Madalmaade Kuningriigi saatkond avaldab oma lugupidamist Eesti Vabariigi

      1. Tööle asumise luba.

      b. Käesolevas kokkuleppes tähendab:
• «ametikohustuste
      täitmiseks nimetatud töötaja» diplomaatilist esindajat,
konsulaarametnikku ning diplomaatilise esinduse ja konsulaarasutuse
      haldus- ja abipersonali liiget;
• «ülalpeetav» ametikohustuste
täitmiseks nimetatud töötaja abikaasat või partnerit, kellest on
teavitatud vastuvõtvat riiki ja keda vastuvõttev riik on sellena
      tunnustanud.

      c. Tööle asumise luba loetakse ilma eelneva teavitamiseta lõppenuks
vastavalt Eestisse või Hollandisse ametikohustuste täitmiseks nimetatud
töötaja lähetuse lõppedes. Käesoleva kokkuleppe alusel saadud töö ei
anna ülalpeetavatele õigust jääda sellele tööle või asuda uuele tööle
Eestis või Hollandis pärast loa lõppemist.

      2. Menetlus

      a. Tööle asumise loa taotluse esitab ülalpeetava nimel saatkond
vastuvõtva riigi välisministeeriumi protokolliosakonnale, näidates ära
      taotletava töökoha.

      uuesti esitada taotlus loa saamiseks.

      3. Puutumatus

      4. Maksu- ja sotsiaalkindlustuse süsteem.

Kokkuleppe alusel tööle asuvate ülalpeetavate kohta kehtib vastuvõtva
riigi maksu- ja sotsiaalkindlustuse süsteem kõigis selles riigis
      töötamist puudutavates küsimustes.

Memorandum of Understanding

The Embassy of the Kingdom of the Netherlands presents its compliments
to the Ministry of Foreign Affairs of the Republic of Estonia and has
the honour to propose that dependants of employees of the Government of
the Kingdom of the Netherlands assigned to official duty in Estonia and
dependants of employees of the Government of the Republic of Estonia
assigned to official duty in the Netherlands shall on a reciprocal
basis, be permitted to engage in a gainful occupation in the receiving
      State.

The Ministry has the honour to propose the following Arrangement:

      1. Authorisation to engage in a gainful occupation

      a. Dependants, as defined below, will be authorized to engage in a
gainful occupation in the receiving State in accordance with the
provisions of the laws and regulations of that State.

      b. For the purpose of this Arrangement it is understood that:
• “an
employee assigned to official duty” means diplomatic agents, consular
officers, and members of the administrative and technical staff and of
      the service staff of diplomatic missions and consular posts;
• “a
dependant” means the spouse or the partner of an employee assigned to
official duty, who has been notified to and accepted as such by the
      receiving State

      c. The authorisation to engage in a gainful occupation will be deemed to
be terminated without prior notification upon the termination of the
assignment of the employee assigned to official duty in Estonia or the
Netherlands, as the case may be. Employment taken up in accordance with
the terms of this Arrangement will not entitle dependants to remain in
such employment or to enter into other employment in Estonia or the
Netherlands after termination of the authorisation.

      2. Procedure

      a. A request for authorisation to engage in a gainful occupation will be
sent on behalf of the dependant by the concerned Embassy to the Protocol
Department of the Ministry of Foreign Affairs of the receiving State,
      specifying the position applied for.

      b. Upon verification that the person is dependant of an employee
assigned to official duty of the concerned Government and after
processing the request according to domestic legislation, the Embassy
will be informed that the dependant may engage in a gainful occupation,
subject to the applicable regulations of the receiving State. The
position mentioned in the preceding paragraph will be printed on the
      identification card of the dependant.

      c. Should the dependant seek to change employment at any time after
receiving the authorisation, a further request for authorisation must be
      made.

civil, administrative and criminal law of the receiving State.

In particular they will comply with the requirements of the applicable
laws and regulations relevant to labour in Estonia or the Netherlands.

It is understood that dependants who obtain employment under this
Arrangement have no immunity from civil and administrative jurisdiction

waive the immunity of the dependants concerned from the criminal
jurisdiction of the receiving State in respect of any act carried out in
the course of employment. This is without prejudice to the right of the
sending State in special instances to adjudge such waiver to be contrary
to its interests, and in such circumstances, to refuse such waivers.

In determining as what action to take in the event a dependant is
charged with a crime related to employment, each party will consult with
a view towards satisfying each other’s legitimate interests.

      4. Fiscal and Social Security Regimes

Dependants who engage in a gainful occupation in accordance with this
Arrangement will be subject to the fiscal and social security regimes of
the receiving State for all matters connected with their gainful
      occupation in that State.

      5. Duration and Termination

This Arrangement will remain in operation for an indefinite period.
Either side may terminate it at any time by giving 90 (ninety) day’
notice in writing to the other State.

If this proposal is acceptable to the Government of the Republic of
Estonia, this Note and the reply of the Ministry shall together
constitute an Arrangement between the Government of the Kingdom of the
Netherlands and the Government of the Republic of Estonia which shall
come into effect on the date of the Ministries reply.
