Requirements for the accessibility of websites and mobile applications, and the rules for publishing information describing accessibility

This Regulation is enacted on the basis of Section 32(2) of the Public Information Act1 [avaliku teabe seadus].

§ 1.  Terms

  For the purposes of this Regulation, the following definitions apply:
 1) accessibility — the principles to be observed and the technical specifications to be used when designing, constructing, maintaining and updating websites and mobile applications in order to make them perceivable, operable, understandable and robust for users;
 2) mobile application — application software that is developed for use on mobile devices and does not include the software that controls those devices or hardware.

§ 2.  Requirements for the accessibility of websites and mobile applications

 (1) In order to ensure accessibility, websites and mobile applications must be perceivable, operable, understandable and robust, regardless of which sense is used to perceive them.

 (2) It is assumed that websites and mobile applications meet the accessibility requirements if they meet the requirements set out in European standard EN 301 549 V2.1.2 (2018-08).

§ 3.  Publication of information describing accessibility

 (1) For websites, the accessibility statement shall be provided in an accessible format, using the model statement referred to in subsection 3 of this Section, and shall be published on the website of the holder of information.

 (2) For mobile applications, the accessibility statement shall be provided in an accessible format, using the model statement referred to in subsection 3 of this Section, and shall be published on the website of the holder of information or alongside other information available when downloading the application.

 (3) Information describing accessibility shall be presented in line with Commission Implementing Decision (EU) 2018/1523 establishing a model accessibility statement in accordance with Directive (EU) 2016/2102 of the European Parliament and of the Council on the accessibility of the websites and mobile applications of public sector bodies (OJ L 256, 12.10.2018, p. 103).
