The regulation is established based on subsection 1 of § 27 of the International Sanctions Act.

§ 1.  Scope of regulation

  In order to support the objectives specified in subsection 1 of § 3 and in § 4 of the International Sanctions Act, the regulation establishes, as the sanctions of the Government of the Republic, the restriction on the granting of visas, on short-term employment in Estonia and granting temporary residence permits for employment, study or business to citizens of the Russian Federation and the Republic of Belarus.

§ 2.  Scope of application

 (1) The regulation applies to all citizens of the Republic of Belarus who apply for a visa or temporary residence permit on the following grounds provided in the Aliens Act:

 1) the visa specified in §-s 621 for short-term employment in Estonia;
 2) the visa specified in §-s 624 for engaging in start-up business;
 3) the visa specified in §-s 625 for teleworking;
 4) the visa specified in §§ 59 and 60 for the purpose of engaging in business;
 5) the temporary residence permit for employment specified in clause 4 of § 118;
 6) the temporary residence permit for business specified in clause 5 of § 118.

 (11) The regulation is applied to all citizens of the Russian Federation who apply for a temporary residence permit on the following grounds provided in the Aliens Act:

 2) a temporary residence permit for study specified in clause 3 of § 118;

 3) a temporary residence permit for employment specified in clause 4 of § 118;

 4) a temporary residence permit for business specified in clause 5 of § 118.

 (12) The regulation is applied to all citizens of the Russian Federation who apply for a visa.

 (2) The regulation is applied to all citizens of the Russian Federation and the Republic of Belarus who do not have a valid visa issued by Estonia and who are applying for registration of short-term employment in Estonia.

 (3) The Regulation is not applied to citizens of the Russian Federation and the Republic of Belarus who apply for an extension of a temporary residence permit issued for employment or business, or who have the abovementioned residence permit, and who commence employment for another employer.

 (4) The regulation is not applied to citizens of the Russian Federation and the Republic of Belarus who are journalists accredited by the Ministry of Foreign Affairs and who have a legal basis for staying in Estonia.

 (5) The regulation is not applied to citizens of the Republic of Belarus who have a legal basis for staying in Estonia and who apply for a temporary residence permit for employment in a professional position in information and communication technology.

 (6) The Regulation is not applied to citizens of the Russian Federation who apply for a visa and:
 1) visit a direct descendant or ascendant relative or spouse of an Estonian citizen living in Estonia or a person holding an Estonian long-term residence permit;
 2) visit an Estonian citizen living in Estonia or a person holding an Estonian long-term residence permit with whom they are raising a common minor child;
 3) are employees of a diplomatic mission or consular institution located in Estonia or their family members;
 4) are directly related to the international transport of goods and passengers, including service personnel or crew members of a vessel, servicing the international means of transport, and persons performing repair, warranty or maintenance work on the means of transport;
 5) are persons who have the right to free movement based on the European Union law or
 6) whose arrival in Estonia is necessary for humanitarian reasons.

 (7) The regulation is not applied to citizens of the Russian Federation who apply for a one- time extension of a temporary residence permit for study by up to one year.
