§ 1. Salary of higher state servants
(1) This Act regulates the salaries of higher state servants.
(2) The salary of higher state servants is the highest salary rate specified in § 2 of this Act multiplied by the factor specified in § 3.

§ 2. Highest salary rate of higher state servants
(1) The highest salary rate of higher state servants shall be 5,200 euros.
(2) After indexation provided in § 21 of this Act the highest salary rate resulting from the indexation in the previous year is considered to be the highest salary rate next year.

§ 21. Indexation of highest salary rate of higher state servants
(1) The highest salary rate specified in § 2 of this Act is indexed by 1 April each calendar year with the highest salary rate index the value of which is dependent 20% on the annual increase in the consumer price index and 80% on the annual increase in the receipt of the pension insurance part of social tax. The index shall be given with the accuracy to three decimal places.
(2) Upon calculation of the index the annual increase in the consumer price index is multiplied by 0.2 and the annual increase in the receipt of the pension insurance part of social tax is multiplied by 0.8 and the resulting products are added.
(3) The annual increase in the consumer price index shall be calculated by dividing the value of the consumer price index for the previous calendar year with the value of the consumer price index for the year before the previous calendar year on the basis of the value of the consumer price index officially published by Statistics Estonia.
(4) The annual increase in the receipt of the pension insurance part of social tax shall be calculated by dividing the total amount of the pension insurance part of social tax for the previous calendar year with the value of the total amount of the pension insurance part of social tax for the year before the previous calendar year, on the basis of the data of the Ministry of Finance concerning the receipt of pension insurance part of social tax.
(5) The annual increase in the consumer price index and the receipt of social tax shall be expressed with the accuracy to three decimal places.
(6) The highest salary rate index specified in subsection 1 of this section shall be published by the Ministry of Finance on its web page by 15 March of each calendar year.

§ 3. Coefficients applicable to salaries of higher state servants
(1) The coefficient for the salary of the President of the Republic shall be 1.0.
(2) The coefficient for the salary of the President of the Riigikogu shall be 1.0.
(3) The coefficient for the salary of the Prime Minister shall be 1.0.
(4) The coefficient for the salary of the Chief Justice of the Supreme Court shall be 1.0.
(5) The coefficient for the salary of the Vice-President of the Riigikogu shall be 0.85.
(6) The coefficient for the salary of the Auditor General shall be 0.85.
(7) The coefficient for the salary of the Chancellor of Justice shall be 0.85.
(8) The coefficient for the salary of a justice of the Supreme Court shall be 0.85.

(9) The coefficient for the salary of a minister shall be 0.85.

§ 4. Change in salary rate of higher state servants
The change in the highest salary rate provided in subsection 1 of § 2 of this Act shall enter into force on the day of commencement of authority of the following composition of the Riigikogu.

§ 41. Reduction of coefficients for salaries of higher state servants during increased defence readiness and state of war
(1) During increased defence readiness and a state of war, if it is necessary in the interests of ensuring the security of the state to make changes in the State Budget Act as a result of which salaries payable from the state budget shall be reduced, the Government of the Republic shall have the right to make a proposal to the Riigikogu for temporary reduction of the coefficients provided for in subsections 1, 3, 4, 6–10, 12, 14 and 16–21 of § 3 of this Act.
(2) The proposal of the government of the Republic shall set out the extent of the reduction of coefficients, taking proportionally account of the extent of reduction of the total amount of salaries payable from the state budget.
(3) The Riigikogu shall decide on the reduction of coefficients, extent of reduction and period of validity of the decision at the earliest opportunity as from the submission of the proposal of the Government of the Republic.
(4) The decision of the Riigikogu shall enter into force on the first date of the calendar month following the decision.

§ 17. Implementation of indexation of highest salary rate of higher state servants

§ 171. Specification of application of highest salary rate resulting from indexation
(1) The highest salary rate resulting from indexation provided in subsection 2 of § 2 of this Act shall be applied with regard to the persons specified in subsections 1–3, 5, 9, 11, 13 and 15 of § 3 from the day on which the mandate of the XIV Riigikogu begins.
(2) Upon calculation of the salary of the persons referred to in subsection 1 of this section until the day on which the mandate of the XIV Riigikogu begins the redaction of this Act in force until 1 March 2018 shall be applied.

§ 172. Specification of indexation of highest salary rate provided for higher state servants from 1 April 2024 until 31 March 2028
(1) From 1 April 2024 until 31 March 2028, the highest salary rate provided in § 2 of this Act for persons specified in subsections 3, 8–10, 14 and 16–19 of § 3 of this Act is indexed with an index of the temporary highest salary rate by 1 April of each calendar year.
(2) For calculating the index of the temporary highest salary rate, the index calculated in accordance with § 21 of this Act is added one and the result is divided by two.
(3) The highest salary rate of the preceding year calculated for persons specified in subsection 1 of this section multiplied by the index of the temporary highest salary rate is deemed to be the highest salary rate.
(4) The official salary of the persons specified in subsection 1 of this section is the product of the highest salary specified in the same subsection and the coefficient provided in § 3 of this Act.

§ 19. Entry into force of Act
(1) This Act shall enter into force on 1 January 2012.

(11) Subsections 4, 8, 14 and 16 of § 3 and § 6 shall enter into force on 1 July 2013.
