Order of the person in charge of emergency situation

1. Under § 24 (2) of the Emergency Act:
1) Local authorities shall devise and propose at the first opportunity solutions as to how to ensure the care of children of preschool age in the event their parents have to be at work, and promptly present these to the person in charge of emergency situation;
2) the Police and Border Guard Board shall carry out health checks at border crossing points in order to identify the country of departure of persons and their self-declared symptoms of disease, including at the external border of the Republic of Estonia and at Ikla, Valga (I, III) and Lilli border crossing points and at ports and airports open to international travel;
3) in collaboration with the Ministry of Social Affairs, the Ministry of Foreign Affairs shall:
a) on a daily basis report to the person in charge of emergency situation on areas of high virus spread, persons arriving from where must avoid contact with other persons for two weeks (isolation);
b) the list referred to in clause a) shall be extended by an order of the person in charge of emergency situation;
c) devise the rules of isolation with the Ministry of the Interior by 16 March 2020.
4) In collaboration with the Government Office, the Ministry of Foreign Affairs shall ensure that embassies and citizens of these countries are informed.
2. Under § 77 of the Police and Border Guard Act and § 30 of the Law Enforcement Act, the Police and Border Guard Board shall request the following information at manned border crossing points: person’s name, country of departure, country of transit, country of destination, e-mail address, phone number, place of residence or place of stay in Estonia. Persons must be informed of the rules in force in Estonia for preventing the spread of the virus.
3. Under § 24 (2) of the Emergency Act, the Ministry of Economic Affairs and Communications, the Ministry of Social Affairs and the Ministry of Foreign Affairs in co-operation with passenger shipping companies shall:
1) develop and implement measures to contain the spread of the virus;
2) inform passengers when buying a ticket and those who have already bought a ticket of the above requirements for isolation.
4. This Order takes effect upon signing.
This Order establishes specific measures for the protection of the life and health of people and overriding public interest, said measures being essential for preventing the spread of the virus. The reasons and considerations are set out in the explanatory memorandum to the Order. The explanatory memorandum to the Order will be published on the website of the Government of the Republic.
Failure to duly comply with measures of emergency situation will prompt the application of the administrative coercive measures set out in § 28 (2) or (3) of the Law Enforcement Act.
This Order can be appealed against pursuant to the procedure provided for in the Code of Administrative Court Procedure.
