      Tema Ekstsellents<br/>hr Shigeo Kondo<br/>Jaapani erakorraline ja

    <p>
      Ekstsellents
    </p>
    <p>
      Mul on au teatada, et olen kätte saanud Teie Ekstsellentsi tänase
      kuupäevaga noodi, mis on järgmine:
    </p>
    <p>
      «Mul on au viidata Jaapani valitsuse ja Eesti Vabariigi valitsuse
      esindajate äsjastele kõnelustele, millel käsitleti eksponeerimis- ja
      konserveerimisvahendite (edaspidi <i>tehnika</i>) tarnimist Eesti
      Kunstimuuseumile (edaspidi <i>toetuse saaja</i>), ning teha Jaapani
      valitsuse nimel järgmine ettepanek.
    </p>
    <p>
      1. Et aidata kaasa kultuuripärandi säilitamise edendamisele Eesti
      Vabariigis, pakub Jaapani valitsus Eesti Vabariigi valitsusele Jaapani
      asjakohaste õigusaktide kohaselt toetust kuni nelikümmend üks miljonit
      kuussada tuhat jeeni (¥ 41 600 000) (edaspidi <i>toetus</i>).
    </p>
    <p>
      2. Toetus tehakse kättesaadavaks selle ettepaneku jõustumise kuupäeva ja
      31. märtsi 2006 vahelisel ajal. Ajavahemikku võib pikendada kahe
      valitsuse asjaomaste asutuste vastastikusel kokkuleppel.
    </p>
    <p>
      3. 1) Eesti Vabariigi valitsus kasutab toetust sihtotstarbeliselt ja
      ainult selleks, et osta tehnikat, mis on Jaapani või Eesti Vabariigi
      tooted, ja niisuguste toodete hankega seotud teenuseid, sealhulgas
      tehnika vedu Eesti Vabariigi sadamatesse.<br/>2) Kui mõlemad valitsused
      peavad seda vajalikuks, võib hoolimata alapunktist 1 osta toetuse
      summast tehnikat, mis ei ole Jaapani ega Eesti Vabariigi tooted.
    </p>
    <p>
      4. Punktis 3 viidatud tehnika ja teenuste ostmiseks sõlmib Eesti
      Vabariigi valitsus või tema määratud asutus lepingu Jaapani jeenides
      Jaapani kodanikega. (Mõiste “Jaapani kodanikud”, mida ettepanekus
      kasutatakse, tähendab Jaapani füüsilisi või juriidilisi isikuid, keda
      kontrollivad Jaapani füüsilised isikud). Niisugused lepingud kinnitab
      Jaapani valitsus, et need vastaksid toetuse saamise nõuetele.
    </p>
    <p>
      5. 1) Eesti Vabariigi valitsus või tema määratud asutus avab Eesti
      Vabariigi valitsuse nimel ühes Jaapani pangas, mille määrab Eesti
      Vabariigi valitsus või tema määratud asutus, pangakorralduste teel
      pangakonto, mida kasutatakse üksnes toetuse jaoks.<br/>2) Jaapani
      valitsus teeb Jaapani jeenides maksed, et katta kohustusi, mis on
      tekkinud Eesti Vabariigi valitsusele või tema määratud asutusele
      kinnitatud lepingute alusel, millele on viidatud punktis 4 (edaspidi <i>kinnitatud
      lepingud</i>). Maksed tehakse pangakontole, millele on viidatud
      alapunktis 1, kui Jaapani valitsusele on maksenõuded esitanud pank,
      millele on viidatud alapunktis 1, maksekorralduse alusel, mille on
      väljastanud Eesti Vabariigi valitsus või tema määratud asutus.
    </p>
    <p>
      6. 1) Eesti Vabariigi valitsus võtab meetmeid:<br/>a) et tagada
      tehnika viivitamata mahalaadimine ja tollivormistus Eesti Vabariigi
      lossimissadamates ja sisevedudel;<br/>b) et tagada, et tollimaksud,
      riigisisesed maksud ja muud lõivud, mida võidakse Eesti Vabariigis
      kohaldada toetusega seotud tehnika või teenuste suhtes, tasub Eesti
      Kunstimuuseum;<br/>c) et võimaldada Jaapani kodanikele, kelle teenuseid
      võidakse vajada seoses tehnika tarnimise ja teenustega kinnitatud
      lepingute alusel, vajalikke soodustusi Eesti  Vabariiki sisenemisel ja
      seal viibimisel töö tegemiseks;<br/>d) et tagada tehnika
      nõuetekohane ja tõhus korrashoid ning<br/>e) et lisaks
      toetusest kaetud kulutustele kanda kõik kulutused, mis on vajalikud
      toetuse rakendamiseks.<br/>2) Toetuse abil ostetud tehnika meretranspordi
      ja merekindlustuse puhul hoidub Eesti Vabariigi valitsus igasugustest
      kitsendustest, mis võiksid takistada õiglast ja vaba konkurentsi
      meretranspordi ja merekindlustuse ettevõtete vahel.<br/>3) Toetuse
      abil ostetud tehnikat ei veeta Eesti Vabariigist taas välja.
    </p>
    <p>
      7. Mõlemad valitsused peavad teineteisega nõu küsimustes, mis võivad
      ettepanekuga seotud olla või sellest tuleneda.
    </p>
    <p>
      Järgnevalt on mul au teha ettepanek, et käesolevat nooti ja Teie
      Ekstsellentsi vastunooti, millega Eesti Vabariigi valitsuse nimel
      kinnitatakse eeltoodud ettepanekut, käsitatakse kui kahe valitsuse
      kokkulepet, mis jõustub Teie Ekstsellentsi vastunoodi kuupäeval.»
    </p>
    <p>
      Järgnevalt on mul au Eesti Vabariigi valitsuse nimel kinnitada eeltoodud
      ettepanekut ja nõustuda sellega, et Teie Ekstsellentsi noot ja käesolev
      vastunoot moodustavad kahe valitsuse kokkuleppe, mis jõustub käesoleva
      vastuse kuupäeval.
    </p>
    <p>
      Võimalust kasutades kinnitan Teie Ekstsellentsile oma sügavaimat
      lugupidamist.<br/>Tallinn, 18.11.2005.

    <p>
      Viidates Eesti Vabariigi valitsuse ja Jaapani valitsuse nootide
      vahetamise teel 18. novembril 2005. aastal sõlmitud kokkuleppe
      punktidele 1, 3, 4 ja 5 (edaspidi <i>nootide</i> <i>vahetamine</i>), mis
      käsitlevad Jaapani kultuuriabikoostööd eksponeerimis- ja
      konserveerimisvahendite (edaspidi <i>tehnika</i>) tarnimiseks Eesti
      Kunstimuuseumile, soovivad Eesti Vabariigi valitsuse ja Jaapani
      valitsuse esindajad protokollida järgmised protseduurilised üksikasjad,
      mille suhtes kahe valitsuse asjaomased ametiasutused on omavahel kokku
      leppinud.
    </p>
    <p>
      <b>1.</b> Hankekonkurss
    </p>
    <p>
      1) Toetust tuleb nootide vahetamise punkti 3 alapunktis 1 viidatud
      tehnika ja teenuste ostmisel kasutada tõhusalt ja
      mittediskrimineerivalt. Et tagada niisugustest nõuetest kinnipidamine,
      peab Eesti Vabariigi valitsus või tema määratud asutus palkama iseseisva
      ning pädeva esindaja Eesti Vabariigi valitsuse või tema määratud asutuse
      abistamiseks, et korraldada tehnika hankekonkurss.
    </p>
    <p>
      Ühe kuu jooksul pärast nootide vahetamise jõustumist sõlmib Eesti
      Vabariigi valitsus või tema määratud asutus lepingu, nagu on viidatud
      nootide vahetamise punktis 4, Jaapani Rahvusvahelise Koostöö Süsteemiga (<i>Japan
      International Cooperation System</i>, JICS) (edaspidi <i>esindaja</i>),
      et abistada Eesti Vabariigi valitsust või tema määratud asutust esindaja
      volituste piires, nagu on ette nähtud lisas.
    </p>
    <p>
      2) Nimetatud leping jõustub pärast Jaapani valitsuse kirjalikku
      kinnitust.
    </p>
    <p>
      <b>2.</b> Esindaja tasu
    </p>
    <p>
      1) Nootide vahetamise punktis 1 märgitud summa sisaldab esindaja tasu.
    </p>
    <p>
      2) Eesti Vabariigi valitsus või tema määratud asutus väljastab eeltoodud
      kokkuleppe kohaselt maksekorralduse nootide vahetamise punkti 5
      alapunktis 1 viidatud pangale.
    </p>
    <p>
      <b>3.</b> Eesti Vabariigi valitsuse ametnik ei võta enda kanda mitte
      mingit osa Jaapani kodaniku tööst tehnika ja teenuste tarnimisel,
      millele on viidatud nootide vahetamise punktis 4.
    </p>
    <p>
      <b>4.</b> Kui nootide vahetamise punktis 1 nimetatud toetuse kava
      soovitakse muuta, peab Eesti Vabariigi valitsus konsulteerima Jaapani
      valitsusega ja saama Jaapani valitsuselt selleks nõusoleku.

      with the relevant laws and regulations of Japan, a grant up to forty-one
      million six hundred thousand yen (¥ 41, 600, 000) (hereinafter referred

      requests are presented by the bank referred to in sub-paragraph (1)
      above to the Government of Japan under an authorization to pay issued by
      the Government of the Republic of Estonia or its designated authority.
    </p>
    <p>
      6. (1) The Government of the Republic of Estonia shall take necessary
      measures:<br/>(a) to ensure prompt unloading and customs clearance at
