Order of the person in charge of emergency situation for imposing a restriction on movement after crossing the state border

Due to the emergency situation declared by the Government of the Republic Order No. 76 “Declaration of an emergency situation in the administrative territory of the Republic of Estonia” of 12 March 2020, the person in charge of emergency situation decides:
1. Under
§ 31 (3) of the Emergency Act, a restriction on the freedom of
movement is imposed for 14 calendar days on persons permitted to enter
Estonia on the state border of the Republic of Estonia. Within 14 calendar
days after arriving in Estonia, such persons are prohibited from leaving their
place of residence or permanent place of stay.

2. Persons may leave their place of residence or permanent place of stay on the order of a health care professional or a police officer or in case of an emergency jeopardising the person’s life or health.
3. The
restriction set out in clause 1 does not apply to the following
asymptomatic persons who are allowed to enter Estonia:
1) employees of diplomatic
missions or consular posts of foreign states in Estonia and their family
members and foreigners arriving in Estonia in the framework of international
military cooperation;
2) persons who are directly involved in transporting goods or raw products,
including loading of goods or raw products;

3) persons who are directly involved in international
carriage of goods and passengers, including a crew member or a ship’s crew
member servicing an international means of transport and a person performing
repairs or warranty or maintenance work on such a means of transport;

4) persons who are servicing
travel groups and who are directly involved in the provision of passenger
transport services;
5) health care professionals
and persons providing other services necessary for responding to an emergency;
6) persons who are allowed
to cross the state border for the purpose of reaching their country of
residence;

62) persons whose border crossing serves the
purpose of going to work or from work to their place of residence, moving
between the Republic of Estonia and the Republic of Latvia;

7) persons referred to in
clause 2 of the Government of the Republic Order No. 78 “Temporary
restriction on crossing the state border due to the spread of the coronavirus
causing the COVID‑19 disease” of 15 March 2020 to whom the Police and
Border Guard Board does not apply the restriction on the freedom of movement
and foreigners whom the Police and Border Guard Board has given permission to
enter Estonia on the basis of their special request under
sub-clause 6 2) of said Order;

8) persons whose permanent
place of residence registered in the population register is in the Republic of
Estonia but whose place of employment is in the Republic of Finland;

9) persons whose purpose for arriving in Estonia is
related to ensuring the continuity of a vital service;

10) persons whose arrival in Estonia is related to the
maintenance or repair of or warranty or information and communication technology
work on equipment of a company operating in Estonia if this is necessary for
ensuring the operation of the company.

31. The restriction set out in clause 1 does not apply to the following asymptomatic persons who are allowed to enter Estonia from the Republic of Finland:
1) person’s purpose for arriving in
Estonia is work or performance of other contractual obligations;
2) persons who are studying in an educational
institution registered in Estonia;
3) persons arriving in Estonia for urgent family
reasons, above all to meet a close relative, a funeral, a wedding or cases of
illness.

32. The
persons referred to in sub-clause 8 of clause 3 and in clause 31
of this Order will take a voluntary test for the coronavirus causing the
COVID-19 disease on ferries sailing between the Republic of Finland and the
Republic of Estonia from 14 to 19 May.

4. Under § 24 (2) of the Emergency Act, for responding to the emergency that led to the declaration of an emergency situation, the Police and Border Guard Board is assigned the duty of ensuring the restriction on movement provided for in this Order pursuant to the terms and conditions set out in the Order.
5. Said measures shall apply until this Order is changed and the need for these measures shall be assessed no later than after every two weeks.
6. Broadcasters and electronic communications undertakings shall publish the Order promptly in unaltered form and free of charge.
7. This Order takes effect on 17 March 2020.
This Order establishes specific measures for the protection of
the life and health of people and overriding public interest, said measures
being essential for preventing the spread of the virus. The reasons and
considerations are set out in the explanatory memorandum to the Order, which
will be published on the website of the Government of the Republic.
Failure to duly comply with measures of emergency situation will prompt the application of the administrative coercive measures set out in § 28 (2) or (3) of the Law Enforcement Act. According to § 47 of the Emergency Act, the amount of penalty payment is 2000 euros.
This Order can be appealed against pursuant to the procedure provided for in the Code of Administrative Court Procedure.
