The regulation is established on the basis of clause 10 (1) 4) of the Civil Service Act.

§ 1.  Scope of application

 (1) The regulation applies to ministries and administrative agencies in their area of government, the Government Office and the Gender Equality and Equal Treatment Commissioner's Office, taking account of the specifications provided for in subsection 2 (2) of the Civil Service Act.

 (2) The regulation is advisory for the Chancellery of the Riigikogu, the Office of the President of the Republic, the National Audit Office, the Office of the Chancellery of Justice, the courts and local governments.

§ 2.  Establishment of composition of places of employment

 (1) The composition of places of employment (hereinafter composition) is the list of places of employment covered by budget funds of the administrative agency, which gives an overview of human resources necessary to achieve the objectives of the administrative agency.

 (2) The establishment of the composition is based on a form given in Annex 1, which may be supplemented by additional columns in accordance with the needs of the administrative agency.

 (3) The places of employment with similar names of one structural unit may be brought out in one line on the form of the composition, summing up their loads. If the distribution of these places of employment into posts or jobs or their terms are different, they are to be brought out in different lines.

 (4) The places of employment for an unspecified term are indicated with the word "tähtajatu” [for an unspecified term]. In the case of temporary places of employment it is required to indicate the date or event when or related to which the functions or duties of the corresponding place of employment are terminated.

§ 3.  Classification of places of employment

 (1) The places of employment established in the composition are classified on the basis of the classification of places of employment given in Annex 4 and in the form set out in Annex 2.

 (2) If the classification of the places of employment is established by the same person who establishes the composition, the composition and classification of the places of employment may be established in the common form as set out in Annex 3.

 (3) The administrative agencies specified in subsection 1 (1) of the section review the classification of places of employment at least once a year by 1 January and if, upon the review of the classification of places of employment, it turns out that the classification of the places of employment requires changing, a new classification of places of employment is established.

 (4) The amendment of the function group or level of the function group of the place of employment assigned on the basis of this regulation does not entail legal consequences for an official or employee.

§ 4.  Amendment of classification of places of employment in civil service

  The Ministry of Finance assesses the suitability of the classification of places of employment once a year and submits, where appropriate, the updated classification of places of employment to the Government of the Republic for amendment during the fourth quarter of the calendar year.

§ 5.  Entry into force of regulation

 (1) The regulation enters into force on 1 April 2013.

 (2) The places of employment shall be classified in accordance with the classification of places of employment by 1 July 2013.
