortelaagri tegevusloa alusel ning mille ühe vahetuse pikkus on vähemalt kuus ööpäeva ja mis tegutseb aastas üle 60 päeva;
  5) noorte projektlaager (edaspidi projektlaager) – äriregistrisse, mittetulundusühingute ja sihtasutuste registrisse või usuliste ühenduste registrisse kantud isiku, riigi- ja kohaliku omavalitsuse asutuste riiklikkusse registrisse kantud asutuse või avalik-õigusliku juriidilise isiku (edaspidi projektlaagri pidaja) laager, mida peetakse valla- või linnavalitsuse loal ning mille ühe vahetuse pikkus on vähemalt kuus ööpäeva ja mis tegutseb aastas kuni 60 päeva;
  6) noortevolikogu – valla- või linnavolikogu juures tegutsev noortest koosnev nõuandva õigusega osaluskogu;
  7) noorteprogramm – noorsootöö valdkonna tegevuskava, millele on lisatud maksumuse prognoos ning mis kestab kauem kui üks aasta;
  8) noorteprojekt – noorsootöö valdkonna tegevuskava, millele on lisatud eelarve ning mis kestab kuni üks aasta;
  9) noorteühing – mittetulundusühing, mille liikmetest vähemalt kaks kolmandikku on noored ja mille eesmärgiks on noorsootöö korraldamine ja läbiviimine;
  10) noorteühingute liit – mittetulundusühing, mille liikmed on noorteühingud.

§ 4.  Noorsootöö

  (1) Noorsootöö on tingimuste loomine noore isiksuse mitmekülgseks arenguks, mis võimaldab noortel vaba tahte alusel perekonna-, tasemeharidus- ja tööväliselt tegutseda.

  (2) Noorsootöö korraldamisel lähtutakse järgmistest põhimõtetest:
  1) noorsootööd tehakse noorte jaoks ja koos noortega, kaasates neid otsuste tegemisse;
  2) tingimuste loomisel teadmiste ja oskuste omandamiseks lähtutakse noorte vajadustest ja huvidest;
  3) noorsootöö põhineb noorte osalusel ja vabal tahtel;
  4) noorsootöö toetab noorte omaalgatust;
  5) noorsootöös lähtutakse võrdse kohtlemise, sallivuse ja partnerluse põhimõttest.

§ 5.  Piirang noortega töötamiseks

2. peatükk NOORSOOTÖÖ KORRALDAMINE 

§ 6.  Haridus- ja Teadusministeeriumi ülesanded

  Haridus- ja Teadusministeerium:
  1) töötab välja noorsootöö riiklikud programmid;
  2) toetab noorteühingute tegevust ja eraldab neile aastatoetusi;
  3) teostab riiklikku või haldusjärelevalvet noorsootöö valdkonnas õigusaktides sätestatud pädevuse piires ja kontrollib riigieelarvest eraldatud vahendite sihipärast kasutamist;

  4) täidab teisi õigusaktides sätestatud ülesandeid.

§ 7.  Maavanema ülesanded

§ 8.  Valla- ja linnavolikogu ülesanded

  Valla- või linnavolikogu:
  1) määrab noorsootöö prioriteedid oma haldusterritooriumil ning sätestab nende saavutamiseks vajalikud ülesanded valla või linna arengukavas;
  2) kinnitab noorteühingute, noorteprogrammide ja noorteprojektide valla- või linnaeelarvest toetamise põhimõtted, toetuse taotlemise ja maksmise tingimused ja korra, nähes vajaduse korral ette omaosaluse tingimused toetuse saamiseks, toetuse taotluste vormid ning toetuse kasutamise aruandluse korra;
  3) toetab eelarveliste vahendite olemasolul valla või linna haldusterritooriumil tegutsevate noorteühingute noorteprogramme ja noorteprojekte;
  4) konsulteerib selle olemasolul noortevolikoguga noorsootöö kavandamisel, teostamisel ja hindamisel;

  6) täidab teisi noorsootöö korraldamise ülesandeid oma haldusterritooriumil.

§ 9.  Noortevolikogu

  (1) Valla- või linnavolikogu juurde võib moodustada noortevolikogu. Noortevolikogu eesmärgiks on arutada valla või linna pädevusse kuuluvaid noori puudutavaid küsimusi ning teha nende kohta ettepanekuid valla- või linnavolikogule ja valla- või linnavalitsusele, lähtudes noorte vajadustest ja huvidest.

  (2) Noortevolikogu valitakse valla või linna noorte poolt demokraatlikul teel valla- või linnavolikogu kehtestatud korras.

  (3) Noortevolikogu tegutsemise alused kehtestab valla- või linnavolikogu.

  (4) Vald või linn toetavad oma haldusterritooriumi noortevolikogu jätkusuutlikku tegutsemist valla- või linnavolikogu kehtestatud korras.

  (5) Valla- või linnavolikogu edastab noortevolikogule selle taotlusel oma istungite päevakordade projektid ning noori puudutavate õigusaktide eelnõud enne valla- või linnavolikogu istungite toimumist.

§ 10.  Loakohustus

  (1) Noorte- ja projektlaagri korraldamiseks peab olema tegevusluba.

  (2) Projektlaagri tegevusluba on tähtajaline ja kehtib kuni 60 päeva.

§ 101.  Nõuded noorte- ja projektlaagri pidajale

  (1) Noortelaagri pidaja osutab noortele järjepidevalt mitmekesist tervistava ja arendava puhkuse teenust.

  (2) Projektlaagri pidaja osutab noortele peamiselt ühes noorsootöö valdkonnas tervistava ja arendava puhkuse teenust.

  (3) Noortelaager peab vastama rahvatervise seaduse alusel kehtestatud tervisekaitsenõuetele. Noortelaagrisse ei lubata noort, kui noore terviseseisund, arvestades laagri suunitlust, võib kahjustada noore enda või teiste tervist.

  (4) Noortelaagri pidaja on kohustatud igal aastal esitama Eesti Hariduse Infosüsteemi noortelaagris osalenud noorte arvu valla või linna arvestuses.

§ 102.  Tegevusloa taotlemine

  (1) Noortelaagri tegevusloa taotluse lahendab Haridus- ja Teadusministeerium või valdkonna eest vastutava ministri volitatud asutus. Tegevusloa taotlus esitatakse Eesti Hariduse Infosüsteemi kaudu vähemalt kolm kuud enne noortelaagri tegevuse alustamist. Noortelaagri tegevusloa andmed kantakse Eesti Hariduse Infosüsteemi.

  (2) Projektlaagri tegevusloa taotluse lahendab valla- või linnavalitsus, mille haldusterritooriumil soovitakse projektlaagrit pidada. Tegevusloa taotlus esitatakse Eesti Hariduse Infosüsteemi kaudu vähemalt kaks kuud enne projektlaagri tegevuse alustamist. Projektlaagri tegevusloa andmed kantakse Eesti Hariduse Infosüsteemi.

  (3) Noorte- ja projektlaagri tegevusloa taotluses esitatakse lisaks majandustegevuse seadustiku üldosa seaduses sätestatule järgmised andmed:
  1) noortelaagri korral selle põhimäärus;
  2) kvalifikatsiooninõuetele vastavate noorte- ja projektlaagri juhataja ja kasvatajate kirjalikud nõusolekud ning dokumendid, mis võimaldavad nõuetele vastavust hinnata;
  3) andmed noorte- ja projektlaagri tegevuseks vajalike ruumide (hoonete), sisustuse ja maa-ala kohta ning nende vastavuse kohta tervisekaitse-, tuleohutus- ja päästenõuetele;
  4) noortelaagri korral laagrivahetuste tegevuskava, mis sisaldab noori arendavate tegevuste loetelu;
  5) projektlaagri korral selle pidamise eest vastutava isiku nimi, isikukood ja elukoht ning projektlaagri pidamise täpne asukoht;
  6) projektlaagri korral selle eesmärk ja päevakava.

  (4) Noortelaagri põhimääruse kinnitab noortelaagri pidaja ning selles märgitakse:
  1) noortelaagri nimi;
  2) noortelaagri asukoht;
  3) noortelaagri tegevuse eesmärk ja ülesanded;
  4) noortelaagri struktuur;
  5) noortelaagri juhataja ja kasvatajate pädevus ning ülesanded;
  6) noortelaagris osalevate noorte õigused ja kohustused;
  7) noore noortelaagrisse vastuvõtmise tingimused;
  8) noortelaagri suhtluskeel;
  9) noortelaagris osalemise tasu määra arvutamise alused;
  10) noortelaagri finantseerimise alused;
  11) noortelaagri tegevuse lõpetamise kord.

  (5) Valdkonna eest vastutav minister kehtestab noorte- ja projektlaagri juhataja ja kasvataja kvalifikatsiooninõuded ning neile vastavuse tõendamise korra.

  (6) Noorte- ja projektlaagri juhataja ja kasvatajana võib töötada ka välisriigi kutsekvalifikatsiooni omandanud isik, kui tema kutsekvalifikatsiooni on tunnustatud välisriigi kutsekvalifikatsiooni tunnustamise seaduse kohaselt. Välisriigi kutsekvalifikatsiooni tunnustamise seaduse § 7 lõikes 2 sätestatud pädev asutus on Eesti Noorsootöö Keskus.

§ 103.  Tegevusloa kontrolliese

  Tegevusluba antakse, kui:
  1) noorte- ja projektlaagri juhataja ning kasvatajad vastavad kvalifikatsiooni- ja lastekaitseseaduse §-s 20 sätestatud nõuetele;

  2) noortelaagri põhimäärus vastab käesolevas seaduses sätestatud nõuetele;
  3) noorte- ja projektlaagril on olemas tegevuseks vajalikud ruumid (hooned), sisustus ja maa-ala, mis vastavad tervisekaitse-, tuleohutus- ja päästenõuetele;
  4) noorte- ja projektlaager vastab käesolevas seaduses noorte- ja projektlaagri pidamisele kehtestatud nõuetele;
  5) noorte- ja projektlaager on täitnud isikuandmete kaitse seadusest tulenevad delikaatsete isikuandmete töötlemise nõuded.

§ 11.  Projektlaagri pidamine

§ 12.  Riiklik või haldusjärelevalve noortelaagri üle

  (1) Noortelaagri õppe- ja kasvatustegevuse üle teostab riiklikku või haldusjärelevalvet Haridus- ja Teadusministeerium, määrates selleks riiklikku või haldusjärelevalvet teostavad ametnikud.

  (11) Korrakaitseorgan võib käesolevas paragrahvis sätestatud riikliku järelevalve teostamiseks kohaldada korrakaitseseaduse §-des 30 ja 50 sätestatud riikliku järelevalve erimeetmeid korrakaitseseaduses sätestatud alusel ja korras.

§ 13.  Riiklik või haldusjärelevalve projektlaagri üle

§ 131.  Riikliku järelevalve erimeetmed

  Korrakaitseorgan võib käesolevas seaduses sätestatud riikliku järelevalve teostamiseks kohaldada korrakaitseseaduse §-des 30 ja 50 sätestatud riikliku järelevalve erimeetmeid korrakaitseseaduses sätestatud alusel ja korras.

3. peatükk NOORSOOTÖÖ RAHASTAMINE 

§ 14.  Rahastamine riigieelarvest

  (1) Riigieelarvest toetatakse Haridus- ja Teadusministeeriumi eelarve kaudu:
  1) noorteprogramme ja noorteprojekte;
  2) noorsootöö arendamise riiklikke programme;
  3) noorsoouuringuid;
  4) noorsootööasutusi;
  5) rahvusvahelist koostööd noorsootöö alal;
  6) noorsootöötajate koolitusi;
  7) noorsootööühinguid;
  8) noorteühingute tegevust (aastatoetus).

  (2) Noorteprogrammide, noorteprojektide, noorsootöö arendamise riiklike programmide, noorsoouuringute ja noorsootööasutuste toetamise tingimused ning korra kehtestab valdkonna eest vastutav minister määrusega.

§ 15.  Noorteühingu aastatoetus

  (1) Noorteühingu aastatoetuse eesmärgiks on noorteühingute võimekuse tõstmine ja noorsootöö ning noortepoliitika riiklike eesmärkide saavutamine.

  (2) Noorteühingu aastatoetuse taotlemise õigus on:
  1) noorteühingul, kui sellel on vähemalt 500 liiget ja kui selle kohalikud üksused tegutsevad vähemalt 1/3 maakondade territooriumil;
  2) noorteühingute liidul, kui selle liikmeteks on vähemalt 30 noorteühingut;
  3) õpilasesindusi ühendaval ühingul, kui see koondab oma liikmete kaudu vähemalt 1/3 Eesti põhikoolide, gümnaasiumide või kutseõppeasutuste õpilastest;
  4) üliõpilaskondade liidul, kui selle liikmeteks on vähemalt 1/2 kõikidest kõrgharidustaseme õpet läbiviivate õppeasutuste üliõpilaskondadest.

  (3) Valdkonna eest vastutav minister otsustab noorteühingule aastatoetuse eraldamise, eraldamisest keeldumise ja aastatoetuse suuruse, lähtudes:
  1) noorsootöö ja noortepoliitika riiklikest prioriteetidest;
  2) noorteühingu arengukavast, tegevusest ja senistest saavutustest valdkonnas;
  3) noorteühingu tegevuse ulatusest, sihtgrupist, liikmeskonnast ja suutlikkusest, sealhulgas varasemate kohustuste täitmisel;
  4) aastatoetuse taotleja ja taotluse vastavusest kehtestatud nõuetele. Valdkonna eest vastutav minister võib otsustamiseks kaasata eksperte.

  (4) Noorteühingu aastatoetuse taotlemise, eraldamise ja eraldamisest keeldumise täpsemad tingimused ja korra kehtestab valdkonna eest vastutav minister.

  (5) Noorteühingu aastatoetuse eraldamise või toetuse eraldamisest keeldumise otsusest teavitatakse taotlejat kirjalikult taasesitatavas vormis viie tööpäeva jooksul otsuse tegemisest arvates.

§ 151.  Huvihariduse ja huvitegevuse täiendav toetus valdadele ja linnadele

  (1) Riigieelarvest määratakse kooskõlas riigieelarve seadusega valdadele ja linnadele võimaluse korral täiendav toetus 7–19-aastaste noorte süsteemse ja juhendatud huvihariduse ja huvitegevuse kättesaadavuse ja mitmekesisuse parandamiseks eesmärgiga suurendada nende võimalusi omandada teadmisi, oskusi ja hoiakuid valitud huvialal (edaspidi huvihariduse ja huvitegevuse toetus).

  (2) Huvihariduse ja huvitegevuse toetusest 50 protsenti jaotatakse valdadele ja linnadele huvihariduse ja huvitegevuse kättesaadavuse tagamise eesmärgil, lähtudes valla või linna 7–19-aastaste noorte, toimetulekuraskustes peredes elavate noorte ja puudega noorte arvust ning kohaliku omavalitsuse üksuse finantsvõimekusest.

  (3) Huvihariduse ja huvitegevuse toetusest 50 protsenti jaotatakse valdadele ja linnadele huvihariduse ja huvitegevuse mitmekesisuse tagamise eesmärgil, lähtudes valla või linna 7–19-aastaste noorte ja puudega noorte arvust, kohaliku omavalitsuse üksuse finantsvõimekusest ning huvihariduse ja huvitegevuse piirkondlikust kättesaadavusest valla või linna territooriumil asuvate asustusüksuste kaupa.

  (4) Vald ega linn ei või huvihariduse ja huvitegevuse toetust kasutada kinnisvara ja sõiduvahendite omandamiseks ja kasutusse võtmiseks, hoonete ja rajatiste ehitamiseks ning kinnistute, hoonete ja ruumide majandamiskulude eest tasumiseks. Huvihariduse ja huvitegevuse toetuse kasutamisel peavad vald ja linn lähtuma põhimõttest, et huvihariduse ja huvitegevuse toetusega ei asendata oma eelarvest kaetavaid kulusid.

§ 152.  Valla ja linna huvihariduse ja huvitegevuse kava

  (1) Vald või linn koostab üksi või koos teiste valdade ja linnadega noorte huvihariduse ja huvitegevuse kava, mis võib olla koostatud pikemaks perioodiks kui üks aasta ning olla osa valla või linna arengukavast (edaspidi huvihariduse ja huvitegevuse kava). Huvihariduse ja huvitegevuse kava peab sisaldama:
  1) huvihariduses ja huvitegevuses osalevate noorte arvu 1. oktoobri seisuga;
  2) huvihariduses ja huvitegevuses osalemise võimalusi 1. oktoobri seisuga;
  3) kitsaskohti huvihariduse ja huvitegevuse kättesaadavuses ja mitmekesisuses;
  4) tegevusi kitsaskohtade lahendamiseks.

  (2) Vald või linn esitab huvihariduse ja huvitegevuse kava või esitatud kavas tehtud muudatused ning kava täitmise iga-aastased tulemused 15. jaanuariks Haridus- ja Teadusministeeriumile või tema volitatud asutusele.

§ 153.  Huviala valdkondade kvaliteedi arendamise toetus

  (1) Riigieelarves nähakse võimaluse korral ette sihtotstarbeline toetus huviala valdkondade kvaliteedi arendamiseks ja huviala valdkonna sees koostöö suurendamiseks.

  (2) Käesoleva paragrahvi lõikes 1 nimetatud toetuse taotleja:
  1) lähtub käesoleva seaduse § 4 lõikes 2 sätestatud põhimõtetest;
  2) esindab noorte huvihariduse ja huvitegevuse pakkujaid rohkem kui ühel huvialal;
  3) teeb koostööd huviala valdkonna teiste ühingutega.

  (3) Huviala valdkondade kvaliteedi arendamise toetust saavate huviala valdkondade loetelu ning toetuse taotlemise, eraldamise ja eraldamisest keeldumise tingimused ja korra kehtestab valdkonna eest vastutav minister määrusega.

§ 18.  Noorteühingute registri ja noortelaagrite registri pidamise lõpetamine

  Noorteühingute register ja noortelaagrite register likvideeritakse kooskõlas arhiiviseaduses ja avaliku teabe seaduses sätestatud nõuetega.

§ 19.  Noortelaagri tegevusloa kehtivus

  Noortelaagri tegevusluba, mis on pidajale antud enne käesoleva seaduse jõustumist kehtinud nõuete kohaselt, kehtib loal märgitud kehtivuse lõpuni.

§ 191.  Valla või linna huvihariduse ja huvitegevuse kava esitamine 2017. aastal ning 2017. aasta huvihariduse ja huvitegevuse kava täitmise tulemuste esitamine

  (1) 2017. aastal esitab vald või linn huvihariduse ja huvitegevuse kava 1. juuli seisuga Haridus- ja Teadusministeeriumile või tema volitatud asutusele 2017. aasta 1. septembriks.

  (2) 2017. aasta huvihariduse ja huvitegevuse kava täitmise tulemused esitab vald või linn koos 2018. aasta huvihariduse ja huvitegevuse kava täitmise tulemustega Haridus- ja Teadusministeeriumile või tema volitatud asutusele 2019. aasta 15. jaanuariks.
