Temporary restriction on crossing the state border due to the spread of the coronavirus causing the COVID-19 disease

Under § 17 (1) 1) of the State Borders Act:

1. In connection with the worldwide pandemic spread of the coronovirus causing the COVID-19 disease, identification of the spread of the virus within Estonia and the great probability of its escalation and the subsequent threat of mass infections, the crossing of the external border for the purpose of entering Estonia and, if the border control is temporarily reintroduced on the internal border, the crossing of the internal border are temporarily restricted.

2. Crossing of the state border for the purpose of entering Estonia is allowed for persons who have Estonian citizenship, Estonian residence permit or right of residence or whose permanent place of residence according to the population register is in Estonia.

3. Crossing of the state border for the purpose of entering Estonia is allowed for foreigners who are asymptomatic and who are employees of diplomatic missions or consular posts of foreign states in Estonia or their family members or foreigners arriving in Estonia in the framework of international military cooperation.

4.Crossing of the state border for the purpose of entering Estonia is allowed for foreigners who are asymptomatic and who are directly involved in transporting goods and raw products, including loading of goods or raw products.

5. Crossing of the state border for the purpose of entering Estonia is allowed for foreigners who are asymptomatic and who are providing health services or other services necessary for responding to an emergency.

5¹. Crossing of the state border for the purpose of entering Estonia is allowed for foreigners who are asymptomatic and who are directly involved in international carriage of goods and passengers, including a crew member and a ship’s crew member servicing an international means of transport and a person performing repairs or warranty or maintenance work on such a means of transport.

5². Crossing of the state border for the purpose of entering Estonia is allowed for foreigners who are asymptomatic and who are servicing travel groups and who are directly involved in the provision of passenger transport services.

5³. Crossing of the state border for the purpose of entering Estonia is allowed for foreigners who are asymptomatic and whose purpose for arriving in Estonia is related to ensuring the continuity of a vital service.

5⁴. Crossing of the state border for the purpose of entering Estonia is allowed for foreigners who are asymptomatic and whose arrival in Estonia is related to the maintenance or repair of or warranty or information and communication technology work on equipment of a company operating in Estonia if this is necessary for ensuring the operation of the company.

5⁵. Crossing of the state border for the purpose of entering Estonia is allowed for foreigners who are asymptomatic and whose border crossing serves the purpose of going to work or from work to their place of residence, moving between the Republic of Estonia and the Republic of Latvia.

6. By way of an exception, the Police and Border Guard Board may allow the state border to be crossed for the purpose of entering Estonia by a foreigner:
1) who is asymptomatic and whose direct blood relative in the ascending or descending line or spouse is an Estonian citizen or a person holding an Estonian residence permit or right of residence;
2) who is asymptomatic and whose entry in the country is justified under a special request.

7. Crossing of the state border for the purpose of entering Estonia is allowed for foreigners for immediate transit through the territory of Estonia for reaching their country of residence, provided they are asymptomatic.

8. Said measures shall apply until this Order is changed and the need for these measures shall be assessed no later than after every two weeks.

9. This Order takes effect on 17 March 2020.

Riigipiiri seaduse § 17 lõike 1 punkti 1 alusel:

1. Seoses COVID-19 haigust põhjustava koroonaviiruse pandeemilise levikuga maailmas, viiruse Eesti-sisese leviku tuvastamisega ja laienemise suure tõenäosusega ja sellest tingitud massilise nakatumise ohuga ajutiselt piirata Eestisse sisenemise eesmärgil välispiiri ületamist ja sisepiiril piirikontrolli ajutise taaskehtestamise korral sisepiiri ületamist.

2. Riigipiiri on lubatud Eestisse sisenemise eesmärgil ületada isikul, kellel on Eesti kodakondsus, Eesti elamisluba või elamisõigus või kelle alaline elukoht rahvastikuregistri järgi on Eestis.

3. Riigipiiri on lubatud Eestisse sisenemise eesmärgil ületada välismaalasel, kellel ei esine haigusnähte ja kes on Eestis asuvate välisriikide diplomaatiliste esinduste või konsulaarasutuste töötaja või tema perekonnaliige või rahvusvahelise sõjalise koostöö raames Eestisse saabuv välismaalane.

4. Riigipiiri on lubatud Eestisse sisenemise eesmärgil ületada välismaalasel, kellel ei esine haigusnähte ning kes on seotud vahetult kauba ja tooraine transpordiga, sealhulgas kauba või tooraine laadimisega.

5. Riigipiiri on lubatud Eestisse sisenemise eesmärgil ületada välismaalasel, kellel ei esine haigusnähte ja kes osutab tervishoiuteenuseid või muid hädaolukorra lahendamiseks vajalikke teenuseid.

5¹. Riigipiiri on lubatud Eestisse sisenemise eesmärgil ületada välismaalasel, kellel ei esine haigusnähte ja kes on vahetult seotud rahvusvahelise kauba- ja reisijateveoga, sealhulgas rahvusvahelist transpordivahendit teenindav meeskonna- või laevapereliige ja transpordivahendil remondi-, garantii- või hooldustöid tegev isik.

5². Riigipiiri on lubatud Eestisse sisenemise eesmärgil ületada välismaalasel, kellel ei esine haigusnähte ning kes teenindab reisigruppe ja on vahetult seotud reisijaveo teenuse osutamisega.

5³. Riigipiiri on lubatud Eestisse sisenemise eesmärgil ületada välismaalasel, kellel ei esine haigusnähte ja kelle Eestisse saabumise eesmärk on seotud elutähtsa teenuse toimepidevuse tagamisega.

5⁴. Riigipiiri on lubatud Eestisse sisenemise eesmärgil ületada välismaalasel, kellel ei esine haigusnähte ja kelle Eestisse saabumine on seotud Eestis tegutseva ettevõtte seadme hooldamise, remondi-, garantii- või info- ja kommunikatsioonitehnoloogia alase tööga, kui see on vajalik ettevõtte tegevuse tagamiseks.

5⁵. Riigipiiri on lubatud Eestisse sisenemise eesmärgil ületada välismaalasel, kellel ei esine haigusnähte ja kelle piiriületuse eesmärk on liikuda tööle või töölt elukohta Eesti Vabariigi ja Läti Vabariigi vahel.

6. Erandina võib Politsei- ja Piirivalveamet lubada riigipiiri ületada Eestisse sisenemise eesmärgil välismaalasel:
  1) kellel ei esine haigusnähte ning kelle otsejoones alaneja või üleneja sugulane või abikaasa on Eesti kodanik, Eesti elamisluba või elamisõigust omav isik;
  2) kellel ei esine haigusnähte ning kelle riiki lubamine on põhjendatud eritaotluse alusel.

7. Riigipiiri on lubatud Eestisse sisenemise eesmärgil ületada välismaalasel Eesti territooriumi viivitamata läbimise eesmärgil oma elukohariiki jõudmiseks tingimusel, et tal ei esine haigusnähte.

8. Nimetatud meetmed kehtivad kuni selle korralduse muutmiseni ning nende vajalikkust hinnatakse hiljemalt iga kahe nädala järel.

9. Korraldus jõustub 17. märtsil 2020. a.
