Labelling Requirements for Footwear, Clothing and Textile Products1

The regulation is established on the basis of subsection 71 of § 5 of the Consumer Protection Act.

§ 1.  Scope of application

 (1) The regulation lays down more specific requirements for the labelling of footwear, clothing and textile products offered or sold to the consumer.

 (2) The regulation does not apply to:
 1) protective footwear covered by Regulation (EU) 2016/425 of the European Parliament and of the Council on personal protective equipment and repealing Council Directive 89/686/EEC (OJ L 81, 31.3.2016, p. 51–98);
 2) toy footwear, clothing and textile products;
 3) worn footwear and clothing and other used textile products if identified as such by the supplier or seller.

§ 2.  Footwear

  For the purposes of this regulation, footwear is deemed to mean any product with soles as well as separately marketed main components of such product as specified in Annex 1 to the regulation that are intended to cover or protect the foot.

§ 3.  Labelling requirements for footwear

 (1) The definitions of the main components of footwear and the pictograms and written indications to be used for their labelling are set out in Annex 1 to the regulation.

 (2) The labelling of footwear must include information in the form of pictograms or written indications of the materials used in the main components of footwear representing at least 80 per cent of the external surface of the upper, lining and sock and at least 80 per cent of the volume of the outer sole. The definitions, corresponding pictograms and written indications of the materials used in footwear are set out in Annex 2 to the regulation.

 (3) For the purposes of labelling the material used in the upper of footwear, the accessories and reinforcements used in footwear, such as ankle supports, rims, ornaments, buckles, decorative straps, lacing hole supports and other similar accessories are not taken into account.

 (4) Where the proportion of the materials used in the main components of footwear is less than 80 per cent, the labelling must contain information on the two main materials used in the manufacture of the footwear.

 (5) Information on the materials used in the main components of footwear is presented on or with at least one article of footwear in each pair in the form of a pictogram or a written indication in Estonian. The specified information may be printed, sticked or embossed on the footwear or presented on a label attached to the footwear. The pictogram or written indication of the materials used in accordance with Annex 2 to the regulation must be adjacent to the pictogram or written indication representing the corresponding main components of footwear in accordance with Annex 1 to the regulation.

§ 4.  Labelling requirements for clothing and textile products

 (1) For the purposes of this regulation, the term ‘textile product’ is used in accordance with the provisions of Articles 3(1)(a) and (b) of Regulation (EU) No 1007/2011 of the European Parliament and of the Council on textile fibre names and related labelling and marking of the fibre composition of textile products and repealing Council Directive 73/44/EEC and Directives 96/73/EC and 2008/121/EC of the European Parliament and of the Council (OJ L 272, 18.10.2011, p. 1–64).

 (2) At least the following information is presented on the labelling of clothing and textile products:
 1) the product name, where its absence may mislead the consumer;
 2) information about the size of the product;
 3) instructions for the care of the product.

 (3) The information specified in clauses 2 and 3 of subsection 2 need not be provided for a textile product specified in Annex V to Regulation (EU) No 1007/2011 of the European Parliament and of the Council.

 (4) In addition to the information specified in subsection 2, at least the following information is presented on the labelling of fur and leather garments:
 1) the type of material;
 2) in the case of natural fur, the species of animal.

 (5) Instructions for the care of clothing and textile products are indicated directly on the product, on a textile ribbon securely attached to the product, on a label attached to the product or on the sales packaging of the product.

 (6) It is recommended to provide information on the size of the product on the basis of the Estonian standard EVS-EN 13402 or another equivalent standard and it is recommended to provide the instructions for care on the basis of the Estonian standard EVS-EN ISO 3758 or another equivalent standard.
